Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on August 16,2004. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent, to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 22, 2004, continued to September 29, 2004, at which time the Board found to grant the appeal. Board Members deciding this appeal were, Jeremy Gilmore, Gail Nightingale, Randolph Childs and Acting Chairman Ron S. Jansson. Attorney David V. Lawler represented the applicant before the Board. Mr. Lawler explained that a 10-foot Way was designated sometime in the 1930's, apparently to provide access to the property located to the rear. Over time, the Way was completely enclosed within the subject property and today provides no access. Ile noted that the existing dwelling that was built in 1936 intrudes into the designated Way. Mr. Lawler stated this is a"paper road" in that it exists only on paper and not developed on the ground. The Board reviewed the information submitted including copies of past subdivision plans filed in the Land Registration Office. It was noted that no engineered plan for the location of the proposed boat house, showing the proposed setbacks of,the structure had been submitted. The Board deterrai_ned to continue the hearing to September 29, 2004 to permit the development of the plan. At the continuance, Acting Chairman Ron S. Jansson noted that only four members were present to continue the appeal and that if the applicant went forward, all four votes would be required in order for the variance to be granted. Mr. Lawler agreed to go forward. He presented the Variance conditions, noting the uniqueness of the situation. Public.comment was requested and no one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of September 29, 2004, the Board unanimously made the following findings of fact: 1. Appeal 2004-122 is that of Robert E. Bagshaw Jr. seeking a variance to Section 3-1.1(.5) Bulk Regulations Minimum Front Yard Setback to permit the construction of an accessory boathouse structure within the front yard setback established by an old 10-foot wide"paper roadway" that bisects into part of the property. The property is located as shown on Assessor's Map 207,Parcel 015 addressed 594 Main Street, Centerville, MA in a Residence D-1 Zoning District. 2. The property at issue.is a 0.57-acre parcel located on Main Street in Centerville. The property is developed with a one-story, two-bedroom, single-family dwelling of 990 sq.ft. of living area. Construction of the dwelling dates to 1936 and predates the 1950 zoning for the area. 3. The applicant is seeking to construct an accessory structure,- a boat house—on the property. - According to plans submitted, the proposed structure is to be located just off the south right-of-way of a 10-foot Way that penetrates the center of the property. The 10-foot Way located within the property creates unique conditions that affect the locus but not the zoning district in which it is located. 7. Given the conditions on the lot with reference to the Way, and the fact that the land is Land Court property, a literal enforcement of the provisions of. the Zoning Ordinance would involve su bstantial II hardship,financial or otherwise to the petitioner. 8. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance.. x Decision: Based on the findings of fact, a motion was duly made and seconded to grant the appeal with the following conditions: 1. This variance is granted to permit an Accessory building of a boat house to infringe into the required front yard setback established by a 10-foor Way located entirely within the property. 2. The proposed structure is to be sited on the south line of the right-of-way as proposed in a plan entitled "Certified Plan of Proposed Boat House" drawn by Sagamore Survey Associates, dated: September 27, 2004. 3. The proposed boat house shall be built according to preliminary architectural plans presented. The footprint of the building shall not exceed 18 feet by 32 feet, including the 5 foot open deck to the rear of the building: The height to plate shall not exceed 12'-6",to the highest plate and the height to ridge shall not exceed 17'-6",excluding cupolas, chimneys etc..). 4. The inner"upper story" shall only be used for storage. The accessory structure shall not be used for living, lodging or sleeping purposes. It shall only be used as accessory to the main dwelling. 5. Construction shall conform to all applicable building, fire and health codes and regulations. Town of Barnstable Zoning Board of Appeals Decision and Notice Appeal 2004-122—Bagshaw Variance- Section 3-1.1(5) Bulk Regulations, Minimum Front Yard Setback to permit an accessory boathouse structure within the front yard setback established by a 10-foot wide"paper roadway" Summary: Granted with Conditions Petitioner: Robert E.Bagshaw Jr. Property Address: 594 Main Street Centerville,MA Assessor's Map/Parcel: Map 207,Parcel 015 Zoning: Residence D-1 Zoning District Relief Requested & Background: The property at issue is a 0.57-acre parcel developed with a one-story, two-bedroom, single-family dwelling of 990 sq.ft. of living area, constructed in 1936. The applicant is seeking to construct an accessory structure of a boat house. The proposed location of the structure is just off the south right-of-way of a 10-foot Way that penetrates the center of the property. The Way once functioned for access to a back lot that no longer exists and the subject property now encompasses and encircles the entire 10-foot Way. The Way was never constructed on the ground and today the Way can only be used to gain access to the property of the applicant. The location of the boat house structure complies with all other setback requirements including front yard setback from Main Street and from a second 20-foot way located to the south of the property. The applicant has submitted an application for a variance from the Bulk Regulations to permit the new accessory structure to be located within the front yard setback required by the 10-foot Way. Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on August 16,2004. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 22, 2004, continued to September 29, 2004,at which time the Board found to grant the appeal. Board Members deciding this appeal were, Jeremy Gilmore, Gail Nightingale,Randolph Childs and Acting Chairman Ron S. Jansson. Attorney David V. Lawler represented the applicant before the Board. Mr. Lawler explained that a 10-foot Way was designated sometime in the 1930's, apparently to provide access to the property located to the rear. Over time, the Way was completely enclosed within the subject property and today provides no access. He noted that the existing dwelling that was built in 1936 intrudes into the designated Way. Mr. Lawler stated this is a"paper road"in that it exists only on paper and not developed on the ground. The Board reviewed the information submitted including copies of past subdivision plans filed in the Land Registration Office. It was noted that no engineered plan for the location of the proposed boat house, showing the proposed setbacks of the structure had been submitted. The Board determined to continue the hearing to September 29, 2004 to permit the development of the plan. At the continuance,Acting Chairman Ron S. Jansson noted that only four members were present to continue the appeal and that if the applicant went forward, all four votes would be required in order for the variance to be granted. Mr. Lawler agreed to go forward. He presented the Variance conditions,noting the uniqueness of the situation. Public comment was requested and no one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of September 29, 2004,the Board unanimously made the following findings of fact: 1. Appeal 2004-122 is that of Robert E. Bagshaw Jr. seeking a variance to Section 3-1.1(5)Bulk Regulations Minimum Front Yard Setback to permit the construction of an accessory boathouse structure within the front yard setback established by an old 10-foot wide"paper roadway"that bisects into part of the property. The property is located as shown on Assessor's Map 207,Parcel 015 addressed 594 Main Street, Centerville,MA in a Residence D-1 Zoning District. 2. The property at issue is a 0.57-acre parcel located on Main Street in Centerville. The property is developed with a one-story,two-bedroom, single-family dwelling of 990 sq.ft. of living area. Construction of the dwelling dates to 1936 and predates the 1950 zoning for the area. 3. The applicant is seeking to construct an accessory structure—a boat house—on the property. According to plans submitted, the proposed structure is to be located just off the south right-of-way of a 10-foot Way that penetrates the center of the property. The location of the structure is to comply with all other setback requirements including front yard setback from Main Street and from a second 20-foot Way located to the south of the property. 4. It appears the Way once functioned for access to a back lot that no longer exists and the subject property now encompasses and encircles the entire 10-foot Way. The Way was never constructed on the ground and apparently there are no utilities within the Way. It is a"paper road". Today the Way could only be used to gain access to the property of the applicant. 5. According to a survey plan submitted with the application, the existing dwelling already infringes into the 10-foot Way. 6. The 10-foot Way located within the property creates unique conditions that affect the locus but not the zoning district in which it is located. 7. Given the conditions on the lot with reference to the Way, and the fact that the land is Land Court property, a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner. 8. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. 2 Decision: Based on the findings of fact, a motion was duly made and seconded to grant the appeal with the following conditions: 1. This variance is granted to permit an Accessory building of a boat house to infringe into the required front yard setback established by a 10-foor Way located entirely within the property. 2. The proposed structure is to be sited on the south line of the right-of-way as proposed in a plan entitled"Certified Plan of Proposed Boat House"drawn by Sagamore Survey Associates, dated: September 27, 2004. 3. The proposed boat house shall be built according to preliminary architectural plans presented. The footprint of the building shall not exceed 18 feet by 32 feet,including the 5 foot open deck to the rear of the building. The height to plate shall not exceed 12'-6"to the highest plate and the height to ridge shall not exceed 17'-6", excluding cupolas, chimneys etc..). 4. The inner"upper story"shall only be used for storage. The accessory structure shall not be used for living, lodging or sleeping purposes. It shall only be used as accessory to the main dwelling. 5. Construction shall conform to all applicable building, fire and health codes and regulations. The vote was as follows: AYE: Jeremy Gilmore,Gail Nightingale,Randolph Chiles and Acting Chairman Ron S Jansson. NAY: None Ordered: Variance 2004-122 is granted with,conditions.
