On January 07;2004,the Zoning Board of Appeals granted Special Permit 2003-154 to the applicants to permit the
demolition and reconstruction of a single-family dwelling on an undersized lot. That permit authorized the demolition,
of a 1,A 3/4-story;five-bedroom, 1,836 sq.ft.,single-family dwelling and the reconstruction of.a new two-story,five-
plus-bedroom,5,660 gross sq.ft.single-family dwelling.
W 41During those proceedings the,applicant shifted the location of the dwellingapproximately7-feet southerlyat the request
uest
of an abutting neighbor. During the Conservation Commission permitting,it was noted that the position of the dwelling
mwas very close to the top of the coastal bank,and extremely close,to the FEMA,A13-Zone(Flood Elevation 12). The
.c applicant is now seeking to reposition the home as originally presented to the Board.

utd, Procedural&Hearing Summary:
Cd This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on May 11,2004. A
public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with
ai MGL Chapter 40A. The hearing was opened June 09,2004,at which time the Board found to grant the appeal. Board
Members deciding this appeal were Gail Nightingale,Jeremy Gilmore,Ralph Copeland,Sheila Geiler,and Vice
Chairman,Ron-S.Janson,who was Acting Chairman.

p Attorney John R.Alger represented the applicants before the Board,describing the proposed location that was originally
presented in January of 2004 to the Board. Mr.Alger stated that the location is less intrusive environmentally and on
other abutting neighbors. It was noted that the location would still conform to all required setbacks for the district. The
W issue of conservation approval was raised and Mr.Alger noted that they would return to the Conservation Commission
to obtain a modified Order of Condition should this modification be approved.

bd At the hearing of June 09,2004,the Board made the following findings of fact:
rn 1. Appeal Number 2004-76 is that of Stefan and Cynthia R. Seidner seeking a Modification of Special Permit 2003-
154, Condition Number 1, to allow repositioning of the proposed new single-family dwelling. The property is
shown on Assessor's Map 226,Parcel 142 addressed as 19 Magnolia Avenue,Centerville,MA in a Residence D-1
Zoning District.

2. The applicant seeks to have Condition Number 1 of Special Permit 2003-154 modified to reflect the earlier plan
that is entitled;`Plan of Land Located at 19 Magnolia Avenue(Centerville)Barnstable,Mass."Prepared for Stefan
&Cynthia Seidner dated December 27, 1999,revised 8/27/03 and drawn by Yankee Survey Consultants.
3. The location as approved by the Board and Conservation placed the comer of the dwelling off the crest of the
coastal bank. That position will cause the foundation to be elevated on the southeasterly comer of the structure.
That location with the elevated foundation,may present the building as being much higher,especially when viewed
from the water and beach.
The vote was as follows:

Decision:
Based on the findings of fact,a motion was duly made and seconded to grant the modification of Condition 1 of Special
Permit;003-154:That condition shall now read:
"Location of the dwelling shall be as shown on a plan entitled `Plan of Land Located at 19 Magnolia Avenue .
'(Centerville)Barnstable,Mass."Prepared for Stefan&Cynthia Seidner dated December 27, 1999,revised
8/27/03 and drawn by Yankee Survey Consultants.
In addition,this modification is subject to the applicant returning to the Conservation Commission for a modification of
the Order of Conditions to reflect the new location of the dwelling.

Mr.Gilmore stated that he voted in the negative because neither of the abutting neighbors were present and that
he felt that the applicant should have had this position approved first by the Conservation Commission.
Ordered:
Special Permit 2003-154 has been modified. This decision must be recorded at the Registry of Deeds for it to be in
effect. The relief authorized by this decision must be exercised in one year.
Appeals of this decision,if any,shall be made pursuant to MGL Chapter 40A,Section 17,within twenty(20)days after
the date of the filing of this decision,a copy of which must be filed in the office of the Town Clerk.

and Chairman,Daniel M. Creedon III.
Attorney John R Alger represented the applicants before the Board. At the opening of the hearing,Mr.

