This site visit was conducted with your newly hired Hazardous Materials Specialist, Cynthia Martin. As has been the case in working with the staff at Peck's, they were very cooperative. They have been consistent in contacting me with questions regarding their "checklist" that I gave them (and Cc'd you) on November 2, 2007. Since this second site visit, they have completed the Chapter 108 "requirement list" for their facility. Because they have not had a documented Hazardous Materials Site Inspection or Inventory Site Visit since 2000, 1 would like to emphasize that Pecks' Boats, Inc. completed this list without routine compliance assistance over the years. This means they accomplished an extensive list of changes at their facility in a short amount of time and they should be recognized for this. Their intent has been to fully comply with Chapter 108; and at this point, Pecks' Boats, Inc. has made the necessary adjustments at their facility to fully comply with this ordinance. Throughout this process, they have demonstrated good communication and proactive decision making to make their site/facility as environmentally friendly as possible. Requirement: The Materials Safety Data Sheets (MSDS) must be made available upon request of the Health Department or Fire Department. �l As we discussed, please acquire an MSDS sheet for each individual chemical product used/stored/disposed of at your facility and store these in an easily accessible location. �l Review these annually and make sure these are up to date., Recommendations: • Review an MSDS sheet once a year with your staff to familiarize yourself with the emergency response procedures and health risks of the chemicals used/stored/disposed of at this facility. Recommend improving waste transfer/disposal records retention. Waste disposal is infrequent, but should be recorded to prevent liability. Section 108-5. Storage Controls. Requirement: �l Some containers seen onsite and outdoors were not product-tight or protected from the elements. Please store all hazardous materials containers indoors on an impervious, chemical resistant surface (i.e. no dirt floor storage). Please correct the "open containers" of hazardous materials storage. These should be product tight lids/covers, not covers made of plastic wrap, foil or any type of loose fitting cover. �l Provisions should be made to contain the waste oil (around the waste oil storage tank) in the case of an accidental release. �l Please provide more spill prevention in the form of spill kit absorbent and pads at the waste oil tank. The saturated cardboard in this storage room is inadequate for spill containment/clean up. �l Please provide a spill clean up kit in the work shop (where Kevin is located) to ensure proper response to spills in this area. Recommendations: �l When using approved containers for different chemical product storage, please clearly label all hazardous materials storage containers with the name of the chemical product and "Hazardous Material." Please post "No Smoking" signs where flammable chemical products are used. �l Please post "Hazardous Materials" warning signs in concentrated areas of hazardous materials storage. �l Consider posting signs that indicate when something is non toxic, such as the vegetable oil storage areas. �l Keep all chemicals/fuels in proper storage locations. Box 359 Co-tuit , MA 02635 NOTICE TO ABATE VIOLATIONS On Wednesday , February 12 , 1991 , Donna Miorandi , Health Inspector and Dale Saad, Coastal Health Resource Coordinator, for the Town of Barnstable, performed an on site inspection with Lt . Glenn Wilcox of the C-O-MM Fire Department at your .facility known as Peck's Boat Yard , located at 3800 Falmouth Road, Marston -5 Mills . While on site the following violations were observed: ARTICLE XXXI.X= CONTROL OF TOXIC AND HAZARDOUS MATERIALS. The Board of Health require : that containers of toxic or hazardous materials be stored on an impervious , chemical resistant surface compatible with the material being stored, and that provisions be made to contain the product in case of accidental spillage . Outdoor storage of tonic or hazardous materials is prohibited, except in product-tight containers which are protected from the elements , leakage, accidental damage and vandalism, and which are stored in accordance with all applicable requirements of Section 5 of this bylaw. There are 55 gallon druiis stored on site (some of which are open and much evidence of spillage) that are stored in sheds but on the ground floor. There is also a 300 gallon fuel oil tank on the ground with a shallow bermed area around this tank with much spillage of product . Resting on the 300 gallon tank are two 55 gallon drums of fuel oil/kerosene and on top of that a 20 gallon container of same . Al en-e-nators recauixud_ ts_ me , new accumulation area standards_ Above-ground tanks and containers must be on a surface which does not Have any cracks or gaps and is impervious to the Hazardous wastes being stored. An outdoor area must have secondary containment, such as a berm or dike, which will. hold 1.0% of: the total volume of the containers or 110% of the volume of the largest container, whichever is larger, in the event of a spill or leak . Indoor and outdoor :accumulation areas must be clearly separate from places where waste is generated, must be secured against unauthorized entry and ported with a "HAZARDOUS WASTE" sign. MASSACHUSETTS HAZARDOUS WASTE REGULATION: 310 CMR 30.680, 30.690. Each container and tank must be clearly and visibly labelled throughout the period of accumulation with the following : -the words "HAZARDOUS WASTE" -the name of the waste (e . g . , waste oil , acetone) -the type of hazard ( s) (e .g . , ignitable, toxic, dangerous when wet, corrosive) -date on which the accumulation began. Each container must be in good condition . The drums were unlabelled as indicated above and some of them exhibit advanced stages of corrsosion . You are reminded that you must have all wastes properly disposed of and manifested. You must Have on site copies of all your manifests as well as copies of all the Material Safety Data Sheets (MSDS) for all your chemicals on site . The MSDS sheets can be obtained from your suppliers . You are directed to correct these violations within five ( 5) days of receipt of this notice .
