Background Information: The appeal is to the Zoning Board of Appeals in accordance with MGL Chapter 40A,Section 13 and IS. The applicants are appealing the February 10, 1995,decision of the Building Commissioner not to issue single family building permits for two lots numbered 007.018 and 007.023. Both Lots 18 and 23 were buildable at the time the applicants took possession of them. The roads have been built and the lots released. 5. Lots 18 and 23 are separate lots and are not contiguous with each other—four developed lots intervene. Neither lot was held in common contiguous ownership from 1988. 6. At the time the lots were created through the subdivision,zoning requirements were met. >: 7. The lots met the minimum requirements to be buildable being over 7,500 sq.tt with more than 20 feet of frontage. 8. Prior to the expiration of the eight year grandfathering of a subdivision,the two lots were not in common contiguous ownership. The petitioner applied for a variance from the minimum lot area and also appealed that decision of the Building Commissioner(see Appeal No. 1995-50). Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on March 02, 1995. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to abutting neighbors in accordance with MGL Chapter 40A. The public hearing was opened on May 03, 1995,at which time the petitioner,through their attorney,Mark H.Boudreau requested a withdrawal without prejudice. The Board determined to grant the request to allow a withdraw without prejudice. The case was determined by Appeal No. 1995-50 with the Boards vote to over-rule the Building Commissioner's denial of a building permit.
