Prior to issuance of a certificate of compliance and occupancy permit for Lot 7, the designing engineer must supervise con- struction and grading and submit certification, in writing, that the system was installed in strict accordance with --his plan. Town of Barnstable Health regulations, -in--addition to --310 CMR 15.00 The State Environmental---Code -.Title 5- must be--- met.- The wells must be installed and the water tested for potability prior to issuance of a sewage permit. Wait, RLS THIS ORDER IS ISSUED ON December 19, 1979 THIS ORDER SUPERSEDES ANY PRIOR ORDERS REGULATING WORK AT THE PROJECT SITE Pursuant to the authority of G.L. Ch. 131, S. 40, the BARNSTABLE CONSERVATION COMMIS- SION has considered your Notice of Intent and plans submitted therewith, and has determined that the area on which the proposed work is to be done is significant to one or more of the interests described in the said Act. The BARNSTABLE CONSERVATION COMMISSION hereby orders that the following conditions are necessary to protect said interests and all work shall be performed in strict accordance with them and with the Notice of Intent and plans identified above except where such plans are modified by said conditions. CONDITIONS: 1. Failure to comply with all conditions stated herein, and with all related statutes and other regula- tory measures, shall be deemed cause to revoke or modify this Order. 2. This Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state, or local statutes, ordinances, by-laws and/or regulations. 4. The work authorized hereunder shall be completed within one (1) year from the date of this Order unless it is for a maintenance dredging project subject to Section 5 (9). The Order may be extended by the issuing authority for one or more additional one-year periods upon application - to the said issuing authority at least thirty (30) days prior to the expiration date of the Order or its extension. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or debris, including, without limiting the generality of the foregoing: lumber, bricks, plaster, wire, lath, paper, tires, ashes, refrigerators, motor vehicles or parts of any of the fore- going. 6. No work may be commenced until all appeal periods have elapsed from the Order of the Con- servation Commission or from a final Order by the Department of Environmental Quality En- gineering. ' 7. No work shall be undertaken until the Final Order, with respect to the proposed project, has been recorded in the Registry of Deeds for the District in which the land is located within the chain of title of the affected property. The Document number indicating such recording shall be submitted on the form at the end of this order to the issuer of this Order prior to commence- ment of work. 8. A sign shall be displayed at the site not less than two square feet or more than three square feet bearing the words: "Massachusetts Department of Environmental Quality Engineering. Number _St,_-3_-.543._(Ai� and a copy of this Order shall be available at the site. 9. Where the Department of Environmental Quality Engineering is requested to make a determin- ation and to issue a superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearin;*s before the Department. 10. Prior to any work being done at the site, all legal advertising bills incurred by the petitioner in relation to the Wetlands Hearing held on this project shall be paid. 11. Notice shall be given to the Barnstable Conservation Commission or Conservation Officer no more than two weeks nor less than two days prior to the commencement of the work. N/A 12. Shellfish shall be removed from the work/dredge areas prior to construction under the direc- tion of the Barnstable Natural Resource Officer, at the applicant's expense. N/A 13. Dredging may NOT be done between June 1st and Sept. 1st of any calendar year. Dredge spoils are to be disposed of _._.........._..._......................._._._.......-_....._.._....__...._._......._.._......_._......._.-.. 14. Excavated material is to be disposed of away from banks. 15. Temporary retaining walls are to be used to prevent erosion during construction. 16. All disturbed areas are to be revegetated following construction. Areas stripped of vegetation during construction may NOT be left unvegetated or unmulched for more than 60 days, unless other. erosion control measures have been provided for herein. 17. There shall be maintained a buffer strip of natural vegetation _.._..___....___............._, feet in width around all wetlands and water bodies shown on the plan. Selective limbing may be allowed within the buffer strip to allow for a view. 18. There is to be no alteration of the naturally-occurring vegetation beyond the 96 foot contour for Lot 8; and the 94 foot contour on Lot 7. 19. The project shall not reduce the flood storage capacity of any Nvetland, water course, or water body. 20. Septic system is to conform with Town of Barnstable Board of Health Regulations and Title V, unless specifically ordered otherwise herein. 