Summary: Granted with Conditions Petitioner: Edward A.Thew&Alberta J.Thew Property Address: 982 Route 149,Marstons Mills,MA Assessor's Map/Parceh Map 102,Parcel 005 Zoning: Residence F Zoning District Relief Requested &Background: In Appeal 2006-59 the Applicants sought to use two parcels of land for seasonal boat storage of up to 42 boats. The appeal for a Special Permit was made pursuant to Section 240-94.A Change of a Nonconforming Use to Another Nonconforming Use and Section 240-94.13 Expansion of a Preexisting Nonconforming Use,proposing to change and expand an existing nonconforming use of the land from that of contractor's storage to that of seasonal boat storage of a maximum of 42 boats. Initially the locus was comprised of two lots addressed 976 and 982 Route 149,Marstons Mills,MA, Assessor's Parcels 5 and 6 of Map 102. However during the public hearing on the application,Parcel 6,the 4.44=acre undeveloped lot was removed from the application and relief that sought to expand the preexisting nonconforming use(Section 240-94.13)was eliminated by the applicant. The single lot,Parcel 5 is a 2.59-acre lot developed with a four bedroom, one-story, single-family dwelling of 1,440 sq.ft., and a 320 sq.ft. shed structure. The proposed site plan submtted shows both of the parcels, however the layout for boat storage is accommodated fully on Parcel 5. That layout shows 42 boats varying from 8 to 30 feet in length proposed storage plan. Two graveled driveways are shown as access to the storage area. The first driveway is over the 40 foot panhandle to Route 149 and the second is on the neighboring lot, 998 Route-149. The site plan submitted was reviewed by the Site Plan Review Committee. On May 24, 2006 a Site Plan approval letter was issued subject to additional requirements that included; assurance that the work is completed as per plan, access to and within the site be maintained,containment for gasoline spillage be provided, installation of on-site water main and fire hydrant and,the requirement that all permits and licenses be secured. FILE COPY I Procedural&Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on May 24, 2006. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened July 12,2006, at which time the Board found to grant the special permit only for a change of a nonconforming use to another nonconforming use and only to the one lot addressed as 982 Route 149,Marstons Mills,MA and subject to all conditions herein. Board Members deciding this appeal were,Ron S. Jansson,Randolph Childs,James R. Hatfield, Sheila Geiler, and Chairman,Gail C. Nightingale. Attorney John R. Alger represented the applicants. He stated that his presentation would be for that Special Permit relief sought only for a Change of a Nonconforming Use to Another Nonconforming Use pursuant to Section 240-94.A and only for one of the cited lots, 982 Route 149,Marstons Mills,MA(Assessor's Map 102,parcel 5). The other requested relief,that being for an Expansion of a Preexisting Nonconforming Use(Section 240- 94.B),and the second lot, Expansion of a Preexisting Nonconforming Use,for 976 Route 149,Marstons Mills,MA,Assessor's Parcels 6 of Map 102,is being withdrawn from the application. Mr. Alger cited the history of the property,noting that the Thew family first purchased this particular land in 1934 and that it had been used from that time forward as a contractor's yard, including storage of materials and machinery. It was noted that in those early years heavy machinery was kept on the parcel. That machinery was used in excavation and site preparation for building. Over the years,the contracting use was more limited only to wood framing and wood work. The machinery was removed and storage kept to a minimum. , In 1991,the younger Edward Thew went to work at the Oyster Harbors Marine. Given the need for boat storage,he initiated seasonal storage on the property. No issue was raised until 2004, 13 years after the boat storage was initiated,that the Building Division questioned the use and its conformity to zoning. Mr. Alger noted that the Site Plan Review process was initiated and it has taken this long to secure that finding by that committee that the plan was approvable upon the granting of relief from the Zoning Board of Appeals. He presented the proposed plan for the boat storage noting that the buffering vegetation would be retained. Addressing groundwater, he citied the distances from this site to the nearest public wells,wetlands and neighboring ponds. He stated that there would be no work on any boat on this site. They would be delivered from the boatyard shrink wrapped. There would be no activity at this site other than storage of the boats from September to April or May only. It would be seasonal only and not year round. Mr. Alger further stated that the adjacent Lot 6, the 4.44-acre lot owned by the Thew's would be kept as it now is and not used or disturbed, therefore, adding additional buffer for abutting residences. Mr. Alger and the Board discussed the issues of groundwater protection, