CHAPTER 707
Regulation Governing Minimum Submission
Requirements for a Notice of Intent Application
The Barnstable Conservation Commission has adopted the following requirements in order to obtain more
consistently complete submission documents necessary for a thorough and efficient review of all Notice of Intent
(NOI) applications. Failure to complete any of the items in this checklist may result in your application being
denied.
Applicant or applicant’s agent should check each box denoting that the task has been completed or in certain
instances, like field staking, denoting that the task will be completed. The following submission checklist covers the
requirements of Chapter 237, Wetlands Protection, of the Part I General Ordinances of the Code of the Town of
Barnstable. This checklist shall be submitted to the Barnstable Conservation Division with the NOI application.
1.Requirements
a.The applicant understands, unless they’ve instructed otherwise, they are applying both
under the Massachusetts Wetlands Protection Act M.G.L. c.131,§40 and
Chapter 237 of the Town of Barnstable General Ordinances.
b.Attach a written narrative to the NOI application (WPA Form 3), available at:
www.mass.gov/eea/agencies/massdep/service/approvals/wpa-form-3.html
describing any project impacts and proposed mitigation as they relate to the following:
1)Any of the interests of Chapter 237 of the General Ordinances and the MassDEP
Wetlands Protection Act M.G.L. 131, §40.
2)The performance standards contained in the MassDEP Wetlands Protection Regulations
(310 CMR 10.00)
3)Chapter 704: Regulation Governing Activity in the 100-ft. Buffer Zone.
4)Chapter 703: Private Docks and Piers.
5)Any other applicable regulations (310 CMR 10.00 or as promulgated under Chapter 237
of the General Ordinances).
c.Enclose proper payment to cover the fee for Chapter 237 filings. Consult current Fee
Schedule at www.townofbarnstable.us/Conservation

a.Contact the Conservation Division office at (508) 862-4093 regarding the docketing
process, or see current schedule of Conservation Hearings and submission deadlines at:
www.townofbarnstable.us/Conservation/
b.Provide a copy of the list of abutters within a 100 ft radius of the project parcel.
c.Provide a copy of the Assessor’s Map indicating the parcel of the project site and
showing the 100 ft radius of the project parcel.
d.Provide a copy of the abutter notification letter. Use t he form letter provided in our Abutter
Notification Regulation (Chapter 706), available on the Conservation Division
website.
e.Bring the green return receipts, from the certified mai lings to the abutters, as proof of
notification to the public hearing. If any mailings are returned, bring the entire envelope,
indicating by postal service stamp the reason for return. You will retain the receipts
afterwards, not the Conservation Division.
f.I further certify under the penalties of perjury that all abutte rs were notified of the Notice of
Intent Application, pursuant to the requirements of Chapter 237 of the General Ordinances of the
Code of the Town of Barnstable. Notice must be made in writing by certified mail to all abutters
within 100 ft of the property line of the project location.

3.Field Staking:
a.On or before Tuesday, @ 8:30 a.m., one week prior to the scheduled public hearing, have
your project staked by a professional engineer or registered land surveyor showing all
outside corners of all proposed structures and the continuous proposed “limit of work” line.
b.Have a wetland scientist or other qualified professional flag all wetland res ource areas on or
within 100 ft of the work area. Make sure that the flags are sequentially numbered.
c.Provide a project identification stake with bright painted top and applicant name and address,
easily visible from the street approaching the site.
4.Legal Advertisement Fees:
a.Conservation will submit the legal ad for publication in a local newspaper. The applicant or
his/her agent is responsible for payment, by check (payable to the Town of Barnstable), at the
hearing or by mail. The cost of the legal ad will be pre-calculated and posted on the hearing
agenda prior to the hearing.
5.Minimum Documentation for a Complete Application:
a.Provide a completely filled-out (in all parts) NOI application as locally
adopted for the Town of Barnstable, including MassDEP Vegetated Wetland Field Data Form.
Indicate Assessor’s map and parcel of the project, as well as the street or road address, and
pertinent village (i.e., Hyannis, Centerville, Barnstable, etc).
b.Provide two (2) original project plans, stamped in blue or red ink (wet stamp). Plans must be
signed and dated by a Massachusetts licensed, professional engineer, land surveyor, architect or
landscape architect (as applicable), and shall be drawn at a readable scale (1" = 20' preferred).
For multi-acre sites, a second site plan, drawn at larger scale showing the entire site, should also
be provided.

