Bayside Building Company, Inc. proposes to construct a single-family dwelling on Lot 6. This lot, originally consisted of Lots 13 & 14, and a private way. Although the lots when combined had sufficient acreage to satisfy the 1964 zoning, they lacked adequate street frontage which at the time required 100 linear feet. On April 16, 1965 an application for a variance was filed in the Barnstable ZBA and a hearing was conducted on May 6, 1965. The variance was allowed on May 28, 1965. It permitted a modification, of ,the zoning law to allow less than the ,required frontage for the Lot in question. Thereafter, on October 25, 1965, a subdivision plan was submitted and endorsed as approval not required under the subdivision law by the Town of Barnstable Planning Board. After the variance was approved, the lot was transferred into single lot ownership by conveying to James Driscoll Individually on September 23, 1969 at Book 1450 Page 039. The subdivision plan is recorded in the Barnstable Registry of . Deeds at Plan Book 198 Page 49. As I pointed out in the previous opinion, the assessors map shows lots 13 & 14 and lots 11 and 12 and the adjoining private was .as a single lot. This is inaccurate as lots 11 & 12 have always been held in separate ownership since 1968. Lot 6 is located in an RD-1 district which requires 43,560 square feet of acreage with minimum frontage of 20 feet andia width 125 feet with front and side yard requirement for front, side and rear yard set backs of 30, 15, and 15 respectively. The zoning lot is afforded protection by MGL Chapter 40A Section 6 as any increase in area of a lot for single family use which at the time of the of endorsement was not held in common ownership with any adjoining land, and conformed to the then existing requirements and had less than 5, 000 square feet and 50 linear feet of frontage is entitled to the single lot exemption of this statute. In addition, the lot is non-conforming under Chapter III, Article III, Section 4-4.5 of the Town of Barnstable Zoning By Law, as the lot, complied with the then existing zoning law in 1968 and while building on such lot was permitted, it was held in separate ownership.
