According to information supplied, the applicant is seeking to add 'a two story wood frame addition to the east side of the existing single family dwelling. The application was filed in the offices of the 'Town clerk and at the - - Zoning Board of Appeals office on October 27,1993. . A public hearing duly noticed under M.G.L. Chapter 40-A was opened on November 18, 1993, and: kept open until December 2, 1993 at ,which time Mr. Nason would provide. the Board with a plan showing the exact easement. of the driveway in . conjunction with his driveway and building plan. ' on December '2, 1993; Mr. Nason appeared with several maps as requested but without the. requested easement document. The issue of intensity of use on a small' lot ,was raised by Mr. Jansson as well as the. hardship cited as being self, imposed. - After discussion Mrs. Nason offered to show the Board an IJ alternative plan and the Board decided to continue this -to the January 5, 1994 meeting at which time Mrs. Nason. presented the re-worked plan. The public was invited to speak at each meeting however no person came forward to speak. The Board voted to grant the requested relief as per the new plan. Procedural Provisions: Section 5-3.2 (3) : Variances Background Information: The parcel is located on South Main Street just east of the bridge over the Bumps River. According the the assessor property card, the 0.37 acre waterfront lot is developed with one story, 4 bedroom, 2.1 bathroom single-family dwelling with a gross area of 1,969 sq.ft. The dwelling is connected to public water and has a septic system installed on site. The structure "year built,* is indicated as 1956. According to information supplied, the applicant is seeking to add a two story wood frame addition to the east side of the existing single family dwelling. The first floor is to be a garage with storage space; the second floor (765 sq.ft.of living space) is to be two additional bedrooms and a bath. -- A sketch of the locus showing the proposed addition and the property's relationship to surrounding properties and driveways has been submitted with the application. The portion of the abutting property (a "panhandle*, of over 180 ft. to So. County Rd. ) is not being used as actual access. Procedural Summary: The application was filed in the offices of the Town Clerk and at the Zoning Board of Appeals office on October 27, 1993. A public hearing duly noticed under M.G.L. Chapter 40-A was opened on November 18, 1993, and kept open until December 2, 1993 at which time Mr. Nason would provide the Board with a plan showing the exact easement of the driveway in conjunction with his driveway and building plan. on December 2, 1993, Mr. Nason appeared with several maps as requested but without the requested easement document. The issue of intensity of use on a small 11 t was raised by Mr. Jansson as well as the hardship cited as being self imposed. After discussion Mrs. Nason offered to show the Board an alternative plan and the Board decided to continue this to the January 5, 1994 meeting at which time Mrs. Nason presented the re-worked plan. The public was invited to speak at each meeting however no person came forward to speak. The Board voted to grant the requested relief as per the new plan. Find of Facts: Based upon the evidence submitted and the Testimony given at the public hearing on Appeal No. 1993-66, The Zoning Board of Appeals unanimously found: 1. Due to the location which is adjacent to Centerville River and imposes certain criteria for development within 150 feet of the water s edge and do to the configuration of the lot which is panhandled and the buildable portion being long and narrow, variance conditions have been established as required under M.G.L. Chapter 40A. 2. Granting the relief sought would not be in derogation of the spirit and intent of the zoning ordinance. Conclusion: Accordingly, based upon the findings, a motion was duly made and seconded that Appeal No. 1994-66 for a Bulk variance, Minimum Yard setback be granted as per revised plan dated January 3, 1994 titled sketch plan of land in Centerville (Barn) MA prepared for Robert Nason by Down Cape Engineering. We had hoped to be finished with the whole addition by this point in time, but have been waiting for our excavator.
