The locus is -known as the Centerville General Store and it is located on Main St. , Centerville in..a residence D-1 zoned district. This property was originally the site of the Centerville Post Office and general store and in the 1950's the post office moved to the Community Center and the general store .use occupied the entire first floor of the building. The general store has had varied commercial uses and it is now apparent that an intensification of the retail use is necessary to make this property. economically viable. It is a matter of Law that we are not able to grant you a use variance at that particular location - we will hear your arguments, however, David Luke states that his immediate abutters, namely, Rozs' Drapery Den and Franco Real Estate, both in the same zoning district, are conducting a business in the residential zone - the petitioner feels that he is not a unique situation - therefore many other abutters operating businesses in the immediate area, well within the 100' of the highway. Richard Boy comments that this is perhaps why the Town members acted on this issue, by enforcing this as part of the by-law; Chairman, Luke Lally comments that the other uses were probably granted prior to this becoming .a law. Richard Boy- comments that perhaps we should defer this petition. Gail Nightingale moved to deny the application, based on Section Q, 2 (e)the Board cannot grant this within 300 feet of Route 28 - seconded by Dexter Bliss.. The Board voted unanimously to deny the petition. �1985=6&—CORNERST61-VE ENTERPRISES) Attorney Stephen Jones represented the petitioner who is requesting a special permit to change the existing non-conforming use, - to include the upstairs apartment 44 the existing office use. located at Main St., Centerville in an. RD-1 zoning district and currently occupied by Cornerstone Realty, The, Building Inspector claims that the use of the upstairs as an office is not permitted and a»adification is necessary. 071 July 19, 1982, .the. Board granted permission to change the existing general store to an office building with three offices. The petitioner renovated the .buiZding and the existing up stairs apartment - after renting the apartment for several years, the petitioner needed more space and converted the apartment to office space. The Building Inspector feels that the use of the upstairs space as an office was not included in the prior relief granted, although. thepetitioner has only two offices, the Building Inspector has ruled that the upstairs was not to be used as . office space. A prior decision, 1982-45, was granted with several restrictions, namely, no retail activity. A portion of where the stairs were located was removed for 15 parking spaces - to be operational 9 - 5, Monday through Friday &cept for the real estate .use. The petitioner has been to Superior Court where a hearing was held and determined that there is a zoning violation the Clerk issued a complaint hence an application has been filed asking to allow a change of apartment use - apartment to consist of 500 - 600 square feet - kitchen has been removed. The petitioner feels that this will not be more detrimental with the limitations that have been imposed - will be less detrimental. The petitioner relates that he has had problems with tenants - he states that he could have as many as four people residing in an apartment - that would mean just as many vehicles at the site - would also involve activity during the weekends that is not present with the office use, therefore, the activity would not be increased by a change- the petitioner is not asking for permission to have more than three offices - the limitations would still apply- to be no retail or expansion of hours. If this is not granted by the Board, the court will say that the apartment has to reinstated. The building is attractive and enhances the area. Gail Nightingale questions the parking area - Euitding located to the rear - it is the portion where the stairs were - ntxw removed, Chairman, Luke Lally, comments that when this petition originaZlz came before the Board and was granted, there was some concern by members ?f Ae Board 2. Attorney Jones comments that a non-professional has just as much right. Chairman, Luke Lally . asks if the petitioner would submit that allrestricticns .on the prior petition (original decision) have been complied with - Attorney Jones states that "to the best of my Knowledge" - there have been no complaints with- the exception of upstairs - one of the offices might have been open until 6:00 p.m. Dexter Bliss comments that in reading 'the original decision, . offices would be only on the main floor - apartment would remain - those offices have been open prior to 9:00 a.m. - also there is some confusion about the. number of vehicles .- maximum space of about eleven (11) - in addition, there should be no activities directly involved with construction, operated from the real estate office. It is said that those parties rent on Thornton Park so that those vehicles are not at the office site. Is the change from apartment use going to cause additional traffic. There followed a discussion about the total number of square feet on the first floor - 2200 square feet on the first floor- about 500 square feet on the second, it was never scaled out, Mr. Warren, who ;lives in the area, spoke in opposition - saying that the petitioners have renovated the property - he is concerned with the traffic and the parking - thinks this would be-okay if they might know who the tenants are - or what the businesses would be. Chairman, Luke Lally, comments that he is not certain if the Board can question who might rent this, unless the petitioner desires to inform us - also questioning the parking - was there a problem before