On 19 February, 1985, (Attachment A) Chip Millen sent a memo to your office addressing, among other concerns , the need to assert our ownership of land abutting the herring run which was deeded to the Town in 1880 by a David Jones (Attachment B) . You will notice that this deed is very vague in that the boundaries are undefined, stating only that the town owns the Herring Run, enough land to maintain the Run and deposit the spoils from keeping the run clear, and passage to and from this area through this parcel . Natural 'Resources discovered this deed while doing the background research for anticipated maintenance of the Run .but. as a by-product also discovered that the lots on the. northern edge of the Run were drawn as including the edge of the Run to the center- line (Attachment C, lines along run do not appear on original plan) . Recommendations were made in that original memo as to suggestions on how wide a strip would be appropriate to adequately maintain the run and other activities listed in the deed. My major reason for writing this memo is to emphas.ize Chip Millen 's original , request that Town Counsel investigate the deed and do whatever is deemed necessary to reclaim the property that is rightfully owned by the Town. The urgency of this is even more great because on 21 October, 1985, the owner of .the property abutting the Run opposite Whistleberry subdivision has filed a preliminary plan (Attachment D) and you;�will notice that the lot lines are also drawn to the centerline on the Run. As a point of information, the attorney for the buyer was informed by Natural Resources of the existence of this deed before the parcel changed hands , but this information was obviously disregarded when the lots were drawn. Given that the Town is devoting its time and energies these -days toward acquisitions , it seems to me appropriate to spend some time preserving what we already own. The Town engineers have surveyed the• run and we have consulted with the Mass . Division of Marine Fisheries Herring Run. Construction Crew. . The Construction Crew has viewed the run and is considering doing . the construction . At their request this department started to conduct a records search to find out when the run was constructed and what types of easements the Town might .have. We found that in 1880 the Town purchased the land to construct and maintain the herring run . We also found that the parcels along the Northern edge of . the run " Whistleberry Development" claim the center of -the run as property lines . it is our request that the Town investigate the deed and do what is needed to reclaim the Herring Run property. We suggest that an area 20 ' from the center line or 15 ' from the top of the bank is what was and is .needed for the "convenient construction and maintaining of said run" (Book 143 page 334 ) . This department would also like to pursue the possibility of obtaining all or part of Assessors Map, 61 lot 10 13. 5 Ac . from .Indian Lakes Realty either as a conservation gift or by taking .
