VARIANCE
DECISION AND NOTICE
PETITION : 1990-41
PETITIONER: DANIEL AND SALLY ANN SERPICO
At 'a, regularly scheduled hearing "of the Barnstable Zoning, =
Board of Appeals , held on July 12, 1990 notice of which .was µ
duly published in the. Barnstable Patriot, and notice of
which was forwarded to all interested parties pursuant to
Chapter 40A of the General Laws of Massachusetts , the
petitioners, Daniel and Sally Ann Serpico , petitioned the
Board for a Variance from Section 3- 1 . 1 (5), of the Zoning
Bylaw in order to construct an addition which will intrude•
into the front yard setback.

The petitioner' s property is locatedat 461 Pine Street,
Centerville, MA and is shown on .Assessors' Map 228 as .lot
103 . It is in the Residential D- 1 ' Zoning District.
A Plan entitled "Site Plan in (Centerville) Barnstable,
Mass . for Daniel & Sally Ann Serpico" , prepared by`"Baxter &
Nye, Inc. ; dated May -30, 1990 has been submitted to the
Zoning Board of Appeals file.
Mr. Serpico presented his petition to the •Board. He stated '
that he would like to extend the existing porch on .his
dwelling eight' (8) feet to the west.
Mr. Serpico discussed the topography of his lot. On the
east is the Herring Run which is eroding. The western
border of the lot is a dirt road. Mr. Serpico stated that
this road is shown on the original 1926 Subdivision Plan as
a thirty (30) foot way. Mr. Serpico further stated that the
.road is only about fifteen .( 15) feet wide, ' it has always
been a dirt road and , it is not serviced by. the • Town. The
problem of the intrusion -into the setback arises from the '
fact that due to this lot line bordering a way, the required
setback is a thirty (30) foot front yard setback and not a
side yard setback . i
Mr . Serpico discussed the fact that at a distance. of 160
feet south of Pine Street, the zoning changes from
Residential D- 1 to Residential C and this places his lot in
two different zoning districts. Mr. Serpico stated that the
setback requirements in the Residential C district are less
restrictive than those in the Residential D- 1 district; the

required front yard setback in the Residential C. district is
only twenty ( 20) feet .
Mr. Serpico stated that he is aware that he must comply with
the regulations of the Conservation Commission.
FINDINGS OF FACT:
Based on the information presented, the Zoning Board of
Appeals made the following findings of fact :
I ., Variance conditions exist due to the topography of the
lot .and the erosion of the Herring Run ;
2 . . The addition will be only eleven ( 11 ) feet, at its..
closest point , from the western lot line; and
.3 . The lot is unique due to its location in two different
zoning districts .
The vote on the findings of fact was as follows :
AYES: BLISS, BOY, BURLINGAME , MCGRATH, NIGHTINGALE
NAYES: NONE
DECISION:
Based on the information presented and the findings of fact,
at a meeting held on July 12, 1990, by a motion duly made
and seconded, the Zoning Board of .Appeals voted to grant the
relief requested.
The vote was as follows :
. AYES: BLISS, BOY, BURLINGAME , MCGRATH, NIGHTINGALE
NAYES: NONE
