Background: According to the Assessor's Records lot 020,a vacant corner lot containing 0.23 acres,is located at the intersection of Hillside Drive and Shootflying Hill Road.Parcel 019,abutting lot 020 to the north is also owned by the applicant and which contains her current home,built in 1960 on 0.23 acres.The petitioner has owned both lots since 1976.Gas service and public water are available. Procedural Summary: Filed with Town Hall and Zoning Board of Appeals on June 27, 1994 and scheduled for hearing on August 3, 1994. Board members sitting on this appeal are:R.Thorne,R.Boy,E. Glynn,D.Bliss and Chairman G.Nightingale. Attorney Wm.Beard representing the applicant informed the Board that Mrs.Bolinder is a widow and had placed the two lots at issue into a trust to avoid probate.. Now she would like to separate the lots and sell one due to financial hardship. The variance requested would be for both lots as they are both undersized in square footage and one also is undersized in minimum lot width. Both lots would be comparable to neighboring lots. A uniqueness exists on lot one due to road frontage on three sides as Hillside Drive wraps around the subject parcel. If a home were to be built on this property,access would be on Hillside Drive as Shootflying Hill Road has too much traffic. Little to no more traffic would be created by this variance. f Decision and Notice:Appeal No.: 1994-68-Bolinder Variance-Minimum Lot Area,Minimum Width Attorney Beard continued to say at the time of the original purchase the Bolinders were unaware they needed to have the lots in separate names for zoning purposes. The lot has been accessed by the tax office at a buildable rate the entire duration of ownership by the Bolinders. Mrs.Bolinder now needs the money to maintain her home on the adjacent lot. E. Glynn said he visited the lot and Mrs.Bolinder's home is only about 940 square feet. Attorney Beard agreed saying it is a small cottage. Then E. Glynn asked if Mrs.Bolinder plans to develop the lot or just sell it as a buildable. Attorney Beard said she would like to sell it as a buildable lot. The builders would have to get the appropriate permits. No perk test has been done. D.Bliss said because it is a little lower in topography than the other lots in the neighborhood that it appeared to serve as a drainage area for the neighborhood. Attorney Beard said it would be the responsibility of the builder to get perk tests and appropriate permits. Public comment was invited and none was forthcoming. However, Chairman Nightingale pointed out two telephone call notes in the file from abutting neighbors Anthony Ventuguso and Shirley Silvia both opposed. Attorney Beard had rebuttal time in which he stated that a small home maintained on this lot would be better than the vacant lot that now exists. FINDINGS: 1. Any house built should be limited to one thousand square feet in size. 2.Access to the house shall be from Hillside Drive only and not off Shootflying Hill Road. 3. The petitioner owns both lots(19 and 20)with her house on lot 19. 4.Lot 20 is unique to the neighborhood as it has road frontage on three sides. 5. Variance conditions comply with section 10 of M.G.L. Chapter 40A VOTE: AYE: R Thorne,E. Glynn,R Boy and Chairman G.Nightingale NAY: D.Bliss Conclusion: A motion was made by E. Glynn and seconded by R Thorne that based on the affirmative findings of this Board,a request for variance in appeal number 1994-68 has been granted with the following conditions: 1. The total area of a house built on lot 20 will be one thousand square feet or less. 2. Access to the house shall be from Hillside Drive only and not from Shootflying Hill Road. 3. A suitable perk test must be done before building. 4. The relief requested can be granted without substantial detriment to the neighborhood and is within the spirit and intent of the zoning ordinances. VOTE.- AYE: E. The petitioner has owned the lot for over ten years along with her residence on the next lot. She has received separate tax bills and was under the impression that she did have a buildable lot. After researching the changes in the zoning districts, it was determined that this was actually only one lot in 1966. The petitioner has not presented any variance conditions exist at the site. Dexter Bliss made a motion to deny the relief sought, based on the lack of Variance conditions, as required under Section 10, Chapter 40A, M.G.L. -- Gail Nightingale seconded the motion.
