HOMEOWNER'S EXEMPTION a The Code states that: "Any homeowner performing work.for which a building permit is required shall be exempt from the provisions of this section(Section 109.1.1-Licensing;of construction Supervisors);provided that if the homeowner engages a person(s)for hire to do such work,that such Homeowner shall act as supervisor Many homeowners who use this exemption are unaware that;they are assuming the responsibilities-of a supervisor(see Appendix Q Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may caret amend and adopt such a form/certification for use in your community. There had been a rescue call from the Centerville-Osterville-Marstons Mills rescue team at this address. A man living in the apartment had overdosed on drugs. That this was a nice neighborhood and apartments are not allowed. I had this information confirmed. I sent a letter to Mr. Cavic on July 24, 2007 as to his choices for the illegal apartment. He did not respond. I sent a second letter August 16, 2007 and had a response from Mr. Cavic shortly thereafter. In did a site visit in August and informed Mr. Cavic just what he had to do to be eligible for the Amnesty Program. Mr. Cavic contacted the proper people at the towns Amnesty program, but failed to follow through in a timely manner and so was denied eligibility in February 2008. I that informed Mr. Cavic that he had to restore this property to a single family home. He did not respond to my letter. I once again had a complaint from the same neighbor that he now had a woman with a dog living there and enough was enough. This neighbor was irate that the town had not done anything to correct the problem. I informed him that the process took time. I next ticketed M. Cavic 7 $100.00 tickets for his violations from August 13 through September 12, 2008. I heard from a lawyer representing Mr. Cavic. We met and discussed the matter and I was told by Attorney John Kenny that he would advise his client to pay the tickets and restore the property to a single family home.
