DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside, on which there is, or is intended to be,a one or two-family dwelling, attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner"shall submit to the Building Official on a form acceptable to the Building Official, that he/she shall be responsible for all such work performed under the building-permit` (Section 109.1.1) i The undersigned"homeowner"assumes responsibility.for compliance with the State Building Code and other. applicable codes, bylaws, rules and regulations. The undersigned"homeowner"certifies that he/she understands the Town of Barnstable Building Department minimum inspection procedures and requirements and that he/she will comply with said procedures and requirements. Signature of Homeowner Approval of Building Official Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the State Building Code Section 127.0 Construction Control. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1 -Licensing of construction Supervisors);provided that if the homeowner engages'a person(s)for hire to do such work, that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems, particularly when the homeowner hires unlicensed persons. In this case, our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities, many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care t amend and adopt such a form/certification for use in your community. DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside, on which there is,or is intended to be, a one or two-family dwelling, attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such . "homeowner"shall submit to the Building Official on a form acceptable to the Building Official, that he/she shall be responsible for all such work performed under the building permit. (Section 1.09.1.1) The undersigned"homeowner" assumes responsibility for compliance with the State Building Code and other applicable codes, bylaws, rules and regulations. The undersigned"homeowner"certifies that he/she understands the Town of Bamstable Building Department trunimum inspection procedures and requirements and that he/she will comply with said procedures and requirements. Signature of Homeowner Approval of Building Official Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the State Building Code Section 127.0 Construction Control. ' HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1 -Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work, that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems, particularly when the homeowner hires unlicensed persons. Michael Gaspard was present to represent the applicant. He explained that the changes to previously approved plans would be relocating the front door were it was originally in the 191h century. He stated another change to the window on the second. Clark stated that the changes to the plans were appropriate. Jessop recommended using turned posts to hold up the porch roof. The Commission commented that Craigsville Center is similar to Oak Bluffs, because it is a religious*Community. Mr. Gaspard explained that the shingles will have a scallop and the Commission would like the column type. Mr. Gaspard stated he will submit a plan showing the column type. All parties discussed the window sizes. The BHC accepted the changes with the following recommendations to review the columns at a later date, to see specification of the shingle patterns and gable entry on side door elevation rather then hip roof. A letter will be sent to Michael Gaspard. 68 Dale Avenue The Cape Cod Commission Sub-Committee held a public hearing and took input from their members, the applicant's representatives, and Barnstable Historical Commission members who were present. A revised plan was submitted at the meeting, which has been mailed out for your review. A response to the plan revisions is needed, and remaining outstanding issues addressed. The next sub-committee meeting date is to be verified. Etsten explained that additions and demolitions have been forwarded to the Cape Cod` Commission. She stated that a Sub-Committee of Commission was held on November 6, 2008. The Board discussed re-configuration of the building and all agreed that proposed change in the plans to only have a one storey addition in the back; instead of .two-story addition was a substantial improvement. The two-storey addition would have over shadowed and towered the smaller gothic chapel in the front. The lots backup onto Shallow Pond and the total upland area is calculated at 4.23 acres. The lots are developed and have been used in combination as the"Rose Motel". The 1555 Iyannough lot is the motel proper that is developed with three buildings consisting of a 14 unit motel, motel office, a managers unit, an 8 apartment unit building, and a residential dwelling. The three buildings total 12,616 sq_ft.of living area (17,580 sclft gross area). Development on this lot dates to 1960. The front portion of the lot,for a depth of 300 feet, is zoned Highway Business. The rear portion of the lot is in the Residence D-1 Zoning District. This proposal was before the Cape Cod Commission. On February 12, 2008,the Commission determined that the proposal triggered a limited review of transportatiorl•as a Development of Regional Impact(DRI)..On March 20, 2008,the Commission issued a Hardship Exemption, with conditions. The development was also before the Site Plan Review Committee and on September 17, 2008, a Site Plan Approval Letter was.issued. Most of the redevelopment is located within the Highway Business Zoning District. However, some of the associated parking and access driveway is situated on residentially zoned land. The extension of the zoning district into the residential zone is based upon Section 240-6.C(3),that allows a 30-foot extension of a business zoning district into the residentially zoned district. Professional offices, not including medical and dental, banks-excluding drive-through banking, are principal permitted uses in the Highway Business District allowed as-of-right under zoning. Appeal No.2008-054 sought that conditional use special permit to allow for three drive-thru banking lanes pursuant to Section 240-25.C(1). Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the zoning Board of Appeals on June 16, 2008. An Extension of Time for holding the public hearing was executed and entered into the file. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The appeal had been noticed for August 6, 2008. However, due to a lack in quorum, the appeal was moved to September 10,2008, On that date, the hearing was opened and, continued to September 24, 2008 at the request of the applicant. On September 24tr',the Board found to grant the appeal with conditions. Board Members hearing this appeal were;James F. MCGillen, William H. Newton, Michael P. Hersey, Craig G. Larson, and Chair, Laura F.Shufelt. Attorneys Patrick M. Butler and Eliza Cox represented the applicants in this appeal. Attorney Butler explained that the existing conditions of the site characterized the motel use as being deteriorated and not used. He explained the proposed redevelopment noting that the applicant would be taking advantage of the 30-foot allowance permitted in Section 240-6,C(3)that grants rights to extend the proposed office and back use into the residentially zoned portion of the property. He stated that the lot line between the two lots would.also be adjusted to assure that all of the commercial use would be on a single, lot. He indicated that the on-site septic would be replaced with a new.Title 5 compliant system and the site's drainage revamped to the latest best practices_ As this location is in a groundwater protection district and borders on:Shallow Pond, this system would be a benefit to the environment. With regards to Route132, a major traffic corridor to downtown Hyannis that is just being remade into a divided parkway, the development would add much. The improvements to the site in terms of visual aspects, reduced traffic, controlled turning movements and landscaping will enhance and provide a welcoming invitation into Hyannis. He cited that the past reviews of the development by the Cape Cod Commission,Site Plan Review and Growth Management Department stated that the applicant has strived to incorporate all of the desired improvements and address their concerns. The Board questioned the redevelopment at this time given that no committed tenants have been identified. Attorney Butler cited that it is hard to secure commitments from corporations without actual building permits in hand. He noted the track record of the partners in this development. Public comment was requested and no one spoke in favor or in opposition to the request for a conditional use special permit. The Board and applicant discussed the proposal and it was noted that the permit to be issued would only be issued for the redevelopment lot at 1555 Iyannough Road and that improvements within the right-of-way of Route 132 would be limited to only that area of the way that abuts the two subject lots and not beyond. Findings of Fact At the public hearing of September 24, 2008 a motion was duly made, seconded and unanimously . agreed to find the following findings of fact: 1. Appeal 2008-054 is that of Shallow Pond Nominee Trust and Sixty North Street Realty Trust who have petitioned pursuant to Section 240-25_C.(1) Conditional Use in a Highway Business District for a conditional use special permit to allow for a bank with three(3) drive-thru windows. The properties which are the subject of this appeal are addressed 1555 and 1575 Iyannough Road, Route 132, Hyannis, and are shown on"f own of Barnstable Assessor's Map 253 as Parcels 016,019-BOO, and 019-T00. .2, The applicants propose to demolish the existing buildings and redevelop the property for office and bank use. The proposed office/bank building has a gross floor area of 18,260 square feet, of which 13,055 square fleet will be professional office space, 2,500 square feet will be a bank, and 2,705 square feet will be for associated infrastructure space (e.g., hallways, elevator, etc, ..). 9 OCT 14,2008 05:37P 8664233454 page 5 r 10/14/2008 06:01 b642', 454 EKBALASCHAt PAGE 06/14 Town of Barnstable, zoning Board of Appeals—Decision and Notice condition al Use Special Permit No. 2008-054 4 Drive-thru Banking-Shallow Pond Nominee Trust and Sixty North Street Realty Trust 3. No zoning relief is required for the office/bank within the HB zoning district. 6. However, a conditional use special permit is required for the three (3) drive through windows proposed as part of the redevelopment-Two of the drive-thru windows will be pneumatic teller tubes and the third drive-thru will contain an automated teller machine CAW'): 7. On April 10,2008, the redevelopment project was reviewed and determined approvable by the Site Plan Review Committee, subject to the submission of revised plans. By letter dated September 17, 2008, the Site Plan Review Committee issued its approval of the redevelopment. 8. The proposed redevelopment results in the elimination of a non-conforming use and three' dimensionally non-conforming structures. ' 9. The Board concurs that the proposed impacts will either improve upon, or at a minimum, not be more detrimental than the existing impacts in the areas of water resources, community character, fiscal impact, natural resources, open space, hazardous materials, and affordable housing, 10, The Board finds that the redevelopment of the property, as proposed, is consistent with the initiatives of the Barnstable Local Comprehensive Plan for this growth Activity Area. 11, The Board finds that the relief requested falls within a category specifically excepted by the zoning ordinance. 12. An Extension of Time for holding the public hearing was executed and entered into the file. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A- The appeal had been noticed for August 6, 2008- However-, due to a lack in quorum, the appeal was moved to September 10, 2008. On that date, the hearing was opened and continued to September 24, 2008 at the request of the applicant. On September 24",the Board found to grant the appeal with conditions. Board Members hearing this appeal were;James F. McGillen,William H. Newton, Michael P, Hersey, Craig G. Larson;and Chair, Laura F_Shufelt, Attorneys Patrick M, Butler and Eliza Cox represented the applicants in this appeal. Attorney Butler explained that the existing conditions of the site characterized.the motel use as being deteriorated and not used. He explained the proposed redevelopment noting that the applicant would be taking advantage of the 30-foot allowance permitted in Section 240-6.C(3)that grants rights to extend the proposed office and back use into the residentially zoned portion of the property. He stated that the lot line between the two lots would also.be adjusted to assure that all of the commercial use would be on a single lot. Attorney Butler stated that the proposed demolition of the motel and redevelopment of the lots for office and banking would be an improvement. He indicated that the on-site septic would be replaced with a new Title S compliant system and the site's drainage revamped to the latest best practices, As this location is in a groundwater protection district and borders on Shallow Pond, this system would be a benefit to the environment, He also cited that applying for reduced parking will reduce pavement, He went on to cite that professional offices, such as financial firms that are being sought for this location, do riot require as much parking as projected in the ordinance. He stated that the characteristics of use invalidate normal methods of calculating parking demand and that this fact substantiates a circumstance that warrants the reduction in parking, Attorney Butler cited that neighboring lots do not completely fill and there will be both a driveway and a walkway connecting the abutting parking lot to the south. He suggested that, although there is no formal agreement between abutting property owners, there exists that ability to supplement parking off premises. Attorney Butler stated that the reduced parking has been endorsed by the Cape Cod Commission and the Growth Management Department. Findings of Fact: At the public hearing of September 24, 2008 a motion was duly made, seconded and unanimously agreed to find the following findings of fact: 1. Appeal 2008-055 is that of Shallow Pond Nominee Trust and Sixty North Street Realty Trust who have applied for a special permit pursuant to §240-57 of the zoning ordinance to permit a reduction in the minimum number of parking spaces required by the ordinance. The properties which are the subject of this appeal are addressed 1,555 and 1575 Iyannough Road, Route 132, Hyannis, and are show, on Town of Barnstable Assessor's Map 253 as Parcels 016,019-BOO, and 019-Tao. 2. The proposed office/bank building has gross floor area of 18,260 square feet, of which 13,055 square feet will be professional office space, 2,500 square feet will be a bank, and 2,705 square feet will be for associated infrastructure space(e.g., hallways, elevator, otc.). 3. As part of the redevelopment of the property, the applicants propose a vehicular interconnect which will provide a connection across 3 adjoining properties to Old Strawberry Hill Road- 4- With the exception of this request for a reduction in the required parking, the proposed redevelopment complies with all of the applicable bulk requirements of the zoning ordinance. 5. On April 10,2008,the redevelopment project was reviewed and determined approvable by the Site Plan Review Committee, subject to the submission of revised plans. By letter dated September 17, 2008,the Site Plan Review Committee issued its approval of the redevelopment. 6. As shown on the redevelopment plans submitted, the applicants propose a total of 52 on-site parking spaces, all of which are located to the side and rear of the proposed structure. The proposed office/bank building and the 52 parking spaces are located within the HB zoning district or not more than 30 feet into the RD-1 zoning district as allowed by§240-6(C)(3) of the. zoning ordinance. 7. Of the 52 parking spaces, 18 are proposed on the 1575 Iyannough Road property which is why that property was included in this petition. The applicants have proposed, as a condition of this - decision,to submit an approval not required ("ANR")plan to the Barnstable Planning Board which would alter the lot line between the 1555 Iyannough Road property and the 1575 Iyannough Road property so that all the bank/office parking spaces are located on the bank/office property. 8. Based on the floor area of the proposed office/bank building,§240-56 of the zoning ordinance OCT 14,2008 05:40P 8664233454 ' page 12 I:'14/]ZUU Lib:UI bbb42, f4O4 1Ci 14 Town of 6arnstable,Zoning Board of Appeals—Decision and Notice Special Permit No,2008-055 r Reduction in Parking-Shallow Pond Nominee Trust and Sixty North Street Realty Trust requires a total of 59 on-site parking spaces. As such, the appl'ecants, are proposing to construct seven less parking spaces than required by the ordinance. 9. Section 240-57 of the ordinance allows the Board to reduce the number of parking spaces required if a lesser number is shown to be adequate based on a showing of a "special circumstance." The section provides non-exclusive examples of such special circurnstances. 10. The Cape Cod Commission and the Barnstable Site Plan Review Committee approved the redevelopment with the proposed 52 parking spaces. 11, The applicants are required to implement a trip reduction program which will reduce the anticipated number of trips to the site by 25%.The Board finds that the implementation of this trip reduction program is a "special ciratmstance"warranting a reduction in the-number of parking spaces. Decision; Based on the findings of fact,a motion was duly made and seconded to grant Special Permit No. 2008-055, pursuant to Section 240-57,for a reduction of on-site parking from 59 to 52 spaces, subject to all conditions of Special Permit No.2008-054 and the following additional restrictions: 1.