the reconstruction of the facility - or was the problem created afterwards - Mr. Warren commented that the problem seemed to surface after - only concerned with the traffic that is generated. Chairman, Luke Lally, comments and questions whether there is more traffic now than when it was the general store - Mr. Warren, stated that he did not believe so - we did not have the trucks that we have now. Mr. Panitz comments that he does not feel that we are getting any answers to why the petitioner did not come to the Board before making changes. We have more cars -and conjesticn - the situation is more dangerous, being that there are only two stop signs - an apartment would not create that amount of traffic. Luke Lally comments that most of the Board members will reivew the property. Grace Erdman spoke in opposition - representing herself and Mrs. Roach, who could not be present due to illness - stating that she. feels that this is a blatant disregard of the original decision the apartment did not add to the problem during business hours. The Parking Commission held a hearing on this area - there were complaints from businesses, school bus drivers, etc., -with reference to parking, are they permitted to include on-site parking — there are. barely eleven (11) on site. Everything that is in the original decision has been violated - ti is unethical to do this without first getting permission. Mr. Zveitas also spoke in opposition feels that the petitioner needs variance relief - agrees with what Mrs: Erdman said - comments that perhaps the petitioner should be allowed to withdraw without prejudice - Attorney Jones commented that the petitioner does not wish to withdraw, Mr. McNally also spoke with reference to the cars and trucks that begin arriving about 6:30 a.m. - if this is real estate use, I do not see how anyone can get in there - the parking is very bad - there was further discussion about the offices - does this mean individual offices of businesses - should it be three businesses. Chairman, Luke Lally, comments that he thinks the intent of the Board in granting the change of use to offices, was that there would be three offices, whether they are multiple - we had in mind the granting of a permit to allow three professional offices - Plans were submitted for three individual offices and eleven (11) parking spaces - all on site. 3. l Minutes of Open/Public Hearings - July 25, _1985 �1985=68 CORNERSTONE-ENTERPRISES Sue Rhorback also spoke in opposition to the petition stating that she 'is an abutter and was not notified of the hearing. Attorney Jones stated that he would like to point out that the three parking spaces along the side are on site - lines indicate that they own almost 33 feet into the road - it does give the appearance that it is public. With reference to clients going ahead on this, the clerk took two months to tell us whether there was a zoning violation - the decision was somewhat unclear whether it was three apartments on the first floor or whether there would be three apartments - some confusion about this issue- literally took the point that even though there were only three offices, even though they were on the second floor, that they were not violations - not the intent to ignore the decision. The Board to view the property and the matter was taken under advisement, 1985-69 THOMAS LYONS W. & Mrs. Lyons presented their petition for a special permit to allow a family apartment at Nye Road, Centerville in an RC zoning district. The petitioners were in the process of completing their basement to make a room for their daughter and grandchild - the workmen pulled all of the permits for the work; however, they now realize that they need the special permit for family apartment use. The petitioners will comply with all necessary regulations - stating that they have no intent to rent to anyone else. Gail Nightingale questions the amount of square feet in the apartment - to be about 584 - the first floor is about 1500 square feet. Ron Jansson comments whether, only the renovated area of 584 square feet is the family apartment - the boiler and laundry room as well as the family room also are used by the entire family - they feel that it is not necessarily part of the family apartment: Chairman, Luke Lally, asks the petitioners to place him in locus- where exactly is this located - Pineridge - general directions. Since the Buildin g Inspector made you aware of the v2olatzon, you are now aware that you need relief from Section V of the by-Zaws. The stove is what the Building Inspector found objectionable - permit issued to the contractor - this permit was issued on the basis of remodeling of the basement. This apartment will be used by the petitioner's daughter on a year-round basis - the daughter is employed locally. The Board took the matter under advisement and the hearing was closed. J985-70 DR. JEFFREY TWAROG Dr. Twarog presented his plta i8 before the Board in which he is requesting a special permit to allow o e--car garage- to e. to be used or a professional g � f p f office to provide professional counseling, record keeping and psychiatric evaluations, etc., at .109 Roosevelt Road, Cotuit in an RF zoning district. The petitioner has spoken with most of the abutters who support his petition. This would be a low-key operation- and does not mean that the entire neighbor- hood would be flooded with this type of activity. The petitioner has a drive- way that would accommodate four vehicles - his family has two vehicles. Gail Nightingale questions whether this is an attached garage - it is attached by lattice and girder work - an arbor effect. Chairman, Luke Lally, questions whether the petitioner is more than 300 feet from Route 28 - he indicated that he is about a half mile to Nixon Avenue.
