April 16, 1998 Mr. Francis Murphy 1310 Osterville West Barnstable Road Marstons Mills, MA 02648 ORDER TO ABATE VIOLATIONS OF TOWN OF BARNSTABLE STABLE REGULATIONS ADOPTED 4/1/72 BECAME EFFECTIVE 4/12/72 REVISED 7/15/93 On Tuesday, April 7, 1998 and on Thursday April 9, 1998, Health Inspector Edward Barry inspected your horse stable located at 333 Race Lane (a/k/a 1310 Osterville- West Barnstable Road)Marstons Mills, listed as parcel 14 on Assessor's Map 126, because of a complaint. i On both dates, Mr. Barry observed an accumulation of manure on this property which is in violation of paragraph seven (7) of the Town of Barnstable Board of Health Stable Regulations. This regulation specifically states "owners of stables housing, horses or ponies must clean the manure from the stable at least once each day. Waste matter shall be disposed of in a sanitary manner and shall not be accumulated on the property." On April 7, 1998 and again on April 9, 1998, Health Inspector Edward Barry observed an area approximately twenty (20) feet by five (5) feet by two feet deep of accumulated manure waste on top of the ground adjacent to Osterville West-Barnstable Road. You stated that you are attempting to build-up the elevation of the ground in that area to the same elevation as the road. However, the manure was not mixed with any soil or odor-reducing material such as Lyme. At this time, you have the option to: (a)Remove all of the manure and dispose of it in a sanitary manner within 48 hours of your receipt of this order letter, or (b) You shall mix all of the accumulated manure with an odor-reducing material such as Lyme and with soil on a daily basis for a temporary period of time,until, but not to exceed, the date of May 31, 1998. However, if you choose option "b" above, we wish to make it clear to you that this method of buildin-a-up your land must then cease and desist after May 31, 1998. After that time, you must dispose of the manure in a sanitary manner and shall not allow the manure to accumulate on your property. You may request a hearing before the Board of Health if written petition requesting same is received within seven (7) days after the date the order is served. This letter which is signed by the agent of the Board of Health, Thomas McKean, shall constitute as an order of the Board of Health. Failure to comply with an order of the Board of Health will result in the penalties described in the Town of Barnstable Stable Regulations. It is my opinion that the owner when they resided there and now the rental tenants are in constant violation of conditions one and two of the variance letter. First of all tenant stockpiled manure on the grounds(see recent photograph)and secondly there is insufficient drainage causing mud and pudd ling in the paddock/ coral/ pasture area.There is great concern about mosquito infestation (especially considering the Mass. Deadly virus alert in mosquitoes recently reported in the newspapers). Also the Board of Health I believe has required the property owner to relocate the coral fence fifteen feet back from Barnstable town owned land and this has not been done. The property is only .62 of an acre I believe and on such a small piece of property I feel it is inhumane to cram horses in such a small area. To see them tromping around in the mud and dust with no grass, I have many friends who comment that they feel sorry for the animals. This is no place to house horses. Variance demands are disregarded and the noise disturbs the piece and lowers the value of my property. I have owned the property since 1982 and it was always peaceful and quiet and I feel it should go back to this way. The stables are extremely close to my bedroom window, and the noise in the morning is very disturbing. The property has less than% of an acre,yet the new tenant told we she intends to stable four or more horses when she purchases it. The following is a list of complaints: one of which is why a variance should not be given to allow horses on the property when the new owners purchase it. First the owner stated there would be only one horse and he had five,so he was breaking the variance. Now,the new tenant who intends to purchase the property, states she intends to-place four horses on the premises. One of the present horses kicks the side of the stable in the night time(not as much as the previous horse but plenty enough to keep us awake). Horse dung and saw dust is piled in a 20 foot around and four feet high pile that is partially on my property. The smell is very strong at times. In addition,the moving,feeding, slamming the horse trailer doors and haying keeps me awake. In fact all the noises and smells related to housing horses on such a small piece of property is grounds I feel for not allowing a variance. Finally,the loud yelling of commands to the horses in the early morning hours might be okay on a large ranch, but is terrible on property less than%acres. As if that were not enough,the tenant operates a trucking business and houses an eighteen(18)wheeler type tractor trailer truck which is started between three and five a.m.daily. It is loud,and smells of diesel fuel. We are not discussing a pick.