The property consists of a 0.18 acre lot commonly addressed as 140 Short Beach Road, Centerville. It is
improved with a one and a.half story single-family residence with a living area of approximately 1,744 sq.
ft., according to assessor's.records dated 12/14/99. The property is located in an RD-1 Residential
Zoning District which requires a minimum 30' front yard, and 10' side and rear yard setbacks.
The existing dwelling is currently nonconforming with respect to the minimum required 30 foot front yard
setback, being situated approximately 19 feet from the front property line off Short Beach Road. The
petitioner is proposing to construct a 6' x 33' porch addition (198 sq. ft.)to the front of the existing
residence; which will encroach an additional 6 feet into the minimum required front yard. ,
The petitioner is applying for a Special Permit pursuant to Section 4-4.3(2) Nonconforming Buildings or
Structures Used as Single and Two-Family Residences, to permit the proposed addition to be located
approximately 13 feet from the front property line.
Procedural Summary:
This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on
November 5, 1999. A public hearing before the Zoning Board of Appeals was duly advertised and notices
sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened January 5, 2000,
continued to February 16, 2000 and March 15, 2000, at which time the applicant requested and the Board
granted a withdrawal without prejudice.
Hearing Summary:
Board Members hearing this appeal were Gail Nightingale, Ron Jansson, Gene Burman, Tom DeRiemer,
and Chairman Emmett Glynn. Francis Mulligan, builder, represented the applicants/owners, Steve and
Jane Woelfel. Steve Woelfel was present.
Mr. Mulligan stated the applicant is seeking permission for a porch addition that will encroach on the front
yard setback. He stated that it is a small encroachment and is needed for aesthetic reasons. The house
is currently nonconforming as it is only 19 feet from the setback where 30 feet is required.

The Board asked the applicant to establish the legality of the nonconforming frontyard setback because,
according to the records presented, the house was built in 1960 and in 1958 the property was rezoned to
its current RD-1 Zoning District. That zoning change (in 1958) increased the minimum front yard setback
from 20 to 30 feet. Therefore, the applicant must establish when the house was built in order to establish
the house is-in fact-legally nonconforming. If the house was built in 1960, it is not legally
nonconforming with regard to.setbacks. If he can not establish a legal nonconforming setback then the
proper request would be a Variance-not a Special Permit.
The applicant requested a continuance to allow him time to gather the information. The appeal was
continued to February 16, 2000.
At the start of the continuance, Chairman Emmett Glynn read a letter from Stephen E. Woelfel, received
February 10, 2000, which states "I would like to request a continuation on this hearing so that we may be
able to have sufficient information to present to your Board." Upon the request of the applicant, this
appeal was continued to March 15, 2000.
At the March 15, 2000 continuance of the hearing, Chairman Emmett Glynn read a letter from Stephen E.
Woelfel, dated March 10,2000, which states "I am requesting my application be withdrawn without
prejudice. We are still researching several pertinent issues."
Motion:
Per request of the applicant, a motion was duly made and seconded to allow Appeal Number.2000-01 to
be Withdrawn Without Prejudice.

The petitioner is applying for a Special Permit pursuant to Section 4-4.3(2) Nonconforming Buildings or
Structures Used as Single and Two-Family Residences, to permit the proposed addition to be located
approximately 13 feet from the front property line.
Staff Review:
The proposed porch consists of a raised deck with railings and an asphalt shingled roof. The site is
surrounded by single-family residences on all sides. It appears from the submitted plot plan that the
houses to the east and west are setback about the same distance as or slightly further than the subject
dwelling. The proposed porch would be out of character with the other residences in the immediate
vicinity.
According to assessor's records, the dwelling was constructed around 1960. At that time, the property
was zoned,as it is today (RD-1)with a minimum front yard setback requirement of 30 feet. Setbacks were
first established in 1950 when this area of town was zoned RA which had a minimum front yard setback.
requirement of 20 feet. The 1956 comprehensive rezoning of the town rezoned the property to an RB-1
Zoning District which also had a minimum front yard setback requirement of 20 feet. Finally, in 1958, the

Special Permit, Section 4-4.3(2)Expansion of a pre-existing nonconforming residence
property was rezoned to an RD-1 District. It was the 1958 rezoning that increased the minimum front yard
setback from 20 to 30 feet.
Staff suggests the applicant be prepared to address the legality of the nonconforming status of the
existing dwelling. Assessor's records are not always accurate with respect to the year built. To be a legal
pre-existing nonconforming building, the dwelling would have to.pre=date the 1950 zoning because the
house is only setback approximately 19 feet from the front property line. There is no building permit on
file with the Building Division for the original construction of this dwelling.
Special Permit Requirements:
For the alteration or expansion of a pre-existing nonconforming building used as a single-family
residence, the Board must find that the proposed expansion and/or alterations are not substantially more
detrimental to the neighborhood than the existing building.
The standards for granting a Special Permit also require the following findings of fact to be made by the
Board (Section 5-3.3(2)):
• that the application falls within a category specifically excepted in the ordinance for a grant of a
Special Permit, (the expansion and/or alteration of a nonconforming'building used as single and two-
family residences is allowed by a Special Permit Pursuantto'Section 4-4.3(2)of the Zoning
Ordinance),
• that after evaluation of all the evidence presented, the-proposal fulfills the spirit and intent of the
Zoning Ordinance and would not represent a substantial detriinent"to the public good"or the-
neighborhood affected.'
Suggested Conditions:
If the Board should find to grant the requested Special Permit, they may wist;to consider the following
conditions:
1. The proposed addition shall be constructed in accordance with the submitted plans, copies of which
,are in the file, titled"Entryway/Livingroom renovations for Steve and Jane Woelfel".
2. The proposed addition shall be located no closer than 12.9 feet to the front property line off Short
Beach Road.
3. The locus shall comply with all State Building Code, Town of Barnstable Board of Health and State
Fire Prevention Regulations.

Information and Instructions
Massachusetts General Laws chapter 152 section 25 requires all employers to provide workers' compensation for their
employees. As quoted from the "law", an employee is defined as every person in the service of another under,any coatr�-
of hire, express or implied, oral or written.
An employer is defined as an individual, partnership, association, corporation or other legal entity, or any two or more of
the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer, or the receive:
trustee of an individual, partnership, association or other legal entity, employing employees. However the owner of a
dwelling house having not more than three apartments and who resides therein, or the occupant of the dwelling house of
another who employs persons to do maintenance , construction or repair work on such dwelling house or on the grounds or
building appurtenant thereto shall not because of such employment be deemed to be an employer.
MGL chapter 152 section 25 also states that every state or local licensing agency shall withhold the issuance or renews:
of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has
not produced acceptable evidence of compliance with the insurance coverage required. Additionally,neither.the .
commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until
acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracdng
authority. ,

supplying company names, address and phone numbers along with a certificate of insurance as all affidavits may be
submitted to the Department of Industrial Accidents for confirmation of insiumcc coverage. Also be sure to sign and
date the affidavit. The affidavit should be returned to the city or town that the application for the permit or license is
being requested, not the Department of Industrial Accidents. Should you have any questions regarding the"law"or if you
are required to obtain a workers' compensation policy,please call the Department at the number listed below.
