Procedural Provisions: Section 5-3.2(3):Variances Background Information: According to the Assessor's Records the lot is 0.19 acres and is developed with a one story,single family dwelling of a gross floor area of 720 sq.ft.,located on the north west corner of the intersection of Johnny Cake Road and Yacht Club Road,Centerville. The dwelling,built in 1958,includes 2 bedrooms,one bathroom,and has public water,gas service,and a septic system. The Petitioner is intending to add approximately 1,570 sq.ft.of livable space to the existing dwelling, plus a new basement gross floor area of 785 sq.ft.and a farmer's porch and rear sundeck. The plans indicating the new addition are titled"Bushey Residence,Centerville,MA,Drawing numbers 1 through 5"by Philip L.Orr,Carpentry/Drafting,Barnstable MA,dated 5/94,and were submitted with the application. Procedural Summary:, Filed with Town Hall and Zoning Board of Appeals on July 19, 1994 and scheduled for hearing on August 17, 1994 at which time the Board voted to grant this request with conditions. Board members sitting on this appeal are R.Janson,T.DeReimer,E.Glynn,R.boy and Chairman G.Nightingale. Mr.Bushey spoke saying he and his wife were seeking a variance for an addition to their home. The reason for the addition is the Bushey's plan to start a family. Mr.Bushey explained that the house would be comparable to others in the neighborhood. He added that originally they had planned to put a second floor on the house until the contractor told them that would be cost prohibitive due to the unsound structure of the house. He explained that they could not build on the other side because of the septic system which is located there. The addition connected to the back of the house would create more of a zoning ordinance violation than they are now asking. Decision and Notice 1994-75: Bushey Bulk Regulations E. Glynn asked Mr.Bushey if the house had a setback of 24 fit on the east side. He also asked if the deck was into the setback by 12 feet in.the back. E. Glynn asked if the front year was set back 22.6 feet instead of the required 30 feet. Mr.Bushey answered affirmatively and added that the deck was there when he bought the house. E. Glynn asked Mr.Bushey if the house could not be built up to a second floor. Mr.Bushey explained that the contractor recommended against the second floor development because it was very cost prohibitive as the main support walls would have to be inserted into the first floor. E. Glynn asked Mr.Bushey if he was requesting only a 3/10 of a foot sideyard setback variance and a front yard variance of 7.4 feet. Mr.Bushey said yes. Public Comment was requested and no one spoke. Chairman G.Nightingale again acknowledged the seven letters from the neighbors in the file all in favor of the petition. FINDINGS: 1. The property is located in an RD2 Zoning District. 2. There is on the property,an existing one story dwelling of 720 square feet with two bedrooms. 3. The Bushey's wish to add to the house to accommodate future expansion of their family. 4. The property fronts on two streets. 5. The parcel is.19 of an acre with approximately 8,000 sq.feet of land. 6. The Bushey's are precluded from expanding to the right because of the septic system. 7. These conditions constitute a topographical hardship. 8. Granting of this request would not be detrimental to the neighborhood in view of the seven letters submitted to the file. 9. Granting of this request would not be in derogation of the spirit or intent of the Zoning Ordinance. VOTE.- AYE: R.Janson,T.DeRiemer,E.Glynn,R.Boy and Chairman G.Nightingale. NAY: None.
