Good luck with this one: According to the information in the Assessor's record, it looks like there definitely are two living units and perhaps 3 on this property. The 1968 Main House and the 1950 Cottage structure located at the water's edge came into today's purported single lot in 1968 (Plan Recorded Plan Book 223 page 105). This created two dwellings on one lot not in conformity to zoning and perhaps constitutes a continuation of a pre-existing nonconforming use. ■ The Main House lot is on a 57,100 sq.ft. lot and the Cottage structure is on a 5,000 sq.ft. lot. According to the note on the AN plan these two lots were to be used as one. ■ The 1968 plan did not show the existence of today's purported second detached Cottage structures located to the north-west of the Main House. It appears that structure dates to 1970 and according to the Assessor's record, today it also has a 1 bedroom with a living area of 336 sq.ft. The structures shows up on the 1980's Plan (recorded plan book 346 page 77). In this plan it is labeled "GAR." (Garage). In 1980, another Lot 2 was merged into the parcel (as shown on plan recorded Plan Book 346 page 77). That lot was 20,256 sq.ft. and at that time would have constituted an independent buildable lot under the RID-1 zoning in effect at that time. This Lot 2 abuts the 5,000 sq.ft. lot that holds the 1950 Cottage structure. The 2-acre overlay district came into effect on November 2000 and grandfathered pre-existing legally created lots. In 2001 another land division was implemented (Plan Book 570 page 40). That division reports to transferred Lot 2A(a lot of 10,003 sq.ft.) into the subject property. The Building file shows a 2007 inquire made to your office (apparently for the transfer of the property) concerning the legality of a detached unit(which unit— I do not know). I found no determination issued. In 2007 the lands were transferred to the present owners. That deed cites the transfer of three separate parcels on it. In 2008, a 48-foot long pier was permitted off the Main House. That pier is not shown or referenced in this application. My questions/concerns are: ■ This is a three family use? ■ Is this a legal pre-existing nonconforming two family use? ■ Are there two legal developed lots here?And if so should they be taxed as such?
