DEFINITION OF HOMEOWNER Person(s)who owns a parcel of land on which he/she resides or intends to reside,on which there is,or is intended to be,a one or two-family dwelling,attached or detached structures accessory to such use and/or farm structures. A ` person who constructs more than one home in a two-year period shall not be,considered a homeowner. Such "homeowner"shall submit to the Building Official on a form acceptable to the Building Official,that he/she shall be responsible for all such work performed under the building_permit (Section 109.1.1) The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other applicable codes,bylaws,rules and regulations. ' HOMEOWNER'S E%ENIP'ITON The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt from the-provisions of-this section(Section 109.1.1-Licensing of construction Supervisors); provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall_ act as supervisor." , n Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our.Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require, as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care to amend and adopt such a form/certification for use in your community.' In response.to the'request, I have caused the records at the Barnstable County Registry of Deeds to'be researched. I have also reviewed the Town of Barnstable Zoning Ordinance. Based upon my review of the results of the search of the records at the Barnstable County Registry of Deeds and the Zoning Ordinance it is my opinion that Lots 23 and 22 shown on the plan recorded in Plan Book 281, Page 73, combined, constitute a buildable lot for zoning purposes. This opinion is based upon the following: . #J 1. Lots 23 and 22 were created by a, 1973 subdivision plan recorded in the Barnstable County Registry of Deeds in Plan Book 281, Page 73 (see copy of plan attached hereto as Exhibit A and Assessor's Map 148 attached hereto as Exhibit B). 2. At the time these lots were created they were located in the Residence C Zoning District. The Residence C Zoning District required 15,000 square feet of lot area. Each of the lots met the minimum lot area requirement. 3. On May 26, 1981, James and Virginia Keramus acquired title to the property at 363 Nye Road (shown as Lot 147 on Assessor's Map 148). In 1991, Mr. and Mrs. Karamus conveyed this property to James Keramus, individually. In July of 1999, Mr. Keramus conveyed the property to himself as Trustee of the Keramus Realty Trust. Mr. Keramus, as Trustee of the Keramus Realty Trust currently hold title to the property located at 343 Nye Road. 4. On July 14, 1982, James G. Keramus, as Trustee of the James Realty Trust acquired title to the property located at 12 Meredith Way (shown on Assessor's Map 148 as Parcel 148). 5 On July 21, 1982, James G. Keramus, as Trustee of James Realty Trust, acquired title to the properties located at 361 Nye Road and 19 South Precinct Road (Lots 22 and 23). 6. At the time each of these lots was acquired by Mr. and Mrs. Keramus, the lots were buildable. 7. In 1985, the zoning lot area requirements in the Residence C zone changed increasing the lot area required for a buildable lot to one acre. 8. As a result of the 1985 zoning change, the lots owned by James Keramus as trustee merged. 9. On May 24, 2007, James G. Keramus, Trustee of James Realty Trust applied for a variance from Section 240-13(E) Bulk Regulations — Minimum Lot Area of the Zoning Ordinance to unmerge the lots located at 361 Nye Road (Lot 22) and 19 South Precinct Road (Lot 23) from the lots located at 343 Nye Road and 12 Meredith Way. 10. The hearing on the request for a variance was held on July 25, 2007. At the hearing, the Zoning Board of Appeals voted to grant the request to unmerge Lots 22 and 23 and to combine them to make one buildable (see copy of Decision and Notice in Appeal No. 2007-060 attached hereto as Exhibit C). 11. The Decision of the Zoning Board of Appeals was issued on August 17, 2007 (see Exhibit C). 12. After the twenty day appeal period expired on September 7, 2007 the Decision was recorded in the Barnstable County Registry of Deeds on September 14, 2007 in Book 22336, Page 190 (see Exhibit C). 13.Condition Number 6 in the Decision required the Applicant to exercise the relief granted within "one year form the date of issue of this variance..." 14. On August 1, 2008, James G. Keramus as Trustee of James Realty Trust executed a deed transferring title to Lots 22 and 23 to James G. Keramus, individually (see copy of the deed attached hereto as Exhibit D). 15. After executing the deed, Mr. Keramus delivered the deed to me with instructions to record the deeds. 16.The execution and delivery of the deed to a third party for recording by Mr. Keramus on August 1, 2008 completed the conveyance from Mr. Keramus as Trustee of James Realty Trust to Mr. Keramus, individually (see Earle vs. Fiske 103 Mass.491). The conveyance took place prior to the expiration of the one-year timeframe for exercise of the variance, which would have expired on August 17, 2008. 17. The deed was recorded in the Barnstable County Registry of Deeds in Book 23124, Page 104 on August 27, 2008. Although the Deed was recorded after the August 17, 2008 date for exercise of the variance, recording of the deed prior to said date was not necessary because the purpose of recording a deed is simply to give constructive notice to all others who do not have actual notice of the deed (see Earle v. Fiske 103 Mass 491 and M.G.L. c. 183 §4). 18.The conveyance of Lots 22 and 23 by James Keramus, Trustee of James Realty Trust to himself individually in reliance on the variance to put said lots into separate ownership from the lots located at 343 Nye Road and 12 Meredith Road was sufficient actin to exercise the variance (see Cornell v. Board of Appeals of Dracut 453 Mass. 888 (2009), SJC — 10307). 19.James G. Keramus, individually, has owned Lots 22 and 23 since it was deeded to him on August 1, 2008 and owns said lots as of the date of this letter. 20.James G. Keramus, Trustee of the Keramus Realty Trust has owned the property located at 343 Nye Road since it was deeded to him in 1999 and owns said property as of the date of this letter. 21.The property located at 12 Meredith Way was deeded to Maria Keramus on August 1, 2008. Maria Keramus has owned said property since it was deeded to her and owns it as of the date of this letter. 22. Neither James G. Keramus, individually or as a trustee of any trust, or Maria Keramus has an ownership interest in Lot 142 on Assessor's Map 148, the only other lot abutting Lots 22 and 23 (Lots 140 and 141 on Assessor's Map 148). Based upon the foregoing, it is my opinion that Lots 22 and 23 as shown on the plan recorded in the Barnstable County Registry of Deeds in Plan Book 281, Page 73 combined constitute a buildable lot for zoning purposes. The owner of the lots was granted a variance to combine Lots 22 and 23 as one and to unmerge them from abutting lots. The variance decision was timely recorded. The transfer of the title to Lots 22 and 23 by James G. Keramus, Trustee of the James Realty Trust to James G. Keramus, individually, in reliance on the variance was sufficient to exercise the variance and was completed within one year of the date of the issuance of the variance. This Agreement is contingent on the Buyer diligently seeking and obtaining, at his sole cost and expense, the necessary governmental permits and approvals (the"permits') for construction of a three (3)bedroom house on the property, including the following: (1) Obtaining a Title 5 septic Disposal Works Construction Permit compliant with Title 5 regulations without waivers and with Town of Barnstable Board of Health Regulations without waivers for a three(3)bedroom house; and (ii) Obtaining a Building Permit for a three (3)bedroom house; (iii) If Buyer has not obtained all permits as aforesaid with appeal periods having expired and with no appeals being filed on or before June 10,2014, then Buyer may terminate this Agreement by written notice to Seller sent on or before such date in which event any payments made under this agreement shall be forthwith refunded and all other obligations of the parties hereto shall cease and this agreement shall be void without recourse to the parties hereto.