c.Provide a signed Permission to Access Property, Form PA. The form must be signed by the property
Owner, or legal representative and submitted prior to NOI being docketed and application advertised.
Form PA is available at www.townofbarnstable.us/Conservation/. Do not send the abutter letter
out until the form is submitted to the Conservation Division office.
d.For projects requiring mitigation plantings under Chapter 704 -3, 704-4, and 704-5,
mitigation planting location(s) shall clearly be shown on landscaping planting plan. The
planting plan shall include species list (chosen from the Town of Barnstable Conservation
Commission approved planting lists), sizes, densities and/or quantities. The plan shall
also provide area calculations between 0 to 50 and 50 to 100 separately for the amount of
mitigation planting required, and the amount of mitigation planting proposed.
e.Provide detailed, written street directions to the locus (site).
f.Provide a copy of a U.S.G.S. locus map indicating the general area of the project site.
g.Provide a check for the Town of Barnstable portion of the required filing fee. (The portion
payable to the Commonwealth, see 7. e. below)
h.Provide any other documentation, photographs, architectural renderings or other supporting data
prepared by professionals competent in the field which may be relevant to the application.
6.The site plan shall also show:
a.All existing and proposed contours at 2-ft. minimum intervals (1-ft. preferred).
b.Clear delineation of all existing and proposed structures and features. Building structures must
be accurately dimensioned (fixed location) from property lines and wetland resource a reas. Plans
shall provide sufficient detail to show all potential wetland impacts, mitigation, compensatory
areas, engineered structures, utilities, landscaping, etc. within the area of jurisdiction. On
complicated sites, existing and proposed conditions must be shown on separate sheets.
c.Locus inset map of the site clearly showing its location relative to surrounding public streets.
d.All wetland resource area flags by individual flag number (matched to the field) to clearly
identify all resource areas on or within 100 feet of the work area. The individual who performed
the flagging and date of flagging shall be identified on the plan next to the resource line.
e. Section views showing changes in grade, cuts and fills.
7.SUBMISSION OF THE COMPLETED APPLICATION WITH PLANS:
a.Provide a signed Permission to Access Property, Form PA. The form must be signed by the property
Owner, or legal representative and submitted prior to NOI being docketed and application advertised .
Form PA is available at www.townofbarnstable.us/Conservation/. Do not send the abutter letter
out until the form is submitted to the Conservation Division office.
b.Email NOI application and all associated materials in PDF format to

Do not include copies of checks.
All attachments must be named with the hearing date (year first), type, name, address. Examples

Project Description
I. Existing Property Description
The locus of the subject property is on the north side of Nantucket Sound in Osterville, Massachusetts.
The property has a gross area of approximately 1.8 acres (established to mean high water) and
features approximately 135 linear feet of waterfront on Nantucket Sound. The property is located in a
developed residential use area and is currently developed with various structures, including a two-
story, single-family residence, garage, tennis court, hardscape, gravel drive and associated site
amenities, including subsurface sewage disposal system. The site includes an expansive dune field
and beach.
II. FEMA Flood Zones
A small portion of the subject property lies within Land Subject to Coastal Storm Flowage.
Specifically, within one (1) FEMA mapped Zones VE (El. 15-feet 1), special flood hazard areas subject to
inundation by the 1% annual chance flood (100-year flood event). These flood designations are shown
on FEMA Flood Insurance Rate Map (FIRM) Number 25001C0757J, effective date July 16, 2014. Base
Flood Elevations for these zones are determined as follows:
• Zone VE (El. 15-feet): Coastal flood zone with velocity hazard (wave action); Site specific Base
Flood Elevation determined as 15-feet. Velocity waves have a height of 3-feet or greater, or a
runup depth of 3-feet or greater.
Most of the property, including the currently developed area is located within Zone X. The seaward
portions of the property are located within Zone VE (El. 15-feet); which is a velocity zone that is
identified by FEMA as coastal flood zones with velocity hazard (wave action).
III. Wetland Resource Areas
The subject property lies within the following Massachusetts Department of Environmental Protection
(Mass DEP) and Town of Barnstable wetland resource areas: Coastal Beach, Coastal Dune, Coastal
Bank (Mass DEP and Barnstable defined bank), and Land Subject to Coastal Storm Flowage [LSCSF]
(Flood Zone VE El. 15-ft).
The property lies outside of the Natural Heritage and Endangered Species Program (NHESP) Estimated
or Priority Habitat of Rare Wildlife and Species mapped areas.
IV. Conservation Maps
In a review of the Town of Barnstable Conservation Maps, the property was determined to lie outside
of the following areas:
• Area of Critical Environmental Concern (ACEC)
• State Designated Zone II
• Groundwater Protection Overlay District
• Wellhead Protection Overlay District

