Re: Lot 16 Hillside Drive, Centerville, MA (Plan Book 386, Pages 27-28) Dear Mr. Crossen: I have been asked to render an opinion relative to the record title of the above-referenced premises which appear to be a non-conforming lot which fails to meet the current gross land area requirements of the Town of Barnstable Zoning Ordinance. On June 24, 1986, the Land Court in Boston determined that as of November 4, 1982, at 10:00am, R. Arthur Williams and Betty L. Williams, husband and wife, were the owners of fee title to a large tract of land known as Lot 2 on a Plan recorded in the Barnstable County Registry of Deeds in Book 419, Page 46. Lot 16 was created pursuant to a subdivision process which commenced on September 23, 1983, with a preliminary Subdivision Plan being filed with the Town of Barnstable Planning Board. On June 2, 1984, a definitive Plan was created by the surveyor and on June 18, 1984, the Planning Board of the Town of Barnstable voted to approve the Subdivision Plan which was subsequently recorded in the Barnstable County Registry of Deeds in Book 386, Pages 27-28. On July 30, 1984,the Town of Barnstable Planning Board endorsed the Subdivision Plan and, as indicated, it was recorded on August 17, 1984, in Book 386, Pages 27-28. A Road/Development Covenant was entered into between R.Arthur and Betty L.Williams and the Town of Barnstable Planning Board and it was recorded on July 20, 1984,in Book 4218,Page 29. On November 21, 1984, a full Discharge and Release of the Road Covenant was recorded in Book 4325, Page 240. On February 28, 1985,the Town of Barnstable voted to increase the lot size requirements for the RC Zoning District in which the premises lie and the lot size was increased to a minimum one acre. Lot 16 is bounded on the northwest by two lots in the adjacent subdivision, Lots 20 and 21 on a Plan recorded in the Barnstable County Registry of Deeds in Book 277, Page 98. The land in the adjacent subdivision was the subject of a separate confirmation proceeding in the Land Court and this subdivision was owned in its entirety by Charles F. Stanley and Joan C. Stanley. This property was the subject of a separate Subdivision Plan dated August 21, 1973,which appears to have been recorded I Ralph Crossen August 10, 2000 Page 2 on or about November 21, 1973. So far as appears from my examination of record title,neither of the lots in the adjacent subdivision is ever owned coincidentally by an owner of Lot 16 at any point in the chain of title. On June 10, 1986,Lot 18 was conveyed out to Daniel D.Dodge,et ux.,and so far as it appears of record, it has never come back into the chain of title. On July 23, 1986,Lot 17 was conveyed out to William F.Nicholas, et ux., and no subsequent conveyance brings it back into the Williams chain of title. On December 15, 1987, Lot 15 was conveyed to Kirk David Williams for a stated consideration of$60,000. My examination of record title indicates that no conveyance has occurred transferring record title of Lot 16 from the original owners, R. Arthur Williams and Betty L. Williams, into any third party. However, R. Arthur Williams deceased within the recent past and his widow, Betty L. Williams, now remains as the sole owner of Lot 16. The lot adjacent to Lot 16 lying immediately to the west is Lot 21 as shown on a subdivision plan prepared for Chuck Stanley,dated August 21, 1973,approved by the Planning Board on October 16, 1973,and recorded in the Barnstable County Registry of Deeds on October 21, 1973,in Plan Book 277, Page 98. The Stanleys acquired title to Lot 21, and the entirety of the property comprising the subdivision referred to in the preceding paragraph by deed from Evelyn Crosby, et al., dated September 4, 1973,and recorded in Book 1928,Page 008,of the Barnstable County Registry of Deeds (copy enclosed). The Stanleys retained ownership of Lot 21 until July 12, 1982;when they conveyed it to J.P. Breen Co., Inc., by deed recorded in Book 3516, Page 12. The subdivision plan of the Williams property identifies the abutting land owner to the west as the J.P. Breen Co., Inc. (copy enclosed). Breen conveyed Lot 21 to Mark L. Scibelli and Anthony S. Scibelli by deed dated November 9, 1983, and recorded in Book 3924, Page 173 (copy,enclosed). Anthony S. Scibelli conveyed his interest iri Lot'21 to Mark L. Scibelli by deed dated September 29, 1986, and recorded October 21, 1986, in Book 5360, Page 088 (copy enclosed), and Mark L. Scibelli appears of record to be the current owner. I enclose herewith for your information copies of the pertinent Deeds pertaining to conveyances out of the Williamses of Lots 15 (to Kirk David Williams,recorded in Book 6212,Page 139), Lot.17 (to William F. Nicholas, recorded in Book 5206, Page 179; and from William F. Ralph Crossen August 10, 2000 , Page 3 , Nicholas, et al., to Walter P. Christian, et al., which was recorded on October 14, 1998, in Book 11760, Page 206; and finally, the Deed from R. Arthur Williams, et ux., to Daniel D. Dodge, dated June 10, 1986, and recorded in Book 5126, Page 282). I am of the opinion that all lots surrounding Lot 16 were conveyed out during the eight-year grandfather period which commenced with the Plan endorsement on July 30, 1984. I have enclosed a photostat of a reduced copy of the Subdivision Plan for your reference with the Deeds.
