Development Trust u/d/t dated March 1-6, 1998 recorded in the
Barnstable County Registry of Deeds in Book 11286, page 227 of P .O.
Box 2021, Cotuit, MA 02635 is the owner of Lots 3, 4, and 6 located
on Links Lane, Mazstons Mills, Massachusetts (hereinafter referred
to as "Berke" ) and being shown on a plan entitled "Definitive
Plan' -of Subdivision ##764 Located In: Marsttaons MillsCou.nt

WHEREAS, Fitzpatrick Home Building Company, Inc . of P.O . Box
154, Forestdals, MA. 02644 is the owner of Lots 1, 2 , and 5 located
an Links Lane, Marstons Mills, Massachusetts (hereinafter referred
to as "Fitzpatrick") and being shown on a plan entitled
" 'Definitive Plan' of Subdivision $#764 Located In: Marstons Mills,
MA. Applicant ; Robert Berke" being recorded in the Barnstable
County Registry of Deeds in Plan Book 541, Page 96 ;
WHEREAS, Berke and Fitzpatrick as the owners of said lots have
agreed with the Town of Barnstable Board of Health to a restriction
as to the number of bedrooms which can be included in homes built
on said lots as a pre-condition to obtain bui.ldIng permits for
these lots;
WHEREAS, the Town of Barnstable Board of Health, as a Pre-
condition to authorizing the issuance of building permits for the
construction of single family homes on these lots is requiring that;
the agreement for the restriction on the number of bedrooms for
each lot in the above-referenced subdivision be put: on record with
the Barnstable County Registry of Deeds by recording this document,
NOW, THEREFORE, Berke and Fitzpatrick hereby place the
following restriction on their above-referenced land in accordance
with their agreement with the Town of Barnstable Board of Health,
which restriction shall run with the land and be binding upon all
successors in title:
1 Lots 1, 2 , and 6 may have constructed upon each lot a
house containing no more than three (3) bedrooms and Lots 3 , 4 , and
