DEFINITION OF HOMEOWNER Person(s) who owns a parcel of land on which he/she resides or intends to reside,on which there is, or is intended to be, a one or two- family dwelling, attached or detached structures accessory to such use and/or farm structures. A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such"homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building permit. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this.section(Section 109.1.1 -Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application;that the homeowner certify that he/she understands the responsibilities of a Supervisor. This inspection was conducted onithe basis of a complaint received at Barnstable Health Division. The following violations of the State Sanitary Code were observed: 105 CMR 410.500—Owner's Responsibility to Maintain Structural Elements. The living room,hallway and kitchen ceilings are in the need of repair due to leaking roof.. You are directed to correct the violations listed above within thirty (30) days of your receipt of this notice by repairing or replacing the leaking roof; by repairing the said ceilings after leaking roof has been corrected; by removing all mold like growth and sources of chronic dampness. Complaint of unsafe living conditions • Reported to site with Jeff Lauzon and Martin MacNeely, COMM Fire on 10/19/2011. • The conditions were windy, rainy and raw. • Found the property to consist of a SF dwelling and a block foundation,wood- framed rectangular structure identified as a workshop. • Although the aerial view online shows multiple structures (sheds?),they were not readily visible on this occasion perhaps due to the severe weather as we didn't really walk the site. Storage Trailer • A storage trailer is situated at the end of driveway. • Household debris was scattered along side of the container including upholstered pieces and appliances. The same type of belongings was later found to be inside the storage unit. • A man responded to our knock at the side door of the residential unit. • He identified himself not as a tenant but as a person who is staying there, a cousin . of the owner. • He stated the owner was not home. • Just a few moments later the owner, Cliff Lihou walked out of the house. • There was some tension and disagreeable conversation with the "cousin" regarding our request to inspect the house as part of our investigation. • We walked over to the storage unit and discussed the complaint.- • The "cousin" was argumentative and angry. He'declared that he knew Charlie Wood called us and he keeps making false accusations against them, According to the cousin, Charlie stayed here a few years ago and the trailer and personal effects outside belong to him. • The"cousin"insisted that Charlie refuses to clean out the trailer or remove his belongings and the owner of the containment unit wants to pick up the unit as he has not,paid any of the rental fees for considerable amount of time. Charlie will not let them empty the trailer. • The police were here a few days ago. Charlie was given a..verbal notice to. remove his belongings. They will continue to pursue a remedy to this. • The cousin did not want us to enter the dwelling. He asked.to speak alone to Cliff and the two of them walked off together. Later,they suggested that we return with a search warrant and the police. • I said I could certainly return with the police. • We explained that we needed only a few minutes to'check the house in order close out the complaint. Ultimately, Cliff relented and we all walked over to the house. Dwelling • Ultimately, we were admitted to.the house. • We had received a complaint that the roof was caving in, that buckets were used to contain the rain,that there was no,power, no heat,and gasoline was stored in the basement. • The side door of the dwelling admits one into an unfinished room that currently is used for storage but is said to be intended to be a new kitchen in the future. It is obvious that the shell was completed including power but the area remains unfinished. The appearance of this space is akin to,a hoarding although egress was not blocked. • The next room is currently being used as a bedroom—again the hoarding theme carried through. • The long hallway contained two other be and a bathroom before spilling into another open room (likely a dining room)and ultimately the kitchen at the far end of the house. We`found ceilings are in fact caving in in the hall,dining room and kitchen and likely in other areas. There was almost no natural light and the electric light was very dim or missing. • Each room was suffered a hoarding ambience but the,bathroom was exceptionally clean and neat. • There is running water, hot and cold, the range worked(burners and oven) and there was food in the kitchen. • There is a wood stove in the former dining rooms and wood_ stored in that room as well as in the kitchen: The basement contained multiple lawn mowers, oil tank, washer& dryer and stacks of wood: " • Martin MacNeely provided replacement smoke detectors and ordered them to- obtain.a new CO detector. He arranged to return on Friday to re-inspect for the installation of operable smokes & CO detectors Workshop • The owner, Cliff Lihou advised that the workshop was his father's and the building is over a hundred years old. Nothing inside:was vented and everything was covered with a film of wood dust. Although Mr. Lihou and his "cousin" claimed Cliff is working and even recently had stayed up to 2 AM to make