Bulk Variance 2000-63 was issued to the lot to permit construction of a single-family dwelling not in conformance with the required setbacks for the district. A foundation has been installed on the lot and it was discovered that a bulkhead was added to the footprint that was not delineated on the plans submitted and approved by the Board. The bulkhead infringes into the required 10 foot side setback approximately 5.8 feet. The applicant is requesting the Board modify the approved variance to allow the bulkhead to remain. Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on January 03 2001. An extension of time for holding the hearing and for filing of the decision was executed between the applicants and the Board. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened February 21, 2001, at which time the Board granted the variance requested with one additional condition. At the opening of the hearing,Vice Chairman, Gail Nightingale cited that there were only four members present to hear the appeal. She cautioned the applicant that with only four members a unanimous vote is needed to granted the relief sought. The applicant agreed to go forward with the four member Board. Board Members hearing this appeal were; Tom DeRiemer. Randolph Childs, Jeremy Gilmore and Gail Nightingale,Vice Chairman. The applicant represented himself at the hearing. Mr. Vegas explained that during the pouring of the fpundation,the contractor asked if he wanted a bulkhead opening into the basement. Mr. Vegas responded yes. He did not realize that most bullheads are placed to the rear of the home, where the contractor proceeded to install the foundation for the bulkhead. He noted also that this parcel, being a triangular lot,has two front yards. The contractor thought that locating the bulkhead on either of those two sides would place it in the front yard. A less desirable location. After the foundation was poured it became apparent that it intruded into the required 10 foot setback. The public was invited to speak and no one spoke in favor or in opposition to this variance. Findings of Fact: At the hearing of February 21, 2001,the Board unanimously found the following findings of fact: 1. In Appeal 2001-15,the applicants are Thomas L. and Donna M. Vegas. The location is 299 Old Craigville Road, Hyannis, MA, as shown on Assessor's Map 247 as Parcel 105. It is a 0.14 acre lot, zoned Residential B and GP -Groundwater Protection District 2. In this appeal,the applicants are seeking a modification of previously issued Bulk Variance Number 2000-63. 3. During construction of the foundation for the dwelling authorized under Variance 2000-63,the bulkhead to the basement was located so as to further encroach into the setback imposed. 4. As previously found,unique conditions do exist that affect the locus. 5. In this instance, with reference to the bulkhead,the provisions of the Zoning Ordinance would involve substantial financial hardship if the applicant-had to remove the bulkhead. 6. The relief requested may be granted without substantial detriment to the public good. 7. There was no abutters objection to this small infringement of the bulkhead into the required setback area. Decision: Based on the positive findings of fact,a motion was duly made and seconded to grant the applicants request for a variance, subject to all conditions of the previous variance 2000-63 remain in effect. and the following condition also imposed. There shall be no additional footprint added to this dwelling than that shown on the approved plan without permission from this board. The vote was as follows: AYE: Tom DeRiemer. Variance Findings: In consideration for the Variance,the applicant must substantiate those conditions unique to this lot that justify the granting of the relief being sought. In granting of the Variance the Board must find that: • unique conditions exist that affect the locus but not the zoning district in which it is located, • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Suggested Conditions: If the Board should find to grant the requested Variances, they may wish to consider the following conditions: 1. There shall be no more than a two bedroom single family dwelling and its accessory uses developed on this lot. 2. Wastewater disposal shall conform to all Board of Health requirement. The applicant is seeking a bulk variance from the required front yard setback of 20 feet to permit a two bedroom single family dwelling to be built 15 feet off of Old Crageville Road and 19 feet off of Strawberry Hill Road. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on June 06, 2000. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on July 19, 2000, and continued to August 30, 2000 at which time the Board granted the Variance. Hearing Summary: Board Members hearing these appeals were Richard Boy, Gene Burman, Ralph Copeland, Dan Creedon and Vice Chairman Gail Nightingale. Tom DeRiemer was selected as an Alternate Member. Tom Vegas introduced himself as the petitioner, and explained how the Town of Barnstable took a portion of his property to redefine the corner of Strawberry Hill Rd and Old Craigville Rd. The property was formerly owned by his mother, and the property was transferred to him about thirty years age. It is his intention to construct a home on the parcel transferred to him by his mother. Due to the configuration of the lot(triangular)in shape, he is unable to construct without encroaching on both sidelines. The board discussed if it was possible to locate the house in a different manner on the lot. The board suggested that they explore setting the building further back on the property to maintain the 20 foot setback on both sides. The Hearing was continued to August 30, 2000 At.the August 30,2000, continuance Board members hearing the appeal were, Tom DeRiemer, Gene Burman, Dick Boy, Dan Creedon and Vice Chairman Gail Nightingale At the August 30, 2000 continuance, Ralph Copeland was absent and Tom DeRiemer replacement him. Mrs.Vegas submitted 5 viable plan options to the Board. She stated that Option 1 was the preferred plan. The Board discussed the various plans with Mrs.Vegas and they determined that Option 1 was acceptable and was approved as submitted. Although some of the other options complied with the front yard setbacks the Board found those options objectionable because it pushed the structure too close to the rear property line. The lot is 0.14 acres and is in an RB Residential B Zoning District and GP Groundwater Protection Overlay District • The applicants are seeking relief of the Zoning Ordinance, pursuant to Section 3-1.1(5), Bulk Regulations to construct a single family home. • The taking of land by the Town of Barnstable reduced the buildable lot size • The applicant has addressed the question of the lot being merged, and the Board has determined that the lots have not been merged. The Variance from the 20 foot setback would cause a 6.5 foot shortage of the required frontage. • unique conditions exist that affect the locus but not the zoning district in which it is located. • a literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise to the petitioner, and • the relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance.
