The petitioner has provided a Plan of Land in Centerville(Barnstable).Mass.,Prepared for Audrey Cappiello by Demarest-Mclellen Engineering,West Dennis.MA, Dated August 10, 1994.which establishes the lot area as 8,168 sq.ft. (0.19 acres). The surveyed lot frontage is 59.36 feet. Also provided is a copy of the plan prepared for approval by the Boafd of Health and titled, "Proposed Plot Plan for Phil Curran,Parcel B,"431 Strawberry Hill road. Centerville"by Stanley R. Sweetser,Inc.,DennigNrt,MA,dated May 2. 1994,last revised October 13, 1994,showing the building plot and septic system layout for a three bedroom dwelling. The Zoning Overlay District is GP-Groundwater Protection District. 'Procedural Summary: ' This appeal was filed with the Town Clerk and with the Zoning Board of Appeals office on October 14, 1994, and a public hearing duly notice was held on November 30, 1994 at which time a decision to grant the request with conditions was rendered by the Board. Sitting on this appeal are Board Members: Ron Jansson,Richard Boy,Emmett Glynn,Dexter Bliss and Chairman Gail Nightingale. r Wayne.Mathews,Attorney from Brockton representing the petitioner,explained that since 1947 when the lot was purchased by Isabeli rartriano it had been shown as being 9,180 sq.ft. Mrs.Partriano gave t.r.lot io her niece in 1993 and she subsequently agreed to sell it. The future purchases secured a foundation permit and µ during the process of development it was discovered that a discrepancy existed in the size of the lot. It came to light that in 1967 Strawberry Hill was the subject of a taking by town which reduced this lot down to 8,168 square feet Discussions with the Building Commissioner revealed that because of the taking we do not qualify for a grandfathered lot-the original.grandfatehercd lot had been changed. Given this information,the Building Commissioner determined that the Building Permit was not valid and the applicant would need a variance from the minimum lot areas requirements of zoning. Public comment was requested. Edward Coomb,an abutter was opposed,noting that the 0.20 acre lot is smallest lot in area. He stated that this small lot would have difficulty to place a house on it without detraction from the neighborhood. John Akins and Linda Faxon abutters to the north agreed with Mr. Coomb. Zane and' Zoning Board of Appeals t_ Decision and Notice Appeal Number 1994-107 Rusty Rodrigues spoke about their concern about the land itself which had a substantial depression and did not pass a perk-test in the past but does now. Concern included the displacement of water or the existence of a vernal spring in the area. Henry Lyons has the lot in back facing Elliot St. and is in agreement with neighbors. The Board stated that according to the proposed plot plan in the file by Stanley Sweetser,Inc.,observation holes had been taken and they did not encounter water in the first 12 feet and the perk-test passed the requirements for Title V. The Board also noted that only relief necessary was from minimum lot area. FINDINGS: In Appeal Number 1994-107,the Board unanimously found the following findings of facts: 1. Testimony has been given that the lot has been continuously taxed as a buildable lot. 2. The lot was laid out prior to the implementation of zoning and since that implementation has always been a non-conforming lot and it did not exceed 10,000 square feet. 3. The lot exceeds the requirement for a buildable lot of Chapter 40A of the M.G.L. which is 7,500 square feet and therefore by State Law should be considered a buildable lot. 4. The frontage on Strawberry Hill Road exceeds the requirements of the Town of Barnstable Zoning Ordinance for frontage. 5. _ The intent of the Town of Barnstable Zoning Ordinance when established,regarding the increasingly large lots,was never to be confiscatory and to taking land by making it unbuildable. . 6. In all likelihood it was not the intent of the Town of Barnstable when it made the taking to improve Strawberry Hill Road to make the lot unbuildable. 7. There would be substantial financial hardship to the applicant should the applicant not be able to utilize the lot for its intended purpose which is a building lot. DECISION: Based on the positive findings of the Board a motion was made by Dexter Bliss and seconded by Emmett Glynn to grant relief from the minimum lot area subject to the following conditions: 1. The lot be built upon as per plan submitted to this Board. 2. The septic system shall comply with Board of Health requirements as well as Title 5 requirements. 3.
