(a) The applicant further agrees that before final approval of the definitive plan, the applicant will cause to be filed with the Board a bond in form satisfactory to the Board, conditioned on the completion of all required improvements in the time and manner prescribed, in a penal sum sufficient, in the opinion of the Board, to cover the cost of such work, and executed by the ap- plicant as principal and a surety company authorised to do business in the Commonwealth and satisfactory to the Board as surety, or secured by the deposit with the Town Treasurer of cash or negotiable securities in an amount equal to the penal sum established by the Board. The developer shall have recorded on the deed that no variances from Title 5, Minimum Requirements for the subsurface Disposal of Sanitary Sewage, and the Town of Barnstable Health Regulations will be granted on any lot in this subdivision.