21. Immediately following completion, the project shall be certified to be'as per these conditions and plans, in writing, to the Barnstable Conservation Commission by the project _-.Engineer_ who shall be registered in the state of Mass. MA 02601 Re: Barnstable - Sewage - Lots 7 & 8,, Pond Ne'adow Drive, Marstons Mills, Mass. (Job #79-529) Gentlemen: In a letter from your Board, dated September 209 19?99 variances to install septic systems on the subject lots were granted under certain conditions. After a filing was made to the Barnstable Conservation Commission, it was determined that the edge of the wetland as delineated on the original plans was improper. The location of the edge of the wetland was taken from the original lot sub- division,plan. Since that time, the lots have been re- surveyed and the edge of the wetland has been accurately located as shown on the attached revised plans dated November 13, 1979. You will note that the size and location of the proposed dwellings, as well as the locations of the proposed sewage systems, have been altered, which necessitates a refiling with your Board. We, therefore, again request variances from the Town Regulations for the following setback distances: 1. The proposed sewage system on Lot 7 is 78 feet from the edge of the bog, and on Lot 8 is ?5 feet from the edge of the bog. 2. The proposed system on Lot ? is 110 feet from the proposed well on said lot and the system on Lot 8 is 112 feet from the proposed well on said lot. (Job #79—S29) Gentlemen: In a letter to your Board dated November 14, 19?9, E. J. Flynn Engineers, Inc. requested variances from the Town Regulations for certain setback distances. As a result of a telephone conversation with Mr. John Kelley on December 5, 1979, this letter is submitted to clarify the requirement of providing 10010 reserve area for the proposed leaching facilities. Reserve areas for both Lots 7 & 8, sufficient to replace the capacity of the original leaching areas, can be located between and to the west of the proposed primary leaching trenches, and a 75-f oot distance between the ,leaching system and the wetland can still be maintained. There is no dispute with.the fact that they do indeed o�ae the taxes on. these lots, however the .reason for this is .that since these.lots were approved as building lots in 1973, Bay Colony has. been unable to obtain building- permits on them for a variety of reasons, not the least of tahich is the constant change of Board:of: Health Regulations. Without going into legal. dissert_a-. tier, suffice it to say that Bay Colony has dealt with the Toum in good faith. in developing.these lots, but the Town, through the Board of Health, 'has refused to grant permits on the lots because the regulations in effect sub- sequent to the Plan approval have made these lot P PP s unbualdable without: vax- iance, which the Town has.been unwilling to grant® We have legal. precedent which states that without a.change: in- the natty e and characteristic of the land..itself, .the Board should be bound by the regulations which were in effect at the time of Plan approval. For then to do otherwise is an effective taking without ca pensation, .for they have, by their regulations rendered the land useless to the owners. This is for— bidden, by the U.S. Constitution, as you, no doubt, are well aware. 'My client has not proceeded on these grounds because to do so.requires heavy legal expenses, which they are unable at present to bear. I realize that yo-a. as Collector of Taxes, are bound by statute to carry out your .duties, but Bay Colony has tried, without success, to deal with the Tbwn on-an above-board basis, and has met with continued opposition to all of their proposals to obtain permits. For these reasons they have taken. the only avenue open: to then without involvingall `e in parties a costly legal .battle, that is they have refused to pay taxes on building lots, when as.such.,, the lots are worthless. But be advised that, upon institution of the Town of any taking or sale by Publication, we shall go into court and seek to have the Town enjoined from taking any. such action until such time as the town udll either issue permits or declare the land as agricultural, to remain in its natural state. The agreement was that there may be more problems, other than the singular problem of whether the 100-foot set back requirement applied or the 75-foot requirement applied. After the meeting I contacted William.Weller, the Surveyor and Engineer in charge of the project, and discussed the matters with him. He assured me that there was not a problem other than the 100-foot requirement . Also, as I .pointed out, my meeting with you was not to request a variance, but rather to discuss the Boardas feelings regarding the