The property also lies outside the mapped areas of the lies outside of the Natural Heritage and
Endangered Species Program (NHESP) Estimated or Priority Habitat of Rare Wildlife and Species.
V. Project Description
The applicant proposes to remove:
the existing two-story dwelling;
the garage;
all existing hardscape;
the existing septic system;
the existing concrete tennis court; and
the gravel drive.
The applicant proposes to:
Construct a new two-story, four bedroom, single-family dwelling with attached garage and associated
hardscape outside 0-50’ buffer;
Construct a new carriage house and associated parking court and hardscape outside 100’ buffer;
Construct a tennis court, tennis cabana and associated hardscape outside the 100’ buffer;
Construct a new gravel drive outside the 100’ buffer;
Install new sewage disposal system which will be located entirely outside of the 100’ buffer.
A portion of the existing structure resides within the 0’-50’ buffer. The new dwelling and attached
garage will be constructed entirely outside of the 50’ buffer. A portion of the existing lawn area within
the 0’-50’ buffer is proposed to be regraded and replaced in kind with new lawn. No native vegetation
or trees are to be removed within the buffer zone.
The existing sewage disposal system will be removed and will be relocated, reconfigured, and
upgraded to a fully Title 5 compliant sewage disposal system, located entirely outside the 100’ buffer
zone on site. All new utilities will be installed to the new buildings. Roof runoff for the new buildings
will be managed through the installation of gutters and downspouts routed to drywells.
No mitigation has been proposed as there is no increase in coverage within both the 0’-50’ buffer and
the 50’-100’ buffer zones.

Performance Standards Narrative
The proposed project meets the performance standards of the Massachusetts State Wetlands
Protection Act (WPA) Performance Standards as set forth in the Regulations at 310 C.M.R. 10.00, et
seq., as well as those adopted by the Barnstable Conservation Commission and set forth in the local
Barnstable Wetlands Regulations. The following sections address how these performance standards
are met for the proposed project and provide evidence demonstrating that the proposed project will
not have significant adverse impacts to the resource areas, as those areas are defined within the
State and Local regulations.
I. Wetland Performance Standards - (310 CMR 10.00) State WPA Regulations
10.28: Coastal Dunes
Performance Standards
(3) Any alteration of, or structure on, a coastal dune or within 100 feet of a coastal dune shall not
have an adverse effect on the coastal dune by:
(a) affecting the ability of waves to remove sand from the dune;
• No work within the resource area
(b) disturbing the vegetative cover so as to destabilize the dune;
• No work within the resource area
(b) causing any modification of the dune form that would increase the potential for storm or
flood damage;
• No work within the resource area
(c) interfering with the landward or lateral movement of the dune;
• No structures are to be constructed that would impede the lateral movement of the
dune landward.
(d) causing removal of sand from the dune artificially; or
• No work within the resource area
(e) interfering with mapped or otherwise identified bird nesting habitat.
• N/A
(4) Notwithstanding the provisions of 310 CMR 10.28(3), when a building already exists upon a coastal
dune, a project accessory to the existing building may be permitted, provided that such work, using
the best commercially available measures, minimizes the adverse effect on the coastal dune caused
by the impacts listed in 310 CMR 10.28(3)(b) through (e). Such an accessory project may include, but
is not limited to, a small shed or a small parking area for residences. It shall not include coastal
engineering structures.

