I called back a couple of times about a month and a half later, and left messages,but have not heard back from Mr. Dube since. And finally, D. I followed up with a written request from Lois Barry on 1/29/03 to send out an inquiry letter to the following individuals regarding their participation in Amnesty. I sent a letter to each on 2/10/03,but I have not heard back from any of the property owners.They were all formerly legal Family Apartments: 1. Peace, osepn D. uz Building Commissioner ,jL)D/km C(__ Board of: Appeals TOWN OF PARNSTABALE ZONING BOARD OF APPEAR OCT 1` PZ :41 SPECIAL PERMIT DECISION AND NOTICE PETITION: 1988-57 PETITIONER: RICHARD AND GAIL SCHERBATH FAMILY APARTMENT At a regularly scheduled hearing, held on July 14, 1988, notice of which was duly published in the Barnstable Patriot, and notice of which was forwarded to all interested parties pursuant to Chapter 40A of the General Laws of Massachusetts, the Petitioners requested a special permit pursuant to Section 3- 1 . 1 (3) (D) of the Town of Barnstable's Zoning Bylaws to allow a family apartment within the home which they are proposing to build in Centerville at Map 147, Lot 20, Rosemary Lane in an RC zoning district. In support of this petition, the Petitioners presented evidence that the following conditions applied which would warrant the grant of a Special Permit. _ The Petitioners are seeking to attach a family apartment to the new home that they propose to build and presented a plan showing the proposed house and apartment wing and ell addition on the northwesterly corner of the house.. The new house will be 1 ,672 sq. ft. the proposed family apartment will be attached in a wing and ell to the house and contain 680 sq. ft. The apartment will be utilized on a year-round basis by the petitioner's father who has recently become a widower and is in failing health. The petitioners are familiar with and intend to comply with all of the provisions of the bylaw as it pertains to family apartments. FINDINGS OF FACT: Based on the evidence submitted the Zoning Board of Appeals made the following findings of fact: Family apartments are allowed in all zoning districts of the Town and the petitioners understand that they must comply with Section 3-1 . 1 (3) (D) of the bylaw. The use as proposed, will not be in derogation of the spirit and intent of the zoning bylaw and will not result in detriment to the neighborhood affected. Based on the above findings, the Zoning Board of Appeals, at a public meeting held on September 22, 1988, by a motion duly made and seconded, voted to grant the Special Permit to allow a family apartment. The Petitioners are seeking to attach a family apartment to the new home that they propose to build and presented a plan showing the proposed house and apartment wing and ell addition on the northwesterly corner of the house.. The new . house will be 1 ,672 sq. ft. the proposed family apartment i will be attached in a wing and ell to the house and contain 680 sq. ft. `The apartment will be utilized on a year-round i basis by the petitioner's father who has recently become a widower and is in fairing health. The petitioners are familiar with and intend to comply with all of .the Provisions of the bylaw as it pertains to family apartments. " •FINDINGS OF FACT: s Based `on the evidence submitted the Zoning Board. of Appeals made the following findings of fact: Family apartments are allowed in all zoning districts of the Town and the petitioners understand that they must comply { with Section 3- 1 . 1 (3) (D) of the bylaw. The use as proposed, will not be in `derogation of the spirit and intent of the zoning bylaw and will not result in detriment to the { neighborhood affected. Based on the above findings , the Zoning Board of Appeals, at a public meeting held on September 22, 1988, by a motion duly made and seconded, voted to grant the Special Permit to allow a family apartment.
