The Subdivision was approved in 1981 (Dan Hostetter). Over many years, the Planning Board negotiated improvements with developer. This is an update on the Berry Hollow Drive lots from COMM. J� A water main was installed and a fire hydrant installed in the cul-de-sac. The four homes along this road are surrounded by actively used cranberry bogs, where pesticides/herbicides are regularly applied. Sampling and testing for herbicides in well water could be conducted; however it is not performed on a regular basis nor has it been performed at all of the homes along this road. Early in 1997, the cranberry farmer provided me documentation that the following pesticides/herbicides are used in these cranberry bogs: Devrinol, Casoran, Lorsban, Bravo 720, Diazinon, and Dithane F45. On June 26 1997, the Board of Health recommended testing for only two of the herbicides, Bravo and Casoran, four times per year at 104 Berry Hollow Drive. Finally on June 1, 2000, sampling and laboratory analyses were performed at 105 Berry Hollow Drive and at 117 Berry Hollow Drive for Bravo, Casoran, PCB, Dichlobenil, Chlorothalonil, and various other pesticides. The results showed "none detected." However, according to our records, further tests were not routinely performed after that date. The tests are known to be very expensive. Also, it is not known what was buried below ground or what was applied historically in this area (long before 1997). 1 myself would be concerned about drinking well water from an area surrounded by cranberry bogs—especially from wells which are not routinely and regularly tested for all of the possible contaminants present and the potential long term health implications which have been found to be potentially associated with such contaminants. Dear Board of Health: I am unable to make tonight's meeting where D. Hostetter will seek a waiver from the requirement to supply town water to the houses on Berry Hollow Road. I urge you to grant this waiver. My reasoning is the following points.I understand in prior talks with the town that the cost will be prohibitive, $50,000 or more. I also understand that the Planning Board has not placed a requirement on Mr.Hostetter to bring water in to the houses on Berry Hollow Rd. Another very important issue is that the Massachusetts Department of Environmental Protection has placed a superceding order of conditions on this road, file# SE-3—2589.This order of conditions does not allow for this type of work to be done on or around the road. In the unlikely event that the Board should require Mr. Hostetter to pipe water to the houses on Berry Hollow Rd I would have to appeal that decision to the DEP. In the event town water is supplied to the houses on Berry Hollow Rd I will expect the Board(and involved contractors)to work with me closely so that my property is not negatively impacted or damaged. I didn't realize that you never received the results from the well testing on lots 79 and 80 on Bog Hollow Road. The homes located on these lots are owned by Mr. Sheehan and Mr. Blazis respectively. Since we did the testing in 1997, the other two lots located on Bog Hollow Road have been built upon. I would like to take you chronologically through the development of Whistleberry and how it relates to the installation of town water on Bog Hollow Road. 1981- The Barnstable Planning Board approves Whistleberry. Precisely at this time C.O.-M.M. Water District is installing water on Old Mill Road. Old Mill Road runs along the entrance of Whistleberry Road. One of the conditions of the approval of the subdivision from the Board of Health was that we hook up to the newly installed water mains on Old Mill Road. We agreed to do this and-currently all of the lots on Whistleberry Road have town water. Lots 77,78,795and 80 are located on Bog Hollow Road and did not have town water available at that time. Town water was not installed on River Road until much later. 1985-1986- We sell lots 79 and 80 and ask that all 4 lots located on Bog Hollow Road be released from covenant from the Planning Board. The Planning Board releases the covenant on all 4 lots. 1990-1993 Although the road layout on Bog Hollow Road is less than the required width, we negotiated a development agreement with the planning board and Mr. Sheehan and Mr. Blazis to improve Bog Hollow Road with M pavement and drainage. We agreed to do this so that we could have the remaining 4 lots in Whistleberry released from covenant. During these negotiations, Mr. Sheehan and Mr. Blazis agreed that the town water was a "non-issue" and not to pursue them with us. I have enclosed a copy of the minutes of the June 22, 1992 Planning Board meeting. 