To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. FLI Environmental, Inc. (FLI)was retained by Shallow Pond Nominee Trusi to perform an asbestos inspection at 1555 Iyannough Road, Hyannis, Massachusetts. The inspection included a visual survey and sampling for suspect asbestos containing materials (ACMs) throughout buildings 1, 2, & 3:. As part of the inspection one hundred-sixty three (163) bulk samples were collected for analysis to confirm the asbestos content of suspect- building materials. However, of the one hundred sixty-three samples collected only one hundred sixty-two (162)were analyzed. :When multiple samples of a similar material were collected and one was found to contain asbestos the remaining similar materials were not analyzed (positive stop). Samples not analyzed due to a.positive stop are considered asbestos containing and are listed in section 3.0. Multiple joint - compound/textured ceiling samples were analyzed and found to contain 2%asbestos. In an effort to reduce abatement cost joint compound samples were reanalyzed utilizing The Point Count Procedure. This analytical method is better able to determine exact asbestos , content at low.percentages. Analytical results from the Point Count Procedure supersede the initial results (see sub-section 4.0 &_section_3). According to,MA DEP and EPA regulations materials found to.contain <1%asbestos by this analytical method can be handled as non asbestos. Point Count results determined the asbestos content in the joint- compound to be,<1%. The inspection and sampling was'performed by FLI's Carl . Pennor, MA DOS Asbestos Inspector License#AI 62010 on October 30.& 31, 2008 & November 7, 2008 2. The summary report contains a summary of the findings-and bulk sample analytical results. Bulk samples were collected in a random manner and submitted via.chain of custody to EMSL Analytical Services,Inc. located in Woburn, Massachusetts., The'samples were analyzed by Polarized Light Microscopy per EPA method 600/R-93-116, July 1993 and where required were analyzed by TEM.Method EPA/600/R-93/116 Section 2.5.5.1, or via EPA 600/R-93/116 Quantitation using 400 Point count Procedure. The detection limit of the EPA recommended method is one percent asbestos by weight:Materials containing greater than one per cent asbestos are treated as asbestos-containing as determined by the EPA. The laboratory is certified by the National Institute of Standards and Technologies NIST%NVLAP Program (NVLAP #02079-0) and the Massachusetts Department of Occupational Safety: 2. Any additional suspect materials not identified in this report that become exposed during building renovation, maintenance or demolition should be sampled and analyzed for asbestos content.:. 3. Areas within walls, drywall encased columns and'above ceilings were inspected (if , present) in access ible-representative locations. However, each individual enclosed area was not.inspected. The property was originally listed as being in Centerville and then later sometimes listed as being in Hyannis. From 1960 through 1988 or 1989 the entire area from Old Strawberry Hill Road down was in the RD-1 district. In 1988 or 1989 the HB cutout was created. ROSE MOTEL (1555 Iyannough) f/k/a DeCota Family Inn f/k/a Presidential Motel I could not find any building permit for the original construction of the motel. The Assessor's office started assessing the buildings in 1960 so construction is assumed to be 1959. How the motel was allowed in the RD-1 district is not explained. There is no Variance or Special Permit allowing the motel on file. Here is the history that is in the building file: 1959—Presidential Motel was constructed (assumed) 1959 to1986—the Motel was used as a seasonal motel and consisted of 30 motel rooms (two separate buildings) 1986—Owner Frank McDonough applied for a building permit and Board of Health Variance to construct a three-bedroom house attached to one of the motel buildings to house summer help. The Board of Health Variance was granted September 24, 1986 with conditions: Motel is limited to operation from May through October and system must be pumped every October. Building permit was granted September 29, 1986 to add 3-bedroom structure to house residence for summer help in an RD-1 District 1987— Owner Frank McDonough applied for a building permit to reduce the 30 motel units to 16 motel"suites". Permit was granted January 21, 1987 subject to Board of Health requirement that this remain a seasonal operation from May 201"to Labor Day. Building Permit list proposed use as a motel in an RD-1 district. 1 �t 1995 (April)—Department of Health, Safety&Environmental Services letter states that the property consists of three buildings: one with single motel units; one with motel suites and one with house. 1995 (June)—Owner James DeCota applied for a building permit to construct a deck and egresses. Permit lists current use as motel in the HB district. 2000— Inspection Certificate issued to Hotel/Motel (now Rose Lodge) from April 14, 2000 to April 14, 2001. 2001 (April)—Barnstable Housing Authority zoning verification was issued to the owner for the rental of unit#6 and signed by Gloria Urenas as being a legal unit meeting all zoning requirements for rental. 2001 (Aug. 14)—Letter from Tom Geiler via Lois to Gloria Urenas and Ralph Jones wherein it is stated that the property has now been purchased by Rose Clark(and Hank Barry) and when Rose was contacted regarding the now expired COI, she informed the Town that the property was no longer a motel but is now apartments rented on a yearly basis. Lois questions if they now need a change of use permit. 2001 to August 2003 — Property being run as a year-round multi-family with no COI. There are vague notes and memos which mention Tom Perry discussing the matter with Ruth Weil and a possibility of"it" going to court. ROSE LODGE (1575 Iyannough) Boarding House 1987—Owner Frank McDonough applied for building permit to construct"Lodging House"in RD-1 District. It is handwritten on the permit that it is "subject to Selectman approval, 5/18/87 10:45 ok per Selectman per M.J. Flynn". 2001 —Inspection Certificate issued to Lodging House from April 7, 2001 to April 7, 2002. Handwritten note from Lois in 2002 wherein Mr. McDonough stated he sold the property to Hank Barry(and Rose Clark), however licensing does not have any request for transfer of license. Lois questions if this is still being used as a"lodging house". 2003 — Owner Henry Barry(who is co-owner with Rose Clark)request renovation work. Permit does not list zoning district and lists dwelling type as a 7 unit multi- family. 2003 — Memo from Lois to Tom(I assume Perry) where she states Tom is holding the files for 1555 and 1575 Iyannough Road and a building permit was requested for renovation on 1575.. Lois goes on to question the use of the property and if said use is allowed? No further information is in the file. SUMMARY OF USE From 1960 through 1986 the buildings on 1555 Iyannough Road were used as a 30 unit seasonal motel in an RD-1 district. In 1987 the motel was reduced to 16 motel "suites"; and the lodging house was constructed on 1575 Iyannough which was approved by the Selectman. It appears from 1987 until 2000/2001 when Hank Barry and Rose Clark took ownership it is assumed that the properties were maintained as a motel and lodging 2 house although the "seasonal"use may be questioned. From 2000 /2001 to present is appears that the lodging house was converted, albeit not legally, to year-round apartments and the motel was also being used as a year-round (maybe week-to-week)rentals. The Barnstable Housing Authority verified the zoning of Unit 6 in April 2001. Tom Perry and Ruth Weil obviously have discussed this property and court action was discussed,but no notes were in the building file. This is the best I could come up with without further research.