(5): The following projects may be permitted, provided that they adhere to the provisions of310 CMR
10.28(3):
(a) pedestrian walkways, designed to minimize the disturbance to the vegetative cover and
traditional bird nesting habitat;
The proposed house will be served by the timber ramp that exists in southwest corner of the
property, which will remain unchanged. The existing footpath across the 10’ easement along
the westerly border of the property will similarly remain unchanged.
(b) fencing and other devices designed to increase dune development; and
• N/A
(c) plantings compatible with the natural vegetative cover.
• N/A
(6) Notwithstanding the provisions of 310 CMR 10.28(3) through (5), no project may be permitted
which will have any adverse effect on specified habitat sites of Rare Species, as identified by
procedures established under 310 CMR 10.37.
• N/A. The project site is outside any NHESP mapped area.
10.30: Coastal Banks
Performance Standards
(3) No new bulkhead, revetment, seawall, groin or other coastal engineering structure shall be
permitted on such a coastal bank except that such a coastal engineering structure shall be permitted
when required to prevent storm damage to buildings constructed prior to the effective date of 310
CMR 10.21 through 10.37 or constructed pursuant to a Notice of Intent filed prior to the effective date
of 310 CMR 10.21 through 10.37 (August 10, 1978), including
reconstructions of such buildings subsequent to the effective date of 310 CMR 10.21 through
10.37, provided that the following requirements are met:
(a) a coastal engineering structure or a modification thereto shall be designed and
constructed so as to minimize, using best available measures, adverse effects on adjacent or
nearby coastal beaches due to changes in wave action, and
(b) the applicant demonstrates that no method of protecting the building other than the
proposed coastal engineering structure is feasible.
(c) protective planting designed to reduce erosion may be permitted.
• N/A. No coastal engineering structures are proposed as part of the proposed project.

(4) Any project on a coastal bank or within 100 feet landward of the top of a coastal bank, other than
a structure permitted by 310 CMR 10.30(3), shall not have an adverse effect due to wave action on the
movement of sediment from the coastal bank to coastal beaches or land subject to tidal action.
• The coastal bank on this property is fronted by a coastal dune and coastal beach. No work is
proposed other than regrading of the lawn and removal of the existing deck within the 0’-50’
buffer.
(5) The Order of Conditions and the Certificate of Compliance for any new building within 100
feet landward of the top of a coastal bank permitted by the issuing authority under M.G.L. c. 131, § 40
shall contain the specific condition: 310 CMR 10.30(3), promulgated under M.G.L. c. 131, § 40, requires
that no coastal engineering structure, such as a bulkhead, revetment, or seawall shall be permitted on
an eroding bank at any time in the future to protect the project allowed by this Order of Conditions.
(6) Any project on such a coastal bank or within 100 feet landward of the top of such coastal
bank shall have no adverse effects on the stability of the coastal bank.
• The activities taking place within 100 feet of it will be the removal the existing structure, the
construction of the new dwelling and associated hard scape further from the resource areas as
well as minor regrading. None of these activities should adversely affect the stability of the
bank.
(7) Bulkheads, revetments, seawalls, groins or other coastal engineering structures may be
permitted on such a coastal bank except when such bank is significant to storm damage
prevention or flood control because it supplies sediment to coastal beaches, coastal dunes, and
barrier beaches.
• N/A. No coastal engineering structures are proposed as part of the proposed project.
(8) Notwithstanding the provisions of 310 CMR 10.30(3) through (7), no project may be
permitted which will have any adverse effect on specified habitat sites of rare vertebrate or
invertebrate species, as identified by procedures established under 310 CMR 10.37.
• N/A. The project site is outside any NHESP mapped area.
Land Subject to Coastal Storm Flowage
The MA DEP Wetland Regulations set forth in 310 CMR 10.00 contain no performance standards for
work within LSCSF.
II. Barnstable Wetlands Protection Regulations
Land Subject To Coastal Storm Flowage - No work is taking place within the VE Zone or any other
flood zone with moderate wave action, so the Barnstable guidance pertaining to LSCSF is not
applicable.
Chapter 705 – Coastal Banks - The Coastal Bank on site does meet the local Town of Barnstable
definition. (see notes in previous section)

