Barnicle, PWS, an ENSR wetland scientist, conducted a second field inspection of Wetland A located at the site to determine if it met the definition of a vegetated wetland pursuant to the Barnstable Wetlands Protection By-law (Article 27). According to the Bylaw, vegetated wetlands are defined as "Any area of at least 500 square feet where surface or ground water, or ice, at or near the surface of the ground support a plant community dominated (at least 50 percent) by wetland species." Wetland A is an isolated vegetated wetland and was delineated with pink flags consecutively numbered from Al to A8. This wetland is vegetated with American holly (Ilex opaca), red maple (Ater rubrum), black gum (Nyssa sylvatica), inkberry (Ilex glabra), and cinnamon fern (Osmunda cinnamomea). The uplands are vegetated with scarlet oak (Quercus coccinea), white oak (Q. alba) and American holly. Wetland A did exhibit redoximorphic (hydric) soil features and surface hydrology (i.e., stained leaves, standing water). The majority of the vegetation observed in Wetland A is the American holly which is indicated as FACU (facultative upland) as identified by the US Fish and Wildlife Service National List of Plant Species that Occur in Wetlands: Massachusetts (1988, updated August 1995). The FACU category definition is as follows: "Usually occur in nonwetlands (estimated probability 67%-99%), but occasionally found in wetlands (estimated probability 1%-33%). An assessment of the plant community was performed in Wetland A in accordance with the guidelines provided in the Massachusetts Department of Environmental Protection (DEP) document entitled Delineating Bordering Vegetated Wetlands Under the Massachusetts !Wetland Protection Act (1995). Vegetation is determined to be upland or wetland based on :he "dominance test". The vegetation dominance test results are shown on the attached form. According to our assessment (see attached), Wetland A is comprised of only 35 percent wetland vegetation. Based on the Bylaw definition for a vegetated wetland, it is our opinion that Wetland A does not meet the 50 percent vegetation criteria.
