Dear Mr. Stevens,
In reference to our property located at 43 Piney Pt. Dr. I would like to inform you
that we plan to come down to the Cape sometime during the week after Christmas as we
have school vacation at that time. We will have to drive there with the building permit
application and take it to the various depts involved as we are unable to find someone
we know on Cape that could do this for us. I did call your office because we originally
were planning on coming down the day after Thanksgiving but we were told the office
was closed then.
I am writing this to verify that we are once again willing to comply with your
office and because of the distance to travel and the time it would take we have been
unable to process this application sooner.
If we can send it down to each individual dept. involved through the mail and have
them send back to us each section that pertains to them completed then it's possible that
it could be done sooner, however I'm not sure we're allowed to do this.
Please show this letter to Gloria so she is aware we plan to take care of this matter.

Dear Mr. Stevens,
I spoke to you on Friday afternoon, March 26, 1999 concerning the removal of a
stove from one part of our house located at 43 Piney Pt. Dr., Centerville. I was
responding to a letter to us about"reverting the above structure back into a single family
home"written by Mr. Crossen. I was confused by the wording as this house has never
been structurally changed since it was built. You explained to me that we need to remove
the stove.
This letter is to confirm our co-operation and compliance with the building division
concerning this matter. We are more than willing to remove the stove.
We plan to move down to that property at the end of June for the summer at which
time we would appreciate the flexibility of your dept. (which you mentioned) concerning
the inspection of the house at that time. We understand your need to insure that the stove
is removed,however it would be more convenient for us to meet with you then as we
have to work daily on the North Shore until school closes for the summer.

Point Drive, Centerville, MA. The owner of the lot is identified as being a Raymond Hooper by the Town
of Barnstable Assessor's Records. The lot was developed in 1960 with a 1,532 sq.ft. structure now
identified by the Assessor's Records as being utilized as a three-family dwelling.
The applicant is seeking two forms of relief from the Board:
Appeal No. 1997-107 seeks the Board to overrule the order of the Building Commissioner dated
July 11, 1997,that states the dwelling at"43 Piney Point Drive, is currently being used as a
three-family home contrary to Barnstable Zoning Ordinance."
Appeal No. 1997-108 is seeking a Use Variance to the Principal Permitted Uses(Section 3-
1.1(1)) in the district to allow the use of the structure as a two-family dwelling. It is also seeking
a variance from the lodging provisions (Section 3-1.1(2)(A)) apparently seeking to allow more
that 3 lodgers and apparently to permit lodging use in apartments.
Procedural Summary:
The appeals were filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on
August 18, 1997. A public hearing before the Zoning Board of Appeals was duly advertised and notices
sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened October 08, 1997,
continued to December 03, 1997, at which time the Board allowed the appeal to be withdrawn without
prejudice. An Extension of time for filing of the decision was executed between the Board and Applicant.
A copy of that extension is contained within the files.
Board Members hearing and deciding this appeal on December 08, 1997, were Ron Jansson, Gail
Nightingale, Gene Burman, David Rice, and Chairman Emmett Glynn. Attorney Peter Freeman
represented the applicants, Paul &Susan Ingram,who were present.
Hearing Summary:
At the opening of the public hearing on this appeal,the chairman read a letter dated October 06, 1997,
from Attorney Freeman requesting the appeal be continued. The Board granted a continuance to
December 3, 1997. At that hearing,the Board did permit Ray Beaton, an abutter,to state that there is
opposition to this appeal amongst some of his neighbors. He cited that they will be writing a letter in
opposition.
At the December 03, 1997, continuance of the hearing, Attorney Freeman asked that this appeal be
withdrawn. He explained that because this district has been a single family area since 1950- before the
house in question was built- he can not establish a pre-existing use and must agree with the Building
Commissioner's decision.
