The applicant further agrees that if the definitive plan is approved, applicant will promptly at any time thereafter when requested so to do by the Board, convey to the sewer District in form satis- factory to the Board, title to sewers and the prescribed easements therefor. (a) The applicant further agrees that before final approval of the definitive plan, the applicant will cause to be filed with the Board a bond in form satisfactory to the Board, conditioned on the completion of all required improvements in the time and manner prescribed, in a penal sum sufficient, in the opinion of the Board, to cover the cost of such work, and executed by the ap- plicant as principal and a surety .company authorized to do business in the Commonwealth and satisfactory to the Board as surety, or secured by the deposit with the Town Treasurer of cash or negotiable securities in an amount equal to the penal sum established by the Board. OR (b) The applicant requests the Board to approve the definitive plan on condition that no lot in the subdivision shall be sold and no building shall be erected or placed on any lot until the re- quired improvements necessary to adequately serve such lot have been completed to the Satis- faction of the Board. 10. The permission is granted with the following conditions: (1) The applicant must obtain a well construction permit from the Health Department. office. Prior to the issuance of a well construction permit, an engineered plan must be submitted showing the location of the proposed well at least 150 feet from the onsite sewage disposal system. (2) Prior to the issuance of a disposal works construction permit, the well must be installed and the water must be tested bacteriologically, chemically, for purgeable hydrocarbons, purgeable aromatics, petroleum hydrocarbons and for pesticides. The water must meet all the standards of the Safe Drinking Act of 1974, ammended 1986. (3) The dwelling must be connected to Town water when/if the remaining lots in the subdivision are constructed upon. This permission is granted because the applicant explained it would be a severe hardship to connect to the Town water system at this time because the nearest water line is located further than 1000 feet from the property. Leonard, on a par- cel of land located off Race Lane in Marstons Mills com- prising 3 buildable lots and having a right of way known as "Drumble Lane" . I am writing to ask that lot #2 be released from the requirement that it be supplied with Town water. My circumstances are thus : Mr. Leonard and I entered into an agreement in which I, as owner of Lot #2 would assume part of the cost of constructing the roadway and Mr. Leonard the remainder. At the time we made these arrangements and began to proceed with getting subdivision approval, Town water was not an issue as the nearest main wasffirthar than I,000 feet from the property and we would not have been required to tie:rinto it. We, in fact .had never considered this to be in any way a commercial proposition, .intending to build houses for ourselves, and to live in them. However, because of business reasons Mr. Leonard is not in a position to assume any of the costs of road con- stucton. I wish to proceed with constructing a :hame fnr myself, but upon learning the extreme cost of installing Town water find it would be a severe hardship fdr mel I would be unable to build for many more years at the very least.