Chapter 704 – Wetlands Buffer Zone Activity – Pursuant to Section 704-3:
(C) Where a fifty-foot undisturbed buffer zone, as measured in accordance with the definition of
"fifty-foot undisturbed buffer zone" in § 704-2, does not exist prior to the proposed work, any work
proposed within the one-hundred-foot. buffer zone shall be subject to mitigation planting
requirements intended to restore, in so far as possible, both the dimensions of a fifty-foot
undisturbed buffer and its vegetation. For such work proposed within the fifty-to-one-hundred-foot
zone, the calculation of mitigation is set forth in Subsection D.
(D) Calculation of mitigation for work proposed within the fifty-to-one-hundred-foot buffer. The
amount of mitigation planting required for work proposed within the fifty-to-one-hundred-foot buffer
zone shall be determined by the following method:
(1) Calculate area of proposed hardscape within the fifty-to-one-hundred-foot buffer zone;
(2) Multiply the area found in Subsection D(1) by three to obtain the area of required mitigation at a
planting to disturbance ratio of 3:1.
(3) In no case shall the total area of mitigation plantings required be greater than that which is
necessary to restore a fifty-foot undisturbed buffer in its entirety.
A "fifty-foot undisturbed buffer zone" in § 704-2, does not exist on this property. However, the
proposed project will not result in any increase in coverage within these zones.
III. Summary
The project meets the performance standards set forth in both the Massachusetts Wetland Protection
Regulations and the Barnstable Wetland Protection Ordinance. As set forth in the foregoing Narrative,
the proposed project will result in no significant or cumulative negative effects upon the wetland
values defined within the Town of Barnstable Wetlands Protection Ordinance and no adverse impacts
to the wetland interests defined in the Massachusetts Wetland Protection Regulations.

Construction Protocol
I. Pre-Construction Requirements
• A sign bearing the MA DEP file number shall be posted in compliance with the Order of Conditions
issued by the Barnstable Conservation Commission.
• Prior to any construction or site disturbance activity, the erosion and sedimentation barriers shall
be installed in the location(s) shown on the plan.
• A copy of the approved plans and the Order of Conditions shall be provided to the Contractor and
shall be on site at all times.
II. On-Site Pre-Construction Conference
Prior to the start of any sitework or construction, a pre-construction meeting will be held on site to
discuss the project requirements with the following parties represented:
• General Contractor
• Sitework Contractor
• Coastal Engineering Co., Inc. Engineer
• Barnstable Conservation Commission Agent
Topics to be discussed during the meeting include, but are not limited to the following:
• Maintenance of erosion and sedimentation control barrier
• Limit of work
• Construction sequencing and schedule
• Material and equipment storage
• Project contacts
During the preconstruction conference, the Engineer and Conservation Agent shall inspect the erosion
and sedimentation barrier. Any deficiencies shall be addressed prior to the commencement of work.
III. Limit of Work
The Sitework Contractor shall familiarize himself with the boundaries of the property and the limit of
work. The Contractor shall exercise care in order to protect adjacent properties and wetland resource
areas. The Contractor shall not operate heavy equipment outside the work limit as shown on the
approved plan and delineated by the erosion and sedimentation control barrier.
The contractor shall practice good housekeeping measures during the day-to-day operations at the
site. The site should be policed daily to remove any litter or construction debris. Care shall be taken
that no debris be allowed outside the work limit. Debris outside the work limit shall be picked up
immediately.

IV. Construction Access
Construction access shall be from the existing paved driveway. Any storage of equipment shall take
place within the driveway or outside of the 50-foot buffer zone to the wetland resource areas.
V. Construction Operations
The contractor shall practice good housekeeping measures during the day-to-day operations at the
site. The site shall be policed daily to remove any litter or construction debris. Care shall be taken
that no debris be allowed outside the work limit. Debris outside the work limit shall be picked up
immediately.
Any construction debris which will not be removed from the site at the end of the workday shall be
placed in dumpsters. The dumpsters shall be located in the existing driveway. The dumpsters shall be
covered at the end of the workday and emptied when full. The Contractor shall police the site daily in
order to prevent wind-blown material from entering abutting properties or resource areas.
Material stockpiles that are in place for an extended period of time shall be stabilized with vegetation,
mulching, erosion control blankets, and other measures that are necessary to prevent the discharge
of sediment from the project site.
