The caller was adamant that our department inspect the service/meter so that they could get their power restored. They were very argumentative when told that they needed an electrician first and the electrician would request our inspection after they checked the service/meter. The caller spoke to three different people in our-office. He claimed one of our staff had sworn at him(we all sit together and.listened to each other speak to this caller, and this was not the case). That day the property owner called and informed our department that the occupant was out of the hospital. They were informed of the process and their electrician came in the next day to pull a permit and request an inspection. We then attempted to inspect the property that day. When Electrical Inspector Arthur Doherty arrived at the property, there were small children on the site. They went into the house to get the `him'. After waiting for fifteen minutes for an adult to appear,the electrical inspector left. The occupant called our offices the next business day(Monday) and was informed that we attempted to inspect the property on Friday and we were unable to inspect the panel as there wasn't an adult available to gain entry; he was told our inspector waited for an adult to come out of the house for 15 minutes. He did not reply to this. Our inspector did inspect that same day and he was able to gain access. Two letters in favor of the appeal were submitted to the file. Marcia Cowan, an abutter, stated that she bought her home in 1949 and at that time there were two houses on that lot. The houses at different times, have been rented. Also speaking was Gail McGuire who stated she is concerned with the septic system and its location near Bearse Pond. Chairman Nightingale explained to her that any work done would have to be approved by the Board of Health. Because Mr. Langfield needed to do more research and prove his case, a motion was made and seconded to continue Appeal Number 1996-51 to July 10, 1996. At the July 10 hearing, Mr. Langfield submitted two signed letters in support of his position. One from Mr. & Mrs. Cowan stated in 1949 there were two cottages and one from Mrs. O. Pearson stated that in 1949 her sister built the two cottages and rented the back cottage while they owned the property. Mr. Langfield tried to get aerial photographs to show there.were two dwelling in 1951/1952, however, when he searched the database of the U Mass Earth Science Dept., he was told they are currently not available. Mr. Langfield submitted a memorandum outlining the numerous places he has researched, such as, surveyors'files, the Health Department, the Building Department, estate records, etc. The Board requested public comment. No one spoke in favor or in opposition to Mr. Langfield's request. The Board also requested the Applicant look at the Assessor's Records for 1951, 1952, and 1953 to see if they indicate there were two dwellings. This would help to support their case. Also, any photographs from those. years would be helpful. A motion was made, seconded and unanimously voted on to continue this appeal to July 24, 1996 at 7:15 PM. On July 24, the Petitioner was represented at the hearing by his father-in-law, Carl Mitchell. He agreed to have the appeal heard by only four Board Members as Ron Jansson was not present. Board Members hearing this appeal on July 24 were Richard Boy, Emmett Glynn, Gene Burman, and Chairman Gail Nightingale. Mr. Mitchell had located aerial photos dating back to 1952 which show the two buildings on the one lot. He showed the new information to Mr. Crossen and the Building Commissioner advised Mr. Mitchell that he no longer needs the Special Permit he is seeking as Mr. Crossen will now issue him a Building Permit for both structures. He respectfully requested to Withdraw Without Prejudice his appeal. The Board asked the Building Commissioner if that was accurate and Mr. Crossen stated that he has aerial photography, statements from neighbors and information from the Assessing Department that convince Mr. Crossen that the structures are pre-existing non-conforming. My plan , at that time , was to extensively renovate the larger cottage to make it suitable as a home for my family and to rent the smaller cottage for income . That income would be necessary for me to finance the renovation . I did not suspect there would be a problem with this plan since : - The seller ' s "description of property" and the broker ' s sales literature identified a second dwelling suitable for rental . - Both the seller and the next door neighbors assured me the second dwelling had been rented on a regular basis for many years . - The deeds back to at least 1965 identify the property as including "multiple buildings" . - The property assessment of Sept . 1972 identifies 2 buildings ; a family dwelling with 4 rooms and a bath and a cottage with 3 rooms and a bath. . I am ready to proceed , however I now know my plans may be inconsistant with current zoning codes . I 've extensively searched Town records and cannot substantiate with certainty that the cottage pre-dated zoning , except that it did exist prior to Sept . 1972 . I did not find any evidence of building permits for either' building on the property. The last owners (since 1965) are deceased and the trustee doesn ' t have any further information . I am therefore requesting this special permit , which hopefully you will see fit to approve , so that I may .protect my investment . I believe my plans will not further detriment the neighborhood and .will , in fact , greatly improve the appearance of the property. The Board told Mr. Langfield that if he needed additional time,they could continue his appeal and he could research further the history of the lot. Public Comment: Two letters in favor of the appeal were submitted to the file. Marcia Cowan,an abutter,stated that she bought her home in 1949 and at that time there were two houses on that lot. The houses at different time,have been rented. Also speaking was Gail McGuire who stated she is concerned with the septic system and its location near Bearse Pond. David Langfield represented himself before the Board. Also present was his father-in-law,Carl Mitchell. This appeal was continued from June 5, 1996 to allow the Petitioner time to do research to establish that the legal non conforming use he is seeking does,in fact,predates zoning. Mr.Langfield reminded the Board that he had purchased the property with the two dwellings on it. He was told by the realtor,the cottage could be rented without any problem as it had been previously rented. Mr.Langfield submitted two signed letters in support. One from Mr.&Mrs.Cowan stating in 1949 there were two cottages and one from Mrs. O.Pearson stating that in 1949 her sister built the two cottages and rented the back cottage while they owned the property. Mr. Langfield tried to get aerial photographs to show there were two dwelling in 1951/1952, however,when he searched the database of the U Mass Earth Science Dept.,he was told they are currently not available. Mr. Langfield submitted a memorandum outlining the numerous places he has researched,such as, surveyors' files,the Health Department,the Building Department,estate records,etc. The Board asked Mr. Mitchell if he knew when the field card listed the property as having two dwellings on it. He stated he did not know,but that he would check further if that would be helpful. There is town water in the main dwelling and the Board suggested he may want to check the Water District files to see if they have any additional' information. Public Comment: No one spoke in favor or in opposition. There are four letters in of support in the file. The Board explained to the applicant that a true affidavit would indicate that it was signed under"pain and penalty of perjury"and that it was"true to the best of their knowledge_ and belief." Both letters that were submitted,should state that information if they are to be used as affidavits. The Board also requested the Applicant look at the Assessor's Records for 1951, 1952,and 1953 to see if they indicate there were two dwellings. This would help to support their case.