property. On behalf of my clients we are now formally request- ing a variance, and would like to meet with the Board at their next meeting . Kindly inform me and Cape Cod Survey Consultants as to the time when-ewe may meet . Hamblin Wakeby Road Marstons Mills, Mass. 02648 Sir: Thank you for your letter dated September 9, 1972 relative to Bay Colony Developers,. Inc. on a subdivision on River Road and Newtown Road, Marstons Mills. Unless all peat and mud are taken out and replaced with good solid fill and compacted, we would consider the outside ditch as the basic wetlands edge. No septic system would be allowed less than 75 feet from that point -- three times the State requirement. At this time, we would not consider any of the filled lands buildable because of the mixture of peat and mud with the sand. The groundwater height is figured at the highest known water level. If all septic systems are installed in strict accordance with Article XI of the State Sanitary Code and Town Regulations, it would appear unlikely that pollution would occur in the pond or ditches. The eo nverst&anaf wetlands into house lots is controlled by the Wetlands Committee of the Conservation Commission and Department of Natural Resources, and, it appears that they should have a stronger law. The fill from the, excavation was; deposited on the bog and Ito the south of the pond upon the upland 4* shore of the boggy This has, rai&d the grade of the bog and joined it to the upland. - Most of this excavated material is: a mud peat soil. How much of this "new" 'upland .is buildable land? Since the height of standing water is controlled by flume boards anal rain- fall, what is the official height of the water? There is a, good possibility of stagnation because the plans do not seem to provide for the natural flow of those water courses to the west of said proposed pond and there seems to be no replacement for the exiiting springs at the site that will be disturbed. However, the Commissioner finds that in order to protect public or private water supply, ground Water supply and insure proper, flood control, the following conditions are necessary, and�all work must be per- in strict conformance therewith. Therefore, the said Commissioner issues this permit, and upon the record- ing thereof in the appropriate Registry of Deeds, work may commence. CONDITIONS 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this permit. 2. The provisions of G.L. cc. 91 and 111, and any regulations adopted thereunder, must be fully complied with. 3. This permit does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 4. This permit does not relieve the permittee or any other person of the necessity of complying with all other applicable federal, state, or local statutes, ordinances, by-laws and/or regulations. 5. The work authorized hereunder shall be completed within one (1) year from the date of this�• permit. A one ,.: (1) year extension of this period may be obtained by the submission .of plans to the Commissioner of Nat. r ural Resources which indicate the remaining work to be performed. If said work is not completed within the initial one (1) year period, or the one (1) year extension thereof, the permittee, or his successors or assigns must apply for a new permit pursuant to G.L. c. 131 §40, provided, however, that all conditions imposed herein shall remain in full force and effect. 6. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or de- bris, including, without limiting the generality of the foregoing, lumber, bricks, plaster, wire, lath, paper, a' cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any,of the foregoing. 7. All construction must conform, unless otherwise herein so staged, with the plan submitted entitled this plan to be used for reference only - received with the applicants notice of intent dated March 13, 1972, Director, Division of Conservation Services. , 8. "Person, s used herein, means a coration, individual or other legal entity. ,' - Section 3 3.0. 11,ithout having a permit as hereinafter provided, it shall be unlawful for any person: LL (a) To or lace deposit J Pany debris, fill or other materials, including structures, in any Wetlands or Waters, r41 or to make any alteration of any land within 50 feet of Y� Wetlands or Waters or of any lands contiguous to said Vet— lands or Waters which may cause such a placing or deposit. (b) To di dred a or in an other wa g� g , y y alter or remove any material from said Wetlands or i;aters which will cause any alteration in their natural condition. (c ) To cause by any means, any sewage, insecticides or. poison or any affluent contaminated by any sewage, insecticides or poison to enter or flow into any of said Wetlands or haters, whether the same be by surface or sub-surface action or seep- a3, age or otherwise . (d) To prevent or interfere with the common-law right of residents of this town to fish and fowl in the area which lies between low water mark and high water mark on any tidal waters within the town, including rivers, estuaries and streams. Section 4 4. 