1996- We complete asphalt and drainage on Bog Hollow Road in compliance with the development agreement with the Town. 1997- After completing the items on Steve Seymour's punch list, we again request to have the lots released from covenant. At the meeting to discuss the release, through the urging of Mr. Blazis and Mr. Sheehan, the Town asked if we would test the wells of the two residents. We agreed to do the testing and have enclosed those results for your review. In conclusion, we feel that the town water hookup was intended to include each and every lot in the main subdivision off Old Mill Road. To the best of our knowledge, the town had never insisted that a developer bring water a distance of over 3 miles to a site that included 1 acre lots. Also, if the wells are not a problem, the lots had been released, the residents agreed that we do not have to install water, we have signed a development agreement without the mention of installing town water, why should we be forced to bring water to these lots? I have worked with Steve Seymour for over 10 years to try to get these lots released. I have done everything the Town has asked. C. Cooperrider stated that the bank thinks the Board can not do anything but issue the permit. Attorney Ford expressed concern that if the Board was disposed to do otherwise than issue the building permit tonight, that the Board consider continuing their vote until the next hearing date so that he would have an opportunity to appear and present his argument. Attorney Ford did want me to convey that the bank has a buyer contingent on the building permit and they have already lost one buyer. A MOTION was duly made by R. Freedman and seconded by G. Zoto to deny the request based on the fact that there is an incomplete road, however, and the Board agreed to postpone the vote until July 13, 1992 when the attori,ey can be present to state his case. Voted_ unanimously to table the vote until next meeting. July 13, 1992. SUBDIVISION #680 CRANBERRY BLOSSOM TRUST Letter from William Crowell requesting release of Lot #3. Town has $20,000.00 cash security. S. Seymour's report, dated 12/16/91, was read into the record. A MOTION was duly made by J. McKenna and seconded by R. Freedman to approve the release of Lot #3, based on the fact that the Town has additional security to finish the subdivision.. Voted unanimously. DISCUSSION SUBDIVISION #454 - WRISTLEBERRY Request by the Planning Board to meet with Daniel Hostetter, developer of the Whistleberry subdivision - Mr. Hostetter was to provide estimated costs of construction of Berry Hollow Road. C. Cooperrider asked Mr. Blazis if he had been given a copy of the letter from D. Hostetter. (see attached) Mr. Blazis stated that he had received a copy. C. Cooperrider asked the residents of Berry Hollow to respond to the letter. Mr. Johnson stated that he was president of the Whistleberry Residents Association and drafted a letter in response (see attached) Item one, we accept in general, the other two items that we have put in the letter, we try to motivate the process they could be done as soon as possible, you will note in the second and third paragraph with respect to items two and four we would like to propose some sort of a method where the lot would be released for example when it's sold but that then the work could be done and not have all the lots released and of course we would be back trying to Planning Board Minutes 6/22/92 Page 5 03/05/2000 16:57 5084281974 HOSTETTER REALTY PAGE 02 ensure that the work is done. The spirit of this letter is an intent to try and ensure that we could get this to a satisfactory completion. The Resident's Association met Sunday night and drafted this letter, we only had a few days where we had D. Hostetters letter in hand. C. Cooperrider noted that this is an initial response and the association has not had a chance to get together to discuss this back and forth. However, C. Cooperrider stated that the association should be aware of a letter dated. June 19, 1992 from S. ,Seymour, the project engineer. This letter is in response to Mr. Hostetter's letter and we have not had a change to talk to Mr. Seymour yet. (see attached) C. Cooperrider felt that Mr. Seymour was bringing the road width to everyone's attention that from an engineer's prospective, it is going to be a narrow road. fie did not make any recommendations. Mr. Hostetter proposed a 12 foot road and feels that it is adequate and there will not be that much traffic on it. Be stated that he was not in a financial position to start the work today, my idea would be that as soon as a lot is sold, take those funds and do the work that the association expects us to do. The figure of $25,000.00 is necessary to do a first class job to do the road according to the specifications of the Town. One of the biggest expenses will be the removal of the existing road and properly disposing of the asphalt. Both Mr. Sheehan and Mr. Blazis agreed that the water and the underground utilities are a non issue. They agreed not to pursue them with Mr. Hostetter. C. Cooperrider stated that everyone is agreed to the letter except for the fourth paragraph, and asked the parties to get everyone together and resolve the gap that is there. J. McKenna stated that a fair compromise would be to offer to make the allowance against the lots for the full amount provided the road was completed by a certain fixed date, say November, 1992. This would give Mr. Hostetter an incentive and reduce that by $1,000 each month for every month over the fixed date. C. Cooperrider felt that there is a need for flexibility. C. Cooperrider