DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside, on which there is,or is intended to be,a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building permit. SiknatuTe of Homeowner Approval of Building Official Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the State Building Code Section 127.0 Construction Control. . HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109.1,1.Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care t amend and adopt such a forn/certification for use in your community. In Appeal 2006-094,the applicants, Rod T. and Colleen M,5roczenski sought a special permit from the Zon ing Board of Appeals to demolish an existing single-family dwelling on an undersized lot and rebuild a new single-family dwelling on lot not in compliance with current required setbacks. The special permit was sought pursuant to Section 240-91.H(2) of the Zoning Ordinance of the Code of the Town of Barnstable. The applicants requested that a special permit be granted to forgo the minimum side yard setback of 10 feet, the 50-foot setback to great ponds, and the 30-foot setback from wetlands. The applicants seek to retain the home and the existing pump house in the existing non-conforming location, Procedural& Hearing Summary: This appeal was filed at the Town Clerk's Office and at the office of the Zoning Board of Appeals can September 12, 2006. A public hearing before the Zoning Board of Appeals was duly advertised and i ter40A, The hearing opened November notice sent to all abutters in accordance with MGL Cha p g was P 1, 2006 and continued to Dec6mber 6, 2006, at which time the Board found to grant the special permit subject to conditions herein. Board Members deciding this appeal were, Randolph Childs, James R. Hatfield, Ron S.jansson,John T. Norman, and Chairman Gail C. Attorney Boudreau presented the background on the lot and its proposed development. He cited that under Section 240-9 i.H(2) of the Zoning Ordinance, the applicants can, by special permit, request the reduced setbacks being sought in the redevelopment of the parcel. He reviewed the requirements for the special permit stating that the gross area of the . building to be built was 6,665 sq.ft. which represents a floor area ratio (FAR)of.2936 when the ordinance allows a maximum of.3 FAR. The footprint of all structures to be built totals 4,534 sq.ft. or 19.0% lot coverage when the ordinance provides up to 20% lot coverage. Attorney Boudreau noted that on May 6, 2006, a variance from Title 5 and local Board of Health regulations was issued by the Board of Health for the proposed on-site septic system. He stated that the variance was issued with the restriction that the dwelling be limited to a maximum of 4 bedrooms, The nature and type of system was discussed and it was determined that the variance was issued as a repair to the system and would still be applicable to the rebuilding of the new home. The Board asked about any conservation issues. Attorney Boudreau cited that the proposal is scheduled to be before the Conservation Commission on November 28, 2006. Public comment was requested. Sheldon Stewart of 602 Shoot Flying Hill Road spoke In favor of the grant of the permit as he.felt the new dwelling would be an improvement for the neighborhood. The Chairman noted that the applicants had submitted 6 letters from abutting property owners in support of the request. They.were from: Dennis Manizza of 46 Johnson Lane,John and Judith Vellone of 552 Shoot Flying Hill Road,Sheldon and Salijane Stewart of 602 Shoot Flying Hill Road, Brian and Valerie Jansson of 6 Bridle Path, Barbara Simonelli of 36 Johnson Lane, and Avis Ochs of 44 Johnson Lane. The Board noted that they would lllce to have the benefit of'the Conservation Commission review be+are rendering of a decision: Certain Board members indicated that they were concerned with the size and gross area of the proposed dwelling. A conversation pursued reviewing the dimensions and the Board inquired if the applicants would consider reducing the size of the proposed dwelling. The . applicants agreed they would revisit the plans. The hearing was continued to December 6, 2006. At that continuance, revised plans dated November 21,2006 were presented to the Board. Attorney Boudreau reviewed the revised plans and submitted calculations comparing the prior plans to the revised building plans. He cited that the revised plans reduced both the gross area of the building and the footprint/lot coverage. It was noted that the living area was now 4,563 sq.ft. Mr. Boudreau stated that the Conservation Commission had received and reviewed the revised plans for the structure•and had no concerns with the proposal for the dwelling but did wish to further review the former pump house structure situated on the property. The Conservation Commission hearing was continued for additional information on that structure and the drainage easement. Attorney Boudreau indicated that the outcome of that issue would not affect the principal structure. The Board and applicant reviewed the figures submitted and compared them with the plans. It is in a Residence D-1 Zoning District, 2. According to plans submitted,the locus is a 22,683 sq.ft. parcel located off Johnson Lane and fronting or. Wequaquet Lake in, Centerville. The