-up truck or a small diesel,so I feel this matter is quite serious and it should be studied and changed in the town ordinances . I have addressed the town of Barnstable regarding this matter. I have owned my property for 20 years with a peaceful quiet setting and now my neighbor is destroying the peace and making my property value decrease. The tenant(soon to be owner) has two dogs that bark starting at 5t45 every morning. At that time her harsh voice starts yelling"shut up"I I constantly loose sleep as a result of this matter and the smells and fumes and horse dung is intolerable. It seems inconceivable to allow either a new variance to house horses on this property or a huge tractor trailer truck.. Whitty, Director of Assessing DATE: April 16, 1998 RE: Murphy Property, 333 Race Lane,Marstons Mills(126-014) Ralph, I have been asked by Mr. Francis Murphy to review and try to explain the discrepancy that exists in the land area amount of one and one-half(1.50)acres that's stated on his deed and the 77/100 acres the town is currently assessing him for. Mr. Murphy expressed a strong feeling that at the time his wives family acquired the property the land area was close to being 1.5 acres, and in later years was reduced through land takings by the town. Without doing extensive research I'm not in a position to refute his claim, nor support it. It does,however, appear very likely that there have been takings at various times to widen the road and rebuild the intersection,how much is difficult to determine. In an attempt to re-scale the property to include land that's now part of the intersection, it appears the property at one time may have exceeded one acre (I scaled it to be 1.03 acres). As far as the taking(s)to widening the road,keep in mind the .77 acres existed as far back as 1970 when the tax maps were first printed. I would have to assume, but, again not positive,that the .77 acres already includes an adjusted for road widening. Try as I may, I cannot reconstruct the parcel to reflect the 1.5 acres. This is not surprising, often times old deed descriptions are only approximate, but generally not by this wide a margin. The following is a list of complaints why I object to the boarding of horses on this p vpertY= First there was not V horse,there were five horses. One of the horses often kicked the stall,on$nd off, all night long. I had to call the police on several occasions to complain. Horse dung was piled three to five feet high and my property often smelled deeply of.how.manure, especially on humid days. Furthermore the horses would nay. constantly. Also the heavy trucks that would be started early in he morning and left to idle close to my bedroom window waking me. In fact.ail the noises:gelated to housing horses on such a small piece of property so close to another dwelling:i8 inappropriate. There were loud yelling to command the horses to move into the trucks or the stalls or coral and the clanging of foetal gates shutting they barked day and nright;,vhenever they were outside. Our children were members of their Paddock Pals 4-H Club. The Densmores had their ponies and calf in a small outbuilding out by Race Lane. The back of their land was fenced for paddocks. In 1970, 1 learned of a two car garage in Hyannis that had to be moved. Jack Densmore bought that garage and Bob Hayden moved it to 333 Race Larne. Jack built the (six) stalls, moved the horses, cow, pigs and chickens into it and tore down the two outbuildings which were eyesores and unsafe. Debbie gave lessons to kids who could not afford lessons. Jack and Debbie ran different 4-H clubs for ten years. They taught the kids good horse management and revolved their lives around their two kids and all their 4-H'-nrs. Debbie continues to own the property and had her own horses there until she remarried. Since then, she leased the barn to horse people on temporary situations. It was transferred to Deborah Densmore-Murphy in 1989 who retains ownership with her husband, Francis. The Densmores purchased this property for their family use, so they could have their show horses and champion ponies at home. There were two outbuildings on the property in addition to the dwelling. They used the bigger shed to stable their four equines until 1970. All the additional land on the race lane side was fenced as turn out for the horses. In 1970, the Densmores purchased, and had Robert Hayden move, a 24' x 24' two-car garage to expressly stable their five show ponies. There were six stalls in the barn. The garage has always been used as a barn. The Densmores used one stall for their cow, to raise as a 4-H project and another small area for pigs and hens in addition to their horses. The Densmores were 4-H leaders in four individual clubs. They were members of the Barnstable County Agricultural Society and the Cape Cod Trail Riders for ten years. Mrs. Densmore-Murphy had horses and/or ponies on this property until 1993 when she decided to board her last show horse with her trainer, since she married and resided in Kingston, Massachusetts and leased her property. i The barn has been used on a temporary basis for six to seven months a year to different horse owners, among them were Harry Aalto, Jane Burke and Nancy Klepser - all residents of Barnstable. .Jack Densmore was a member of the Ad Hoc Committee formed in 1972 r: with Paul Brown, Jane Esbaugh, Gerald Hurd, Frank Correira, myself and others to develop stable regulations for the Town of Barnstable.
