Also attached is a copy of a portion of the plan dated August, 1986 (1986 plan)that was filed with the petition for variance from bulk regulations(width and sideline).The Board found that the dwellings were established "pre-existing non-conforming use." I assume that this phrase also means that the dwelling on what is now Lot 48 was also non-conforming as to front yard setback from Pine Tree Drive.The 1986 plan filed with the petition shows a deck across the northwesterly fagade of the dwelling which is setback about 2 feet from the sideline of Pine Tree Drive. In 2003,the then owner,John G. Kavanagh, secured a building permit to replace the "existing deck" deck on the second floor of the NW facade (application attached).The drawing submitted with the application shows the deck off the first floor, which appears to be the in the same configuration as the 1986 plan, although no width is shown. Finally, attached is the plot plan that was recently done which 1) shows the deck on the first floor in a different configuration and closer to (abutting the southerly sideline of Pine Tree Drive)than on the 1986 Plan (no permit issued was for this deck which appears to be new). In addition, construction of a lattice storage area within the "L" on the northerly side of the dwelling has apparently taken place since the 1989 variance was issued that encroaches into the setback from Pine Tree Drive. Also, an outside shower enclosure has been constructed on the SW fagade that encroaches into the sideline setback and an unknown structure is protruding from the NE fagade (I will find out what this structure is). This home is within 300 feet of the property located on the southwest corner of the intersection of Pine Tree Drive and Old Stage Road. There, the owner Mr. Thomas P. O'Neill III, and the builder Mr. Joseph Campagna, applied for a permit on July 28, 1986. This permit covers. "Remodeling with wood shingle + dry wall," and indicates that there is to be "No change" in the area of the two buildings involved. Subsequently, a ground level deck, measuring 14 by 14 feet, has been added to the larger of the two houses. At the smaller house, a new door has been placed in the north wall of the rear shed. Serving this door is 'a new deck 4 by 11 feet. Above this deck is a new second floor deck 4 by 15 feet. This smaller house was originally just over 4 feet from the property line. The new ground floor deck serving the new rear door is about 2 feet from the property line. The post and footing supporting the second floor deck is less than one foot from the property line. Has the placement of the post and footing supporting the second floor deck been approved by the Building Inspection Department?
