A person who constructs more-than one home in a two-year period shall not be considered a homeowner. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the provisions of this section(Section 109'1.1-Licensing of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that sucliHomeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed-Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. Her stated that the electrician was going to return to move the smoke detectors. I stated that was fine, and asked him if he knew who had signed off the building permit in the fire department's space. He said he did not. I then explained that someone had signed it off, at which time he corrected me, and stated he had written in the date and time I was there for the inspection. I told him that space was for the fire department to sign off for our inspection. I verified again that he had written in the space for the fire department sign-off, and he stated "yes." Since an inspection was made approximately one and a half months ago that found problems, I called the electrician to find out the status of the corrections. As of this date, he has not returned my call. History of Incident: A representative from Mr. Drew's company came into this station on June 13, 2002 to pull a permit to install a smoke detector system at 41 Point of Pines Road, Centerville. At that time, Kathy asked the applicant if the house was already done. He gave her the impression that it was. Within a few days, Mr. Drew's secretary called to inquire about the permit procedure for this Department. Kathy explained the procedure and faxed a copy of the Town's requirements. This struck me odd because Mr. Drew has been pulling permits from this Department for years. Again, after a few days, an inspection was scheduled for June 24, 2002. At that inspection, the following discrepancies were found: 1. The second floor hallway detector was within approximately 18 inches of the bathroom door. 2. The rear bedroom detector, second floor, was within approximately 22 inches of the paddle fan tips. 3. The front bedroom, second floor, was within approximately 12 inches of paddle fan tips. A representative of Mr. Nickulas was on location, and I advised him of the problems. Later in the day, Mr. Nickulas came to this station to discuss problems. I tried to explained the situation to Mr. Nickulas, but after a few minutes he started to insinuate that the failed inspection was due to a possible problem I have with Mr. Drew. I stated that Mr. Drew was one of the most code knowledgeable electricians that pull permits here, and essentially brought the conversation to a close. The next day, Mr. Drew called to go over problems. He stated he would look into the codes and get back to me. After this, Mr. Drew's secretary called to inform me that she researched the codes and could find nothing that states a specific distance from paddle fans. I told her that NFPA 72 dictates distances from ventilating systems (3 feet), and this Department has consistently enforced this regulation with paddle fans also. This is the last conversation with anyone involved in this matter. I called Mr. Drew's office on August 7, 2002 to inquire about the status of the corrections. His secretary took a message and stated Mr. Drew would contact me regarding status. F� l Page: 2 I called Town Building Department to inquire if they had an occupancy certificate, which the secretary stated she did. I asked if the F.D. had signed off, and she said yes. I requested that she fax a copy to this station. I looked at the permit and found someone other than the fire department had signed off in the space.
