Hyannisport, MA Assessors Map/Parcel: 246-235 Zoning: RB (Residential B District) Applicants Request: variance to section 3-1.1 (5) Bulk Regulations, Setback to permit addition of a deck on a single family dwelling to extend into required side and front yard setback areas. Procedural Provisions: Section 5-3.2 (3) : Variances Background Information: The property is located at 56 sea Meadow Circle, West Hyannisport and has 0.37 acres according to the Assessors records. The parcel contains a two story, single-family dwelling of 4,710 gross square feet with four baths and an indoor pool. Records indicate the house was build in 1991 and that the second floor remained unfinished as of January, 1993. There are two "Certified Plot Plans' for Kevin Shearer by Baxter & Nye, Inc., one dated 12/13/88 showing the dwelling structure location as meeting all setback requirements [Front -20 ft, side - 10 ft. and rear - 10 ft. ] , and a second plan dated 12/20/93 showing the addition of wood decks on the front and both sides. In that plan, the front and deck on the north side intrude into the front and side yard setbacks. The petitioner is requesting relief from the setback regulations to allow; 1. the north deck to intrude approximately 9.5 ft. into the 10 foot required side yard setback, and 2. the front deck to intrude approximately 2 ft. into the 20 foot required front yard setback. Procedural Summary: The application was filed in the offices of the Town Clerk and at the Zoning Board of Appeals office on December 27, 1993. A public hearing duly noticed under M.G.L Chapter 40-A was opened on February 23, 1994. After hearing testimony from Mr. shearer the public hearing was closed and the decision to deny the petition was decided by Board Members; Vice-Chairman Gail Nightingale, Ron Jansson, Betty Nilsson, Rob Thorne and Tom DeRiemer. r 1 Summary of Public Hearing Mr. Shearer, the applicant represented himself at the hearing, he explained that the decks were already built. He stated that he was the original builder and developer of the subdivision that created Sea Meadow Circle. He cited that his neighbor Mr. Fletcher purchased from him the adjoining lot and combined the two lots. on that area adjacent to Mr. Shearer home he built a park. Mr. Shearer cited that the decks are not detrimental to the neighborhood and is in keeping with open space and therefore does not variegate from the spirit and intent of the Zoning ordinance as it pertains to setbacks. Additionally Mr. Shearer said because of the topography, he built a stone wall and it makes sense to have the deck in the positions there are in. The Board noted that the lot is one third of an acre and that the first plot for the original house shows compliance with the setback requirement. The Board asked Mr. shearer why he built the deck so close to the lot line and if he had permission from the building inspector. He responded that he did not get permission from the building inspector and that he was planning to secure permission from his neighbor Mr. Fletcher for the decks. He further stated that he did know were the lot line was but figured that with the open space (private park) next door it would not pose a problem to intrude into the setbacks. The only problem was when he went to refinance and it was noted that the decks did not conform to zoning. The public was invited to speak. No one spoke in opposition or in favor of the petition. Finding of Facts: Based upon the evidence submitted and the testimony given at the public hearing on Appeal No 1994-15, the Zoning Board of Appeals unanimously found the following: 1. The property is just 0.37 acres and located in an RB Zone in Centerville. 2. The construction of the house began sometime in 1988 or 1989. 3. The RB Zoning District require a ten (10) foot side yard setback and a ` twenty (20 foot front yard setback) . 4. There is an intrusion by the petitioner of nine and a half (9 1/2) feet into the side yard setback by virtue of the deck that exists on the property for which relief is being sought. In addition, a front deck was also built that intruded into the front yard set set'-back by 2 feet. 5. The petitioner is a builder and developer and was aware of the sideline when the deck was created knowing it would be half a foot away from the property line. 6. In addition to this, the petitioner knew or should have had known of the requirements for adding a structure to his house. He failed to comply with those requirements and he failed to obtain appropriate permitting from the building inspector of this town. 2 7. The lot involved in not unique in that it is rectangular. 8. There has been no evidence submitted to justify those conditions of Chapter 40A Section 10 permitting the granting of relief. 9. Granting of this relief in this case would be in derogation of the spirit and intent of the zoning ordinance. The purposes and intents of the zoning are to eliminate congestion and confusion in residential areas in the Town of Barnstable. Conclusion: Accordingly, based upon the findings, a motion was duly made and seconded that Appeal No. 1994-15 for a variance be denied. Background Information: ' The property -is located at 56 Sea Meadow Circle four lots north ofrCraigville- Beach Road in W., iyannisport (Centerville for Mailing Address 02632) and has 0.37 acres according to the Assessors records. The parcel contains a two story, contemporary single family dwelling of 4,710 gross square feet (GFA) with four baths and an indoor pool. Records indicate the house was build in 1991 and had an unfinished 2nd floor in January, 1993. There are two "Certified Plot Plans" for Kevin Shearer by Baxter .& Nye, Inc., one dated 12/13/88 showing.-the dwelling structure location as meeting all . setback requirements [Front -20 ft, side - 10 ft. and rear - 10 ft:], and a second plan dated .12/20/93 showing the addition of wood decks .on the front.and both sides,, two of which extend into the setback requirement (Front an " left/north side yard) . Staff Report - Appeal No - 1994-15 variance - Setback Requirement: Shearer The petitioner is requesting relief from'the setback regulations to allow the construction of the north deck approximately 9.5 ft, into the 10.0 ft, required side yard setback. In addition, relief should be requested for the existing front deck which extends approximately 2 ft.' into the front yard setback requirement of 20 ft. DEPARTMENT COMMENTS: 1. Section 5-3.2 (3) of the Zoning ordinance and section 10 of Mass. General Laws (MGL) Chapter 40-A require that the Board- be provided with facts which justify the granting of the relief sought. The petitioner should be prepared to present the circumstances relating to soil, shape, or topography which justifies the granting of this relief and should also be prepared to substantiate that the granting of the relief will not be in detriment to the neighborhood nor derogate the intent of the Zoning Ordinance. 2. The Applicant should be prepared to address before the Board the following: a. The circumstances leading to the construction of the existing front deck. Any building permit documentation should be provided. . b. Explanation of the note "park" on the adjacent lot to the north. The lot is privately owned. Any documentation of an agreement with the adjacent property owner for an easement or area permanently set aside for a landscaped buffer should be presented. c. Photographs of the :existing front area and deck, and the adjacent landscaped "Park" area may be helpful. - 3. other material that may be relevant: a. Letters of support from abutters and neighbors. SUGGESTED CONSIDERATIONS: If the Board should find to grant this request for a Variance, it may consider the following suggested conditions: 1.