locus is identified on Assessor's Map 193 as Parcel No. 077. The parcel was created by a July 20, 1970 plan entitled "Revised Plan of tots at Wequaquet Lake, Centerville, Mass. Belonging to John H.Johnson recorded in the Barnstable Registry of Deeds in Plan Book 347, page 37. Sroczenski sought a special permit from the Zoning Board of Appeals to demolish an existing-single-family dwelling on an undersized lot and rebuild a new single-family dwelling on lot not in compliance with current required setbacks. The special permit was sought pursuant to Section 240-91.H(2) of the Zoning Ordinance of the Code of the Town of Barnstable. According'to plans submitted, the property is a 22,683 sq.ft. parcel addressed as 14 Johnson Lane, Centerville MA. According to the Assessor's record, the existing dwelling is a four-bedroom, one story, split level structure of 1,486 sq.ft. of living area with an attached two-car garage and deck. Proposed plans for a new dwelling dated August 30, 2006 were submitted with the application that proposed a two-story, four-bedroom, single-family home. The applicants requested that a special permit be granted to forgo the minimum side yard setback of 10 feet, the 50-foot setback to great ponds, and the 30-foot setback from wetlands. The applicants seek to retain the home and the existing pump house in the existing non-conforming location. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the office of the Zoning Board of Appeals on ; September 12, 2006. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was.opened November 1, 2006 and continued to December 6, 2006, at which time the Board found to grant the special permit subject to conditions herein. Board Members deciding this appeal were, Randolph Childs, James R. Hatfield, Ron S.Jansson,John T.,Norman, and Chairman Gail C. Nightingale: Attorney Philip Michael Boudreau represented the applicants who were also present during the ' proceedings. Mr. Kevin Healy, the consulting engineering from the BSC Group, was also present. .Attorney Boudreau presented the background on the lot and its proposed development. He cited that under Section 240-91.H(2) of the Zoning Ordinance, the applicants can, by special permit, request the reduced setbacks being sought in the redevelopment of the parcel. He presented the plans originally Special Permit 2006-094-Sroczenski - submitted and dated August 30, 2006. He noted that the living area of the proposed-new home was 5,174 sq.ft. He reviewed the requirements for the special permit stating that the gross area of the building to be built was 6,665 sq.ft. which represents a floor area ratio (FAR) of.2936 when the M ordinance allows a maximum of.3 FAR. The footprint of all structures to be built totals 4,534 sq.ft. or 19.99% lot coverage when the ordinance provides up to 20% lot coverage. - Attorney Boudreau noted that on May 6, 2006, a variance from Title 5 and local Board of Health regulations was issued by the Board of Health for the proposed on-site septic system. He stated that the variance was issued with the restriction that the dwelling be limited to a maximum of 4 bedrooms. The nature and type of system was discussed and it was determined that the variance was issued as.a repair to the system and would still be applicable to the rebuilding of the new homer The Board asked about any conservation issues. Attorney Boudreau cited that the proposal is scheduled to be before the Conservation Commission on November 28, 2006.' r Public comment was requested. Sheldon'Stewart of 602 Shoot Flying Hill Road-spoke in favor of the grant of the permit as he felt the new dwelling would be an improvement for the neighborhood. The Chairman noted that the applicants had submitted 6 letters from abutting property owners in support of the request. They.were from: Dennis Manizza of 46 Johnson Lane,John and Judith Vellone of 552 . Shoot Flying Hill Road, Sheldon and Salijane Stewart of 602 Shoot Flying Hill Road, Brian and Valerie Jansson of 6 Bridle Path, Barbara Simonelli of 36 Johnson Lane, and Avis Ochs of 44 Johnson Lane. The Board noted that they would like to have the benefit of the Conservation Commission review before rendering of a decision. Certain Board members indicated that they.were concerned with the size and gross area of the proposed dwelling. A conversation pursued reviewing the dimensions and the Board inquired if the applicants would consider reducing the size,of the proposed dwelling. The applicants agreed they would revisit the plans. The hearing was continued to December 6, 2006. At that continuance, revised plans dated November 21,82006 were presented to the Board. Attorney Boudreau reviewed the revised plans and submitted calculations comparing the prior plans to the revised building plans. He cited that the revised plans reduced both the gross area of the building and the footprint/lot coverage. It was noted that.the living area was now 4,563 sq.ft. Mr. Boudreau stated that the Conservation Commission had received and reviewed the revised plans for the structure and . had no concerns with the proposal for the dwelling but did wish to further review the former pump house structure situated on the property. The Conservation Commission hearing was continued for additional information on that structure