Roof slope is 12 in 12.This is greater than 3 in 12, therefore a minimum of lx6 collar ties are required 48" o.c. (rafters are 16" o.c.) Ties are to be located in the upper third of the height of the roof measured from the sill plate to the ridge. This is in accordance with the MASS State Building Code 3608.2.3.2. Lot 2 falls just short of one (1) acre as it is 40,175 square feet in area; S. as outlined above, however, Lot 2 was held in separate ownership as of February 1, 1985; specifically, the Hurley lot was owned by the Hurleys (see Exhibit A), Lot 1 was owned by the Hinckleys (see Exhibit G) and the "Lester Lot"was owned by Laurence and Sybil Lester(see Exhibit I); t. accordingly, by virtue of Massachusetts General Laws, Chapter 40A, Section 6, and by virtue of the Barnstable Zoning Ordinance, §4-4.2(1), because Lot 2 was held in separate ownership and met the zoning requirements in effect prior to the passage of the zoning amendment, it was protected or"grand-fathered" from the zoning change increasing the minimum lot size in the RC and RD-1 Districts to one (1) acre; U. on November 26, 2000, the new Resource Protection Overlay District Zoning Ordinance became effective, raising the minimum lot size again to two (2) acres; V. §4-4.2(6) of that Ordinance, however,provides an exemption from the two (2) acre requirement for all lots that were otherwise protected from the applicable bulk requirements of the Zoning Ordinance as of November 26, 2000; W. specifically, §4-4.2(6) states that any increase in area under the Resource Protection Overlay District shall not apply to a lot for single family residential use provided that, immediately prior to November 26, 2000, the lot was protected from the applicable bulk requirements of the Zoning Ordinance by the provisions of Section 4-4.2 (1), (2), (3), (4) or(5); X.
