A public hearing before the Zoning Board of Appeals was duly advertised and notice. sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on Town of Barnstable Zoning Board of Appeals—Decision and Notice Special Permit No.2018-028—Deyton et al May 9, 2018 at which time the Board found to grant the special permit subject to conditions. Board Members deciding this application were Alex Rodolakis, David A. Hirsch, Herbert Bodensiek, Jacob Dewey and Kyle Evancoe. Attorney Jean Kampas from Nutter, McClenn_en & Fish presented the application. Also present was Mr. Deyton. Attorney Kampas described the dwelling as a pre-existing nonconforming dwelling as it was constructed in 1930 as was most dwellings in the area. She stated the Applicants are seeking to expand the deck 22 or 23 square feet which would be 8.7 feet from the setback where 15 feet is required. Attorney Kampas reviewed the DCPC regulations. The Board Chair requested public comment and Jim Lane of 86 Summerbell Avenue and President of the Christian Camp Meeting Association, urged the Board to vote in favor as the expansion is minor. Reverend Joanne Hartunian, who also submitted a letter, spoke in support of the expansion of the deck. Findings of Fact At the hearing on May 9, 2018, the Board unanimously made the following findings of fact for Application No. 2018-028, a request for a special permit to expand an existing deck approximately 22 or 23 square feet that will not conform to the applicable front yard setback: 1. The application falls within a category specifically excepted in the ordinance for a grant of a special permit. Section 240-131.4(D)(2) allows for an alteration of an existing lawfully established structure in existence as of January 19, 2011 with a special permit from the Board. 2. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. 3. The proposed alteration/expansions are not substantially' more detrimental to the environment, community and/or historic character of the neighborhood than the existing building or-structure. 4. The proposed alteration contributes to and respects the character and historic development patterns of the area and minimizes inconsistent redevelopment impacts to the historic and community character resources in this area: 5. The proposed alteration protects and preserves scenic views and vistas and ways to the water. 6.. -The-proposed alteration.protects and improves natural resources,.-including but-not-limited-to the barrier beach and groundwater and coastal water quality and minimizes development and redevelopment impacts to the natural resources and ecosystems in this district. 7.