reiterated that the Board ,has a role with regard to permitting aspect of that roadway construction if it does come to pass, especially in terms of working with the Conservation Commission to make sure the pewits go through smoothly_ . We will work as hard as we can to facilitate what you folks agree upon, so long as its reasonable. He asked R. Cooperrider stated that the problem was that the Board is being asked to release lots that are under covenant so that Mr. O'Connell can sell the lots. The Board should have a recorded statement of conditions to go with the approval.. It will state specifically conditions to be record and noted reference on the plan with respect to these two lots in question saying that no building permit will be issued until the driveways have been constructed in conformance with the subdivision control rules and regulations set forth right in statement of conditions, whatever S. Seymour referenced. Reference his letter and also DPW standards that enforce the part of the building permit process. The Board needs specific standards given to us as to what S. Seymour expects to be done to that driveway so someone can go out and inspect it and say yes it has been done it is perfect and that is just what we want. J. Etsten stated that a note can be placed in the file. The quickest way handle this is to have Mr. O'Connell, if he is agreeable, to have that note that you have just officially dictated, if he would have his engineer put it on the plan and then have a covenant prepared which reflects that condition and the lots that S. Seymour has enumerated because the Board has a slightly different list. C. Cooperrider stated that the Board should issue a covenant and a statement of conditions. Mr. O'Connell stated that if the Board puts the lots under covenant obviously, he can't sell them until the Board releases them. The driveway can't be built until the house is built. He stated that both he and S. Seymour worked very hard to get this language just right for the Board. He intends to put this right on the deed anyway. He doesn't want the responsibility for the private way either. The deed will state this on both those two lots, that it is a private way to be constructed and maintained and forever private. C. Cooperrider stated that the only problem that he can see is that he wants Mr. O'Connell to be responsible for doing those driveways, not the homeowner. Dear Mr. Hostetter: In regard to the Whistleberry subdivision that we previously spoke about, I have visited and inspected this site for the purpose of evaluation and cost estimate of installing approximately two thousand(2000) feet of eight(8)inch water main. My findings are as follows. About eight hundred(800) feet of this construction project lies directly adjacent to a low lying operational cranberry bog. This low elevation and the bog itself will present a problem in construction due to excessive groundwater infiltration and will require the use of at least two backhoes and additional pumps to lay the pipe. This in turn would make this portion of the project extremely labor intensive. A fire hydrant would also be required in this area. Due to the groundwater situation, a self draining fire hydrant would not be acceptable as it would constitute a cross connection within the water distribution system and also would not be able to properly drain. A raise in the elevation of this eight hundred(800) foot portion of road,of about five(5) feet,would be required to alleviate the groundwater problem. The other twelve hundred(1200) feet of water main does not seem to present a problem as far as installation goes. The cost of installing water main for the entire project, considering all of the difficulties involved, would be approximately $ 78,978.00 . This price would be for installation of the water main and related construction plus materials and labor. Please be advised that I consider this estimate to be on the conservative side. I am opposed to this project.Berry Hollow Rd has been a problem not only between the residents of Whistleberry and the developer but with those aforementioned groups and my property line abutting Berry Hollow Rd.With regard to that an agreement was concluded between the various town agencies,the developer,The State DEP and myself.A copy of this is included.The result of this legal agreement stipulates that no further work is to be done on the road in question except for minimal maintenance.In addition to the above the water level is very close to the surface of the road. Please see Steve Seymour's letter to that effect(included).I have previously communicated with your office about this matter on 11-5-95. I understand from speaking to the board at the last public meeting that there is the possibility of groundwater testing taking place. I would like to know who the company is that will be performing the test, and what the test parameters are(how and where the specimen is taken etc....).In addition I believe that the test results should be made public. Since I have had quite a problem with Berry Hollow Rd and my property line I am informing you that we have filed