Mr.Alger noted that a neighbor would like the dwelling to be moved in a southerly direction and the
applicants were willing to accommodate that to the degree that they can without infringing into the
wetlands and triggering the need for Conservation Commission review.
The Board noted the location of a common driveway serving both properties and that some of the
roadways were not constructed and are paper roads only. It was cited that the existing dwelling does not
have a basement and the proposed would. The basement would not be a walkout type. The proposed
dormitory room is to be located over the garage and would be accessed from inside the dwelling.
Public comment was requested and Mr.Wayne Kurker,the abutting neighbor to the north spoke. He
stated that he thought this was a good improvement for the property and neighborhood. However he
would like to see the proposed dwelling shifted to the south, further away from his property line as his
garage is situated very close to the property line.
The Appeal was continued to January 7,2004 in order for the site to be viewed and for plans to be drawn to
reflect the proposed shifting of the building in a southerly direction. At the January 07,2004 hearing,new
plans for the proposed location of the structure were presented to the Board. Attorney John Alger noted
that Mr.Kurker had reviewed the new plans and was satisfied with the proposed shifting of the structure of
around 7 feet. Mr.Alger also noted that the Architect Timothy Luff was present to address concerns for
the proposed building.
Public comment was again requested and Attorney Arthur Hyland,the abutter at 10 Magnolia Avenue
spoke, stating that he supports the Seidner's proposed improvements but was concerned that the dwelling
did not shift too much so as to block his view to the Ocean.
Findings of Fact:
At the hearing of January 07,2004,the Board unanimously made the following findings of fact:
1. The applicants are Stefan and Cynthia R. Seidner seeking a Special Permit in accordance with Section 4-
4.3 Nonconforming Buildings or Structures Used as Single and Two-Family Residences and Findings
under MGL Chapter 40A, Section 6 to demolish an existing dwelling and replace it with a two-story
single-family dwelling with.attached garage.
2. The property is shown on Assessor's Map 226,Parcel 142 addressed-as 19 Magnolia Avenue,
Centerville,MA in a Residence D-1 Zoning District. It is a triangular lot fronting on Craigville Beach
Road,Magnolia Avenue and Newland Street in Centerville.The lot is a 0.87-acre parcel developed with
a 1 &3/4 -story,five-bedroom,single-family dwelling.
3. According to the Assessor's record,the dwelling has 1,836 sq. ft. of living area, 895 sq. ft. of porches,
180 sq. ft. of unfinished area in the upper story,a deck of 60 sq. ft.,and a detached garage of 200 sq. ft.
The dwelling dates to the 1900's.
4. The applicants are proposing to completely demolish and remove the existing house and reconstruct a
new single-family dwelling. The proposed new single-family dwelling is to be a,two-story,5,660 gross
sq.ft.,five-bedroom plus a dormitory room structure. Included in the gross area of the structure is an
attached two-car garage of 710 sq.ft. The height of the new structure is to be 21'-2" to the plate and
the height to the ridge is 33'-4".

5. The property is within the AP—Aquifer Protection Overlay District and is not subject to the 330 rule.
The lot should be able to support a 5 bedroom on-site septic system without variance from Title 5.

nei hborin abutter had expressed concerns for the proposed location of the new structure and its
neighboring
proximity to his property line. The applicant has shifted the location of the new dwelling to
accommodate the neighboring property owner. That new plan was presented to the Board tonight.
7. The proposed dwelling that is similar in style and architecture to the existing structure is a
"reconstruction" and is an intensification of the use on the property. However,the new dwelling to be
built does not intensify the nonconformity with respect to the structure's location and use on the lot.
8. Although there is an intensification in building size and area on the nonconforming lot,the proposed
new dwelling would not be substantially more detrimental to the neighborhood than the former
dwelling.
Decision:
Based on the findings of fact,a motion was duly made and seconded to grant the permit for the demolition
and reconstruction with expansion of a single-family dwelling on an undersized non-conforming lot. The
reconstruction shall comply with all setback requirements and is subject to the following conditions:
1. Location of the dwelling shall be as shown on a plan entitled"Plan.of Land Located at 19 Magnolia
Avenue (Centerville) Barnstable,Mass."Prepared for Stefan&Cynthia Seidner dated January 6,2004
and drawn by Stephen J.Doyle.
2. The dwelling shall be built substantially in conformance to plans and elevations presented to the Board
entitled"Seidner Residence"as drawn by Archi-tech Associates,dated June 2,2003,and consisting of
eleven sheets numbered A-1 to A-11.
3. The height of the structure to plate shall not exceed 21'-2"and the height to the ridge shall not exceed
33'-4".
4. The dwelling is limited to no more than five-bedrooms plus a dormitory room to be located over the
garage.
5. There shall be no fill, alteration-or construction activities within 100 feet of wetlands without approval
from the Conservation Commission.
6. The on-site septic system shall be required to meet Title 5 requirements without variance.
7. Construction shall comply with all applicable Building Division and Board of Health requirements.
8. During all stages in the demolition and reconstruction of the dwelling,all vehicles,equipment and
materials associated with the demolition/reconstruction shall be required to be located on-site and not
within the required setbacks. At no time will any parking,storage or construction materials or items be
permitted in any right-of-way or within 10 feet of the neighboring property except as may be needed for
landscaping purposes or for utilities and then only on a temporary basis.
9. All mechanical equipment associated with the dwelling(air conditioners,electric generators,etc.) shall
be located so as to conform to the required setbacks for the district and screened from neighboring
homes, the public right-of-way and view from the water.

10. The dwelling,attached garage,covered porches,the decks shall be considered full build-out for the lot
and the structure shall not be expanded in area or in footprint nor shall any other accessory structure be
permitted without further permission from the Zoning Board of Appeals.
11. This decision must be recorded at the registry of deeds and a copy of that recorded document must be
submitted to the Zoning Board of Appeals Office and to the Building Division before any demolition
or building permit is issued. The relief authorized must be executed within one year of the grant of this
permit.
