We have had time to inspect the subject property and review the nature of the complaint. The bottom line is that there is a property dispute between two parties regarding a subdivision road called Adrena Avenue that was never developed (paved) when the original subdivision was created. I checked with engineering,they have.definitively confirmed that the road in question is not Town owned which means that it is privately held. The result is that the Town has no jurisdiction to compel a change in behavior and that any resolution must be made either by agreement between individuals with rights to the road or through the civil process (court). I did speak with the property owner who was the subject of the complaint. He was congenial and indicated that he was having trouble with a neighbor. He indicated that he simply wanted to put up a fence to avoid further contact with the neighbor. He agreed to have a surveyor stake out his property line and put the fence on that line only. He did ask if there was some way for him and his neighbor each to "claim" half of Adrena Avenue. I explained that he would need to contact a land use attorney and I gave him the telephone number for the Barnstable County Bar Association which has a referral service. I doubt he will pursue the matter but it may be in the best interest of both parties to look into having the road rescinded since it appears to be an orphaned piece of land and it may help to resolve their problem. I will close this file in our system at this point. If the neighbor is not satisfied after speaking with you directly please have them contact me... there is not much I can do but if it helps for him to hear from me l am happy to have the discussion. The other day a resident notified me of his concern about another neighbor perhaps encroaching on Town-owned property believed to be a right of way for perhaps some future purpose. The house i w at 102 Strawberry Hill Road sits adjacent to the Town property and perhaps is squaring off his property in the backyard that is on Patricia Street. They apparently had some agreement concerning the front yard driveway but now the reporting neighbor is concerned that they are claiming Town property for their own use. In any event,I thought it best to notify you. This is not an emergency but I told the reporting neighbor I would let-you know. thank you for the magnificent job you are doing. Have a great summer.