a Notice of Intention To Prevent Acquisition of Easement By Custom.These property line problems have been partly the fault of the Town of Barnstable.Currently the Whistleberry Development is using a piece of my property without my permission.This is obviously a separate matter. However,any further action authorized by the town that adversely impacts my property line in any way s shape or form will be dealt with legally.My attorney in this matter is Duane Landreth of LaTanzi, Spaulding and Landreth. You would have to Uncover the basims and rnake them operable if approval is not received from the regulatory agencies for the change. The reason for the change is the high groundwater that was observed in the field. The lea&iing basins are nearly full of water. It is only 2' from the grate down to the water table. The leaching basins will not operate very effectively if they are submerged in the water table. But more importantly the grounctwater quality will be enhanced if the road ri-inoff is infiltrated through the vegetated swale rather then being injected directly lr:to the groundwater table. Mr.Williams stated to me that the project-could be done in the price range which is stated in my June 2nd letter and the laying of water main in ground water would not present that difficult of a problem. Therefore,the road would not have to be raised 5 feet as stated in Mr.O'Donnell's letter of April29, 1997,nor would there be a problem with a cross-connection with the fire hydrant in the ground water.. A hydrant without drains could be installed or,since there are no homes alongside the bog,a fire hydrant could be installed before or after the love lying area of the cranberry bog. The situation on this road is of a unique nature. As you know it is part of a development that seems to have snuck into being while no one was watching. It i is ill placed and the residents claim that much of it is not up to subdivision standard. Because of this the residents have clamored for years to have this problems fixed. According to the residents one of these "problems" has been the need to provide town water to the lots on this road. This matter itself raise's some environmental questions. As you know, the question of town water is a matter of contention between myself and the residents of this road. And it seems that this matter has not been settled. I'd like to point out that if more houses are added to this road the "clamor" will just increase as more people move in. It seems logical to me that before any more housing is added the question of water needs to be settled. With this in mind I would like you to consider to suspend either temporarily or permanently the well permit for that remaining lot. This is a unique situation which calls for a unique approach to settle it. Otherwise the question of water for these lots will drag on for years as each new resident moves into this neighborhood, and f �s they will continually raise these same tired old questions. Please consider suspending or permanently revoking this permit until the issue of town water is settled. I have previously communicated with your office about this matter on 11-5-95. I understand from speaking to the board at the last public meeting that there is the possibility of groundwater testing taking place. I would like to know who the company is that will be performing the test, and what the test parameters are(how and where the specimen is taken etc....).In addition I believe that the test results should be made public. Since I have had quite a problem with Berry Hollow Rd and my property line I am informing you that we have filed a Notice of Intention To Prevent Acquisition of Easement By Custom.These property line problems have been partly the fault of the Town of Barnstable.Currently the Whistleberry Development is using a piece of my property without my permission.This is obviously a separate matter. However,any further action authorized by the town that adversely impacts my property line in any way � t shape or form will be dealt with legally.My attorney in this matter is Duane Landreth of LaTanzi, Spaulding and Landreth. The memorandum states "the installation of public water on Berry Hollow Drive was not agreed upon by the Planning Board and the developer when the scope of improvements was developed. The (Planning) Board has advised the developer to apply for a waiver of the requirement for public water, which he did not do, although apparently a subsequent developer did obtain a waiver from this requirement." Ms. Etsten further states "(Berry Hollow Drive) is very long, several thousand feet, and in part close to a cranberry bog with high groundwater. Furthermore, water should have been installed prior to reconstruction of the road up the hill. To excavate the extremely steep road shoulders would be a major undertaking. The (Planning) Board, for these reasons has been reluctant to require the installation of public water 15 years after the installation of private wells." Also, please see attached letter from Donald Rugg, Superintendent of the Centerville- Osterville-Marstons Mills Water Department which states one "would