O'Brian Trustees White Revocable Trust 50 Fox Island Road, Osterville Map 096 Parcel 001 The project site consists of approximately 4.2 acres of land in Marstons Mills overlooking Marstons Mills River. The site is developed with a single-family dwelling, pool, tennis court and licensed pier permitted under SE3-1410. The wetland resources at the site are Land Under Ocean, Land Containing Shellfish, Salt Marsh, Coastal Bank, and Land Subject to Coastal Storm Flowage. The area has a shellfish rating of 5 out of 10, and was-dredged in the 1960s under DPW Permit 5556. The project as proposed includes proposed ell and float modifications and dolphin piles at existing licensed pier, and construction of a boat shed. The existing pier has no restrictions. With the existing configuration two of the three existing boats will be forced to maneuver in nearshore areas where 12" of clearance can not be provided, and the engines of all three boats will be in close proximity - which has been a Commission concern at other sites. The project as proposed is to replace the existing 32' ell with a 21' ell extended 5'further. from shore and rotated approximately 10 degrees, and to relocate the existing float from the north side of the pier to the south side of the pier and expand from 160 sf to the allowable.200 sf. The modifications will allow for all the boats to maneuver in areas where sufficient draft can be provided, will provide better separation between the engines, and eliminates the potential for a boat to berthed on the inside of the existing float which would require maneuvering in extremely shallow waters. The proposal requires a waiver under 703 J. 4. as the outside of the boat extends 31%of the width of the waterway, up from the existing conditions which represents 25176. The proposed boat does not extend substantially further than the existing configuration, and more than suitable depths and widths for passage exist for the lightly used cove. We believe the waiver is justified for the reasons above and understanding the Commission may consider the modifications to be a"substantial expansion" -allows the Commission greater control over the structure. Dolphin piles are proposed for the slips. The piles to the north and to the inside of the float will contain the access away from the shoreline. Also proposed, in the vicinity of the pier, is a boat shed. The property owner is an avid sculler. The small enclosure of the boat shed will allow for the secure storage of life jackets, paddles, and other boat related equipment. A roof overhang will provide protection to the scull racked on one side of the structure and smaller water craft such as kayaks and paddleboards on the other. The boat shed is located within the 50' buffer but, is exempt from the Buffer.Zone Regulations as a water dependent facility under 704 6. (5). Although light weight, the scull is over 20' long and maneuvering on the land can be awkward, so access in the immediate vicinity of the shoreline is important. The shed has been located so that the construction would not require the removal of any trees and will be well screened from all directions. Land under the Ocean: The project has been designed so that it will have the least effect on.Land under the Ocean. The proposed project will not affect or change the land under the ocean's ability to provide protection for storm damage prevention. The project will not have a significant negative effect on water quality, distribution of grain size sediment, or water circulation as required by 310 CMR 10.25(6). Land Containing Shellfish: The project will not have a negative impact on the water circulation, relief elevation, distribution of the sediment grain size, or natural drainage from adjacent land, or result in the compaction of the land by vehicular traffic or, change the water quality so as to change the productivity of the Land Containing Shellfish as required by 310 CMR 10.34(4). l
