The Applicant requested a Special Permit in order to construct an accessory structure, a garage approximately 24 feet by 60 feet, on an adjoining lot on.which the principal structure and use it serves. The properties are located at 111 Putnam Avenue and 55 Putnam Avenue, Cotuit, MA as shown on Assessor's Map 036 as Parcels 041-002 and 045. They are located in the Residence F (RF)Zoning District. The Applicant owns the parcel addressed as 111 Putnam Avenue and 55 Putnam Avenue but there are two distinct lots. Both lots (Parcel 041-002 and 045)are held through separate deeds but under the same name. The Zoning. Ordinance allows for accessory uses on lots other than the lot containing the primary use which it services by Special Permit and when the accessory lot is directly across the street from the primary use. The residential property is approximately 3.15 acres and contains a primary dwelling. and a detached garage overlooking Cotuit Bay. The primary dwelling was constructed in 1950, has 2,535 gross square feet and 2 bedrooms. The proposed accessory structure appears to be a four-car garage with storage on a lot that is 5.6 acres. Procedural & Hearing Summary Special Permit Application No. 2019-044 to construct an accessory structure, a garage, on an adjoining lot on which the principal structure and use are located, was filed at the Town Clerk's office and the office of the Zoning Board of Appeals on July 16, 2019. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on August 7, 2019 at which time the Board found to grant the Special Permit subject to conditions. Board Members deciding this appeal were Alex Rodolakis, David Hirsch, Herbert Bodensiek, Paul Pinard, and Jacob Dewey. Attorney Michael Schulz represented the Applicant before the Board. Attorney Schulz described the proposal and the need for a garage for the children's vehicles. The proposed location was chosen as it is a fiat area and screened from sight. Town of Barnstable Zoning Board of Appeals-Decision and Notice Special Permit No. 2019-044-Collins The Board discussed the abutter, Mr. Popolo's, initial concern of potential view impact but after reviewing the site plan, supported the location as it will have no sight impact. The screening is adequate. Mr. Popolo's email was placed in the record. The Board Chair asked for public comment and no testimony,was given. Findings of Facf At the hearing on August 7, 2019, the Board unanimously made the following findings of fact in Special Permit Application No. 2019-044, a request to construct an accessory structure, a garage, on an adjoining lot on which the principal use it serves is located: 1. The application falls within a category specifically excepted in the ordinance for a grant of a special permit. Under Section 240-44, a Special Permit is required for an accessory use immediately opposite and across a road from the lot on which the principal use it serves is located. 2. After an evaluation of all the evidence presented, the proposal fulfils the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. The proposed structure is screened from view. 3. Site Plan Review is not required for single family residential dwellings. i The vote to accept the findings was: AYE: Alex Rodoiakis, David Hirsch, Herbert Bodensiek, Paul Pinard, and Jacob Dewey NAY: None Decision Based on the findings of fact, a motion was duly made and seconded to grant Special Permit No. 2019-044 subject to the following conditions: 1. Special Permit No. 2019-044 is granted to Shannon Collins, in accordance with Section 240- 44—Accessory Use Permitted with Special Permit at 111 Putnam Avenue, Cotuit and shown on Assessors Map 036, Parcel 041-002. 2. The improvements shall be in substantial conformance with the site plan entitled °Plan of Land" Location #59 Putnam Avenue Cotuit Massachusetts" by Baxter Nye Holmgren, Inc dated March 17, 2000 with a revision date of March 26, 2000. 3. Both lots shall be retained in identical ownership with respect to both fee and non-fee interests as 111 Putnam Ave as shown on Assessors Map 036 as Parcel 041-002 and 55 Putnam Ave as shown on Assessors Map 036 as parcel 045. 4. This decision shall be recorded at the Barnstable County Registry of Deeds and copies of the recorded decision shall be submitted to the Zoning Board of Appeals Office and the Building Division prior to issuance of a building permit. The rights authorized by this Special Permit must be exercised within two years, unless extended. Zoning Board of Appeals nub 1 Pr ?; Decision and Notice Special Permit 2019-044—Collins Section 240-44-Accessory Uses Permitted with Special Permit To allow the construction of a garage on an adjoining the lot on which the principal use it serves Summary: Granted with Conditions Applicant: Shannon Collins Property Address: 55 Putnam Avenue, Cotuit, MA 111 Putnam Avenue, Cotuit Assessor's Map/Parcel: 036/041-002 and 036/045 Zoning: Residence F (RF) Hearing Date: August 7, 2019 Recording Information: Plan Book: 556 Page:20 Background Shannon Collins applied for a Special Permit in accordance with Section 240-44—Accessory Uses. The Applicant requested a Special Permit in order to construct an accessory structure, a garage approximately 24 feet by 60 feet, on an adjoining lot on which the principal structure and use it serves. The properties are located at 111 Putnam Avenue and 55 Putnam Avenue, Cotuit, MA as shown on Assessor's Map 036 as Parcels 041-002 and 045. They are located in the Residence F (RF)Zoning District. The Applicant owns the parcel addressed as 111 Putnam Avenue and 55 Putnam Avenue but there are two distinct lots. Both lots(Parcel 041-002 and 045) are held through separate deeds but under the same name. The Zoning Ordinance allows for accessory uses on lots other than the lot containing the primary use which it services by Special Permit and when the accessory lot is directly across the street from the primary use. The residential property is approximately 3.15 acres and contains a primary dwelling and a detached garage overlooking Cotuit Bay. The primary dwelling was constructed in 1950, has 2,535 gross square feet and 2 bedrooms. The proposed accessory structure appears to be a four-car garage with storage on a lot that is 5.6 acres. Procedural & Hearing Summary Special Permit Application No. 2019-044 to construct an accessory structure, a garage, on an adjoining lot on which the principal structure and use are located, was filed at the Town Clerk's office and the office of the Zoning Board of Appeals on July 16, 2019. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters and interested parties in accordance with MGL Chapter 40A. The hearing was opened on August 7, 2019 at which time the Board found to grant the Special Permit subject to conditions. Board Members deciding this appeal were Alex Rodolakis, David Hirsch, Herbert Bodensiek, Paul Pinard, and Jacob Dewey. Attorney Michael Schulz represented the Applicant before the Board. Attorney Schulz described the proposal and the need for a garage for the children's vehicles. The proposed location was chosen as it is a flat area and screened from sight. t i { I i Town of Barnstable Zoning Board of Appeals-Decision and Notice Special Permit No. 2019-044-Collins The Board discussed the abutter, Mr. Popolo's, initial concern of potential view impact but after reviewing the site plan, supported the location as it will have no sight impact. The screening is adequate. Mr. Popolo's email was placed in the record. The Board Chair asked for public comment and no testimony was given. Findings of Fact At the hearing on August 7, 2019, the Board unanimously made the following findings of fact in Special Permit Application No. 2019-044, a request to construct an accessory structure, a garage, on an adjoining lot on which the principal use it serves is located: i. The application falls within a category specifically excepted in the ordinance for a grant of a special permit. Under Section 240-44, a Special Permit is required for an accessory use immediately opposite and across a road from the lot on which the principal use it serves is located. 2. After an evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. The proposed structure is screened from view. 3. Site Plan Review is not required for single family residential dwellings.