and the drainage easement. Attorney Boudreau indicated that the outcome of that issue would not affect the principal structure.' ' The Board and applicant reviewed,the figures submitted and compared them with the plans. The Board requested.that the applicant's engineer review,those calculations and verify them before ruling on this permit. That was accomplished that night to the satisfaction of the Board. Findings of Fact: At the hearing of December 6, 2006 the Board unanimously.made the following findings of fact: 1. This appeal is a'request for a special permit pursuant to Section 240-91.H(2). The applicants seek to demolish the existing single-family dwelling located on the lot and rebuild a new larger single- 2 Special Permit 2006-094-Sroczenski family dwelling not in conformance with the current setbacks requirements. The applicants are Rod T. and Colleen M. Sroczenski. The subject property is addressed as 14 Johnson Lane, Centerville, MA and is shown on Assessor's Map 193 as parcel 077. It is in a Residence D-1 Zoning District. 2. According to plans submitted, the locus is a 22,683 sq.ft. parcel located off Johnson Lane and fronting on Wequaquet Lake in Centerville. The locus is identified on Assessor's Map 193 as Parcel No. 077. The parcel was created by a July 20, 1970 plan entitled "Revised Plan of Lots at Wequaquet Lake, Centerville, Mass. Belonging to John H.Johnson recorded in the Barnstable Registry of Deeds in Plan Book 347, page 37. The subject parcel is a combination of Lot.No. 8 shown on that plan and an adjoining area of land identified on that plan as "Way" — "Drainage Easement". Lot No. 8 was created under the Town of Barnstable Subdivision Control and conformed to zoning requirements at that time. 3. According to the Assessor's record, the existing dwelling is a four-bedroom, 1,486 sq.ft. living area, one-story, split-level structure. There is also an attached two-car garage and an outdoor deck. Additionally, there is an out-building situated.on the 'Way' lot. That out-building is a former pump station now being used as an accessory storage shed to the dwelling. 4. The principal structure is 33-feet off Wequaquet Lake and the deck is 23-feet off the lake. The former pump station (now shed) is directly on the water as well as 1.5-feet off the side property line. Currently, all non-water dependent structures require a 50-foot setback from the mean high water on any great pond as per Section 240-7.G(2). The,required front yard setback is 30-feet and the side and rear yard setback is 10 feet in the Residential D-1 Zoning District. y. 5. The lot was legally created in conformity to zoning at that time and was not until afterwards that the minimum lot area for the district was increased. The dwelling, when constructed inl972, conformed to the zoning setback requirements at that time. The 50-foot setback to great ponds was amended into the ordinance in 1983 after the structure was built. Therefore, the lot is a pre- existing, legal, nonconforming lot that was developed in conformity to zoning at the time it was developed. 6. According to plans submitted, the applicants seek to build 'a new, two-story, four-bedroom, single- family dwelling. The structure is to have a footprint of 4,163 sq.ft., for a total lot coverage by structure of 17.31 %. The total gross area of building on the lot is to be 6,230 sq.ft. or a floor area ratio (FAR) of .2747. 7. For the Board to issue a special permit under Section 240-91.H(2), Provision 'a', the plans must conform to all requirements of that`section. The plans for the principal structure conform to the required front and side setbacks for the district. However, the proposed setback from the great pond which is to remain deficient will equal that established setback of the existing structure. The, . proposed new lot coverage conforms to the 20% maximum lot coverage limitation. The proposed plans appear,to conform to the 0.3 floor area ratio requirement. The plans conform to the 30', height/2.5-story limitation."� « 8. This application falls within a category specifically excepted in the ordinance for a grant of a" V special permit and after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good 3 Special Permit 2006=094-Sroczenski or the neighborhood affected. The proposed new dwelling would not be substantially more detrimental to the neighborhood than the existing dwelling as evidenced by the neighbors support for the grant of this permit. The dwelling, as conditioned by the referenced plans above, shall be limited to a maximum of four bedrooms. 4. The living area or habitable area of the dwelling shall not be expanded beyond that 4,600 sq.ft. as represented to the Board. That measurement being taken from the inside walls of the structure.. and does not included the garage, utility room nor the detached shed. 5. The existing shed, commonly referred to as the former pump house, shall not be expanded in footprint or expanded in gross floor area nor shall it be used for living purposes. 6. The development shall conform to and beJ.maintained.with all Board of Health terms and conditions for the Title 5 on-site septic system. 7. All development shall conform to and be maintained with all conditions of the Order of Conditions to be issued by the Conservation Commission. 8.
