We feel some background information is necessary to explain a little of the history and details of the project, hence this permits cover letter. The Barnstable Conservation Commission issued an Amended Order of Conditions on November 30, 1987, approving the construction of a wood pile and timber pier (among other things) on Lot 2 (Assessors Map 76 Lot 65) off Prince Avenue, Marstons Mills. The state has subsequently issued a license (#2005 ) to allow construction of this pier. This pier was never x constructed. Mr. Kuhn is proposing to move this ®/ approved pier to Lot 1 and extend it approximately 50' to obtain deeper water for his 38 ' long, 4 ' draft sailboat. Due to prevailing southwest winds, he would tie off with the bow facing into the wind, and hence the deeper water (at the 5 ' contour) is necessary to accommodate the keel. The only moorings displaced would be his own and a friend 's (Murphy mooring) , who uses it for his whaler, and would in the future use Mr. Kuhn' s pier for access to his boat. His neighbor's mooring will be 44 ' from his proposed pilings and the distance from his neighbor' s proposed pier to Mr. Kuhn's is now 831 . There will be no structures of any kind allowed on the Barnstable Conservation Foundation parcel. According to Mr. Kuhn, he has never seen sailboats tacking in the area of the proposed pier. It is also estimated that the channel will be 60 ' from the end of the proposed pier, which allows unimpeded passage for boats travelling to and from the town dock. In attendance: Ann Jane Eshbaugh, Chairman, Susan G. Rask and Joseph C. Snow, M.D., members. Also present was Thomas McKean, Director of Public Health and Barbara Sullivan, Office Assistant. i Jane Eshbaugh called the meeting to order at 7:00 P.M. i First on the agenda, Attorney Michael Ford was present to request multiple variances from Title V of the State Environmental Code and Town of Barnstable Health Regulation, ' i for the installation of an onsite sewage disposal system at Lot 2, Prince Avenue, Marstons Mills, listed as parcel 6B on Assessor's map 76. Arne Ojala, Down Cape Engineering, gave some data to the Board concerning the coastal bank. Mr. Ojala stated there is no evidence fof erosion due to tidal action. The toe of the bank is subject to only the rise and fall of the tide, and not littoral currents normally associated with the open coast. A salt marsh is in existence along the toe of the bank, which is an indication of its stability. Mr. Ojala further stated that the septic system upgrade as shown on the plan will never be affected in any way by the coastal environment during the useful life of the system. After some i discussion. Joseph Snow made a motion to explain the reasons for granting the additional i variances where there was an existing house, a cesspool which there had been a demand i that the septic system be upgraded, if this were a new construction these variances would � I not be appropriate but under the circumstances it appears that they are. The motion was seconded by Susan Rask, the Board voted unanimously to approve the motion. Regulation 15.03 (7) - To allow for no separation distance from the leaching facility to the property line in lieu of the required ten (10) feet. Regulation 15.03 (7) - To allow for no separation distance from the reserve leaching facility to the property line in lieu of the required 10 feet. Regulation 15.03 (7) - To allow the separation distance from the garage to the septic tank to be reduced to 6.11 feet in lieu of the required ten (10) feet. To allow the distance from the leaching facility to the top of the coastal bank to be reduced to 38 feet in lieu of 100 feet as required by the Town of Barnstable Health Regulations. To allow the distance from the leaching facility to the mean high water mark to be reduced to 84 feet in lieu of 100 feet as required by the Town of Barnstable Health Regulation. To allow the distance to the reserve leaching facility to the mean high water mark to be reduced to 82 feet in lieu of the required 100 feet. The following conditions apply: (1) The septic system must be installed in strict accordance to the plan dated November 22, 1988 revised July 31, 1990. (2) The designing engineer must be onsite and supervise construction of the sewage disposal system and certify in i writing to the Board that his design has been strictly adhered to. (3) It shall be recorded on the deed that the septic tank shall be pumped annually and written certification submitted to the Board by a licensed septage hauler. The dwelling is presently under construction. On March 30, 1989, the Board of Health granted the previous owner, Christopher Kuhn, conditional variances to construct a septic system on this site. Condition #4 states "the dwelling cannot have more than two (2) bedrooms. Sewing rooms, dens, lofts, enclosed porches, study rooms, finished cellars, and similar type rooms are considered bedrooms according to the Department of Environmental Quality Engineering (now DEP) . Therefore, the garage cannot contain a second floor storage' room. " During construction of the dwelling on October 6 1993, Health Inspector Jerome Dunning observed an isolated room on the top floor of this dwelling which did not appear on the submitted floor plans reviewed by the Board of Health in 1989. This room is greater than 100 square feet in size, it's ceiling height is greater than seven feet three inches, it's wired for electricity, ventilation is provided, and at least one window is provided. (4) According to the EPA/WPC Project No. 625042402 Grant A2plication 66.418 CONSTRUCTION GRANTS FOR WASTEWATER TREATMENT WORKS CONSTRUCTION PHASE, dated June 1988 special grant condition #22 signed by the Town of Barnstable on May 31, 1988, any wastewater effluent pumped from septic systems connected to a building, facility, or other manner of construction which is erected or otherwise placed, in whole or in part upon land which is defined as a wetland or floodplain, cannot be disposed at the Wastewater Treatment Plant located in Hyannis. Therefore, the applicant shall furnish the Board a copy of a contract with a licensed septage hauler indicating where the wastewater effluent (which is to be pumped from the septic tank on an annual basis) will be disposed of. (5) The dwelling cannot have more than two (2) bedrooms. Sewing rooms, dens, lofts, enclosed porches, study rooms, finished cellars, and similar type rooms are considered bedrooms according to the Department of Environmental Quality Engineering. These variances were granted because there was a two (2) bedroom cottage at this site, which was destroyed by fire. The cottage was connected to a cesspool which is in all probability, sitting in groundwater and contributing to the pollution of the marsh.