0. any person or corporation desiring the said permit shall file with the Town Clerk an origina cation, which shall set forth: l and six copies of a written appli- (a) Specific information as to what the applicant proposes j to do. (b) A description of the area the applicant proposes to do such things in. (c ) The purpose of the acts which the applicant proposes to do. (d) The names and addresses of all owners of land abutting on the area where the proposed operations will take place. 4. 1 . Whenever such an application is filed, the Town Clerk shall within six days do the following things : (a) Transmit a. copy of the application to the town officers Of th-e following boards - namely, the Board of Selectmen, the Planning Board, the Board of Health, the Conservation Commission and the Board of Appeals. r (b) Send a notice to each of the owners of property abutt_j.-,c 1 A` (Bylaws for Cape Co owns) --3 on the area which: is the subject of the application. (c) Publish in a newspaper with general circulation within the town that such an application has been filed and that said application is available for inspection by residents of the town. 4. 2. The Board of Appeals of the town shall determine whether or not the permit sbught by any applicant shall be granted. Before any permit is so granted: (a) The Board of .i,ppeals shall receive the recommendations and advice of the Board of Selectmen, the Planning Board, the Board of health and the Conservation Commission. (b) The Board of Appeals shall hold a public hearing, after giving the residents of the town notice thereof, which shall be published once during each of three successive weeks in a news- paper of general circulation within the town. R 403. The Board of Appeals shall not grant any permit unless it finds affirmatively that the acts permitted thereby will not adversely effect and will not threaten to adversely affect the health, safety, o::. the -general welfare of the residents and future residents of the town; and in making such finding, the Board of Appeals shall be guided by criteria embodied herein. 4.4. The Board of !Appeals may in each case either grant or deny without condition a permit sought by the applicant, or may grant the r' permit subject to such conditions a.s it may find necessary to .accomplis'. the purposes of this bylaw. In any case, the Board of Appeals shall make a written decision which states the basis therefor. 4. 5. One of the said conditions which the Board of j.ppeals may a : require is the posting of a performance bond in an adequate amount to insure that the acts which are permitted to be done shall be performed in the way they are permitted to be performed. fi t _ Section 5 f 5 . 0. �Iithin 20 days after a decision of the Board of Appeals has been made which approves the issuance of a permit, the town and/or any resident of the town may appeal said decision to any court having ap- propriate jurisdiction. 5. 1 . l;itl:in 20 d.iys after a permit is denied or approved with conditions unacceptable to the a_��plicant, the applicant may appeal the decision to any court laving appropriate jurisdiction, and the town and/or any resident of the town may appear in opl;osition to the appli- ca.nt Section 6 f . � 6.0. All bylaws in conflict herewith are hereby repealed. (Bylaws for Cape Co owns) . --4 r Section 7 \` 7.0. Any person who violates any provision of this bylaw shall be guilty of an offense and, upon conviction thereof, be punishable by a - fine up to ';p'1 ,000 and imprisonment up to 30 days. 7. 1 . Each day of such violation shall constitute a separate of- fense under this bylaw, provided the alleged violator has been thereto- for duly notified by the Town Counsel, on instructions from the Board of Selectmen, or the Board .of Appeals, that he is acting in violation of this bylaw. 7.2. In the event any person shall continue any violation beyond the time limit specified in said notice, the Board of Selectmen or the f Board of Appeals shall direct the Town CoL�nsel to apply to the Superio-- Court of the County of Barnstable for an order directing t'.ie violation be corrected or removed and all expenses incurred by the town in con- nection with the proceedings, including the actual cost of correction - or removal , shall be assessed against the offender. 1. 3 . Any person who violates the provisions of this bylaw shall be liable to the town and/or any resident of the town for any expense or loss or damage caused to the person wio seeks to establish such lia,- bility by reason of t.iis violation. Section 8 R4 8.0. The invalidity of any clause or part of this bylaw shall no- affect the validity of any other part thereof which c::�.n be given effec without such invalid clause or part. Section 9 9.0.
