Dear Neighbors
This letter is explain that we have a hearing scheduled with the Town of Barnstable
Board of Health on Sept.6, 2005 at Town Hall 7pm. This hearing is the results
of our desire to install a new septic system on the property and to locate the system
as far away from the edge of the Pond. Thus we are asking for a variance from the Rules
of the Board of Health , and they are included here.
We did receive permission from the Conservation Commission also included.

Dear Mr. Doyle,
You are granted a conditional variance on behalf of your client, Larson Realty
Company, to construct a replacement onsite sewage disposal system at 276
Lakeside Drive, Marstons Mills.
The variance granted is as follows:
Section 360 -1 of the Town of Barnstable Code: The soil absorption sytem will
be located seventy-five (75) feet away from a wetland.
Section 360 -1 of the Town of Barnstable Code: The septic tank will be
located fifty-eight (58) feet away from a wetland.
Section 360 -1 of the Town of Barnstable Code: The soil absorption sytem will
be located seventy-five (75) feet away from a wetland.
310 CMR 15.211 M The soil absorption system will be located four (4) feet
away from the foundation wall (crawl space), in lieu of the ten (10) feet
minimum separation distance required.
This variance is granted with the following conditions:
(1) No more than two (2) bedrooms are authorized at this property.
(2) The applicant shall record a properly worded deed restriction, signed
by the property owner, at the Registry of Deeds restricting the number
of bedrooms at this property to two, before the applicant obtains a
disposal works construction permit.

(3) The engineering plans shall be revised to show the leaching trenches
at lower elevation than the foundation (Note: Rectified- Revised plans

This variance is granted because the physical constraints at the site severely
restrict the location of the soil absorption system due to it's proximity to a wetland
and due to the small size of the lot. This proposal appears to meet the maximum
feasible compliance stardards contained within the State Environmental Code
Title V.
