Property Address: 7 Wings Lane,Cotuit,MA mAssessor's Map/Parcel: Map 019 as Parcel 154 Zoning: Residence F Zoning District Background: According to the Assessor's Record,the property before the Board is a 0.46-acre parcel developed in 1975 900 with a three-bedroom,one-story, 1,826 sq.ft. single-family dwelling and a 364 sq.ft.attached garage. The property is a corner lot located at Wings Lane and Cheoh Road. The applicant purchased the property in March of 2002. m The applicant is seeking to expand the existing structure by adding to the rear of it: Qz • a new bathroom,one-story addition of 10 by 8 feet; • a 21'-2"by 14' one-story screened porch; • an open-air raised deck of 21'-2"by 4%and • a lower deck measuring 21'-2"by 9'-10". The applicant has requested a variance to Section 240-14(E)Bulk Regulations—Minimum Side Yard Setback to accomplish the proposed additions. A proposed plot plan showing the location and infringements into the setback and architectural elevations of the proposed additions has been submitted to the file. Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on August 23,2005. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 28,2005, at which time the Board found to grant the variance subject to conditions herein. Board Members deciding this appeal were, Gail Nightingale,Randolph Childs,James R.HatfieId,Ron S.Janson,and Chairman Daniel M. Creedon M. The petitioner,Olaf J. Thorp represented himself at the hearing. Mr.Thorp noted that he was in need of expanding area for the home to accommodate his family. He cited that the only practical direction to expand was to the rear of the dwelling however,there is limited area and the proposed addition would intrude into the required setback. He described the proposed additions and noted that none of the neighbors were in opposition to the grant of the variance. i Bk 20411 Pg 144 #75616 Mr. Thorp noted that the attached garage had been converted into living area by the prior owner and that the conversion had been by a building permit duly issued for that conversion of the garage to living area. The Board noted that the variance was needed for only two components of the proposed additions-to allow a proposed bathroom to intrude 4.9-feet and a proposed screened porch to intrude 5-feet, into the required 15-foot setback. Public comment was requested and no one spoke in favor or in opposition to the request. Chariman Creedon noted that 18 letters of support had been entered into the file. Findings of Fact: At the hearing of September 28, 2005,the Board unanimously made the following findings of fact: 1. Appeal 2005-80 is that of Olaf J.Thorp seeking a Variance to Section 240-14(E)Bulk Regulations— Minimum Side Yard Setback. The applicant seeks the variance to permit additions to the rear of the existing structure to be setback 10 feet from the property line where a 15-foot setback is required. The property is located as shown on Assessor's Map 019 as Parcel 154,addressed 7 Wings Lane, Cotuit,MA in a Residence F Zoning District. 2. According to the Assessor's Record,the property before the Board is a 0.46-acre parcel developed in 1975 with a three-bedroom,one-story,approximately 1,900 sq.ft. single-family dwelling and a 364 sq.ft.attached garage. The property is a comer lot located at Wings Lane and Cheoh Road. 3. The applicant is seeking to expand the existing structure by adding to the rear of it: a new bathroom, one-story addition of 10 by 8 feet;a 21'-2"by 14' one-story screened porch; an open-air raised deck of 21'-2"by 4',and a lower deck measuring 21'-T'by 9'-10". 4. The applicant has submitted a proposed plot plan showing the location and infringements into the setback and architectural elevations of the proposed additions.The applicant has also submitted a one-page summary with respect to the application. 5. The existing dwelling is located 19.2 feet from the property line,in conformance with the 15-foot minimum yard setback. However,the proposed bathroom will intrude 4.9-feet,and the proposed screened porch 5-feet,into the required 15-foot setback. 6. Eighteen(18)letters in support of granting the variance have been received and entered into the file. 7. In consideration for the variance,unique conditions exist that affect the locus but not the zoning district in which it is located. A literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship,financial or otherwise to the petitioner,and this variance may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Decision: Based upon the findings,a motion was duly made and seconded to grant the variance to allow a proposed bathroom to intrude a maximum of 4.9-feet into the required 15-foot setback,and a proposed screened porch to intrude a maximum of 5-feet,into the required 15-foot setback. 1. Development and the infringement into the side setback shall be as proposed on plans submitted to the Board entitled"Plot Plan of Land located at 7 Wings Lane,Cotuit,MA prepared for Olaf&Margaret Thorp"dated August 10,2005 as drawn by Yankee Land Surveyors&Consultants. 2 Bk 20411 Pg 145 #75616 2. The additions to be developed are further limited to that level of development presented to the Board in plan submitted,entitled""New Addition for: Olaf Thorp 7 Wings Land, Cotuit,MA"as drawn by Cotuit Bay Design,dated 8/10/05 and consisting of two sheets,Al and A2,showing the layout and elevations for the additions. 3. Upon completion of those additions as shown on the plans submitted,the existing structure shall not be further expanded in area or in footprint nor shall any accessory buildings be added without permission from the Zoning Board of Appeals. This development shall be considered full development of the lot. 4. The screened porch and decks shall be developed as proposed. They shall not be further enclosed nor converted into a year-round habitable area. 5. During the installation of the foundations and footings for the additions,an engineer or surveyor shall be employed to assure that the foundations/footings are properly located consistent with this decision. N6 The-10=foot-yard-setback area,bordering 73TClieoli Road shall`be landscaped and screened to•provide- vacy for that neighboring-lot from the,infringements into the setback. 7. All mechanical equipment associated with the dwelling(air conditioners,electric generators,etc.)shall be located so as to conform to the required 15-foot setback for the District and screened from neighboring homes and the public right-of-way. 8. This decision must be recorded at the Registry of Deeds and a copy of that recorded document must be submitted to the Zoning Board of Appeals Office and to the Building Division before any building permit is issued. The relief authorized must be executed within one year of the grant of this permit.
