See deed dated January 12, 2007 and recorded with the Barnstable Registry of Deeds in Book 21786, Page 343, a copy of which is enclosed herewith. This opinion is based upon the following: 1. The lots were established on a plan of land dated Apyril 9, 1976. The plan is recorded at the Barnstable County Registry of Deeds in ,Plan Book.305, Page 42. Locus is shown as Lots 29 and 30 on said`plan. Lot 29 has 0.52 acres and Lot 30 has 0.47 acres. (A copy of the plan is enclosed for your records). ri K- i John W. Lot 30, having an address of 48 Sea Marsh Road, was conveyed on June 1, 1984 from Glenn R. Wisch and Mary Beth Wisch to David W. Lambert and Margaret S. Lambert. This deed is recorded in Book 4131 Page 246. A copy of this deed is attached for your reference. 3. Lot 29, having an address of 52 Sea Marsh Road, was conveyed on May 16, 1988 from William S. Ellsworth and Nancy G. Ellsworth to David W. Lambert and Margaret S. Lambert, Trustees of the LAMBERT FAMILY NOMINEE TRUST. The deed is recorded in Book 6260, Page 341. A copy of this deed is attached for your reference. 4. On January 12, 2007, Lot 29 was deeded from the Trust to David W. Lambert and Margaret S. Lambert. This deed put the lots into common ownership. The deed is recorded in Book 21786, Page 343. A copy of this deed is attached for your reference. 5. The lots are in Residence C Zoning District and the Resource Protection Overlay District (RPOD) of the Town of Barnstable. As of October 26, 2007, the minimum lot size was 87,120 square feet. Lot 29 has 22,651 square feet. Lot 30 has 20,473 square feet. 6. In 2007, when the properties were deeded into common ownership, they merged for zoning and building purposes.