have to extend the water main approximately 2,000 feet at a cost of$50,000. To answer your question in your letter which was "does a variance have to be applied for before construction of new houses begin?" The answer is "yes" . For example, the Board of Health recently granted a variance to Jacques Morin to construct a well at Lot 78 Berry Hollow Drive, Marstons Mills. The memorandum states "the installation of public water on Berry Hollow Drive was not agreed upon by the Planning Board and the developer when the scope of improvements was developed. The (Planning) Board has advised the developer to apply for a waiver of the requirement for public water, which he did not do, although apparently a subsequent developer did obtain a waiver from this requirement." Ms. Etsten further states "(Berry Hollow Drive) is very long, several thousand feet, and in part close to a cranberry bog with high groundwater. Furthermore, water should have been installed prior to reconstruction of the road up the hill. To excavate the extremely steep road shoulders would be a major undertaking. The (Planning) Board, for these reasons has been reluctant to require the installation of public water 15 years after the installation of private wells." Also, please see attached letter from Donald Rugg, Superintendent of the Centerville- Osterville-Marstons Mills Water Department which states one "would have to extend the water main approximately 2,000 feet at a cost of$50,000. To answer your question in your letter which was "does a variance have to be applied for before construction of new houses begin?" The answer is "yes" . For example, the Board of Health recently granted a variance to Jacques Morin to construct a well at Lot 78 Berry Hollow Drive, Marstons Mills. The Board of Health is currently investigating this matter. To answer your question"how can more houses be built on Berry Hollow Road when this part of Whistleberry is not up to code?", pleased be advised that every applicant has the legal right to request a variance from the Board of Health. Variances may be granted if the applicant can prove that (1) enforcement thereof would cause manifest injustice and (2)the same degree of environmental/public health protection can be achieved without strict adherence to a particular provision of a Board of Health Regulation or State Environmental Code. For example, if well water analysis by a certified laboratory reveals that the sample meets drinking water standards, the Board of Health could grant the applicant a variance to install a private well on a parcel of less than 40,000 square feet or grant a variance to install a well less than 150 feet from a leaching facility. The next Board of Health meeting will be held on December 5, 1995 at 7:00 p.m., at the Town Hall Hearing Room, 367 Main Street Hyannis. Board of Health meetings are held the first and third Tuesdays of each month. All Board of Health meetings are open to the public. Dear Mr. Mckean: I am an abutter to Berry Hollow Rd which is part of the Whistleberry development. I understand that this road does not meet the standards(code)the Town requires for access to a development. Having suffered through my neighbors attempts to fix their problem over the last several years, I come to you with some questions that need to be answered before further development can continue. The road is not of the proper size and there is no town water leading to the four lots that are on the Berry Hollow Rd. Also this road is over the maximum length for a dead end road. There are two lots that are currently for sale by a building company and I wonder how they can be sold as part of this development. Since the residents of Berry Hollow Rd have raised the issue of safety, in terms of rescue equipment accessing the lots, as well as the question of water quality, how can permits to build more houses on Berry Hollow Rd be issued until these matters are .jt resolved? �f Town water to these lots is going to be a problem as well. Berry Hollow Rd, between stations#4 and#8 is only two feet (a fact that can be corroborated by Steve Seymour, Town Engineering Dept.) above the water level. Finally, a dispute arose between myself and Whistleberry over this road regarding my property line and other environmental matters. It was eventually settled through the State Dept. of Environmental Protection Office of General Counsel. Please refer to file no. 5E-8-2589, Docket no. 93-093. This legal agreement specifies that no work be done on Berry Hollow Rd between Station#4 and Station#8. My lawyer Roger O'Day can supply you with further information on this if you desire it. Furthermore I formally request that you inform me if this matter comes before your Dept. for discussion. If there are any meetings either public or private I would like to be aware of them with the opportunity to attend. Since I commute off Cape to work and cannot get my mail (at my post office box)until the weekend I would appreciate either a call, fax or E-mail informing me of any pending discussion. I stand ready, at your convenience, to answer any questions on this matter that you would like to ask me.