cabinet,the shop look untouched for a long period of time, • Due to the thick layer of wood shavings and dust,deficient venting and lack of fresh area(although 2 garage doors can be opened),this area was ntoed to be a grave concern for combustibles. • Cliff noted the heating system and electrical work was redone but did not indicate when (no permits on file). " • It should also be noted that on this date Cliff is 62 years old(DOB 8/26/49) on .this date and this work shop belonged to Cliff's father. Its use was at least established when Cliff was a child as some of his comments about his father highlighted the fact that the elder Mr. Lihou held the workshop in higher esteem than the house because his living was dependent on the shop; there was no spare time to finish or provide upkeep for the dwelling. This explains some of the old unfinished work such as the over hang and perhaps even the intend new kitchen. Conclusion • During the house inspection,they both cited that money was tight because there is no work but in the shop they both indicated that Cliff was busy working and hadn't had time to clean the shop. • I suspect there is a little hoarding issue. ,I also suspect that the cousin who admittedly was "rescued from a homeless shelter by Cliff' may have a substance issue. I concluded this based on his appearance, demeanor and two empty 12 packs found in the shop. Cliff, on the other hand seems to be a simple, gentle man who may was trained to work with his hands by'his father and developed a skill set of his own. I am not necessarily convinced the cousin is "helping" Cliff but Cliff may in fact be better having someone there with him considering the alleged activity of Charlie Wood. I am not offering a definitive judgment simply my observation that I remain skeptical. • I did not pursue any discussion regarding the business aspect as this use was by all documented accounts pre dating and is likely to be recognized as a pre-existing non conforming use. • In any case, I am not sure that the use is active and if it is it is barely active. • Mr. Lihou said he works alone one small job at a time. The fact that no inspections were made are, first of all, erroneous. Not only have I made several inspections, I have talked with Mrs' Lihou at her house, I have gone over the grounds with Mr. Lihou in the evening after he arrived from work. We had a great deal of digs- cussion about his yard and that a relative owned some of the items and would be removing, them. I have called him to see if his yard was cleaned and he said that he was waiting for. the relative. I might add that Mr. Lihou was not receptive to my. concern over his property. As late as last week, Mr. Lihou was in my office and accused me of harassment because I have questioned him about his land and he advised me that he was going to engage his attorney. Before this episode started, I very distinctly told Mr' Aspirino that I had been involved in this type situation before and knew of no law that legislated how an individual must keep his yard. I had called Mr. .O'Donnell in the Distiict Attorney's office where I obtained my information. Now in the phone calls with both Mr. and Mrs. Aspirino, I stated this and even encouraged Mrs. Aspirin to engage an attorney when she mentioned it to me. All this was mentioned with the first complaint. , I even went to sPe the owner who built the house and the same condition was there when he built' the original house. The statement made by Mr. Aspirino that '!When this man, Cliff Lihou, walks into our office, he causes -euch a rempus, everyone around here shakes" is the most absurd statement I have heard in some time. It's a little late in life for me to be intimidated by anyone. Mr. Aspirino read a portion of the "Purpose" in the zoning by-laws, but he neglected to complete the-paragraph. The statement that, "I can get anything I want out of Joe DaLuz" perhaps would be more appropriate if he substituted the word "can" to "can't" and ." also understand-DaL•uz does not like to get involved in this type of situation". To that end, I` should.,have done what I ,pondered in the beginning, knowing the limits,, insist they get` their own attorney. My version of the problem: It's true that the Aspirinos bought a nice home with swimming pool which unforbunately is' adja6nittta"the Lihou's property: The second.floor overlooks.'the"pool and into the adjacent yard. ' It is also true that Mr. Lihou was there as per the assessor's card in 1965. Mrs. Aspirinn in her conversation with me stated that in cleaning their back yand, they cut a tree branch which was overhanging in their yard. According to her that started the dispute over the property line. The Aspirinos had their land surveyed and f L 5y a Board of Selectmen January 16, 1979 Page 2 now a fence exists where Mr. Lihou had his driveway. He now has to use a side and rear driveway: There is no love lost, unfortunately, between these neighbors. In my honest opinion, this situation will not change. I even asked Mr. Lihou about at least painting his shed. The answer, I'm not doing anything. I know of no case where I- have refused to investigate any question about zoning. I also asked John Kelly to view the property, which he did. His report is enclosed. I find no_ conclusi.ve evidence ranch could be substantiated if I were summoned into Court. As I stated before, I believe it unfortunate that a conflict between neighbors exists. I hive done all that is humanly possible to help alleviate the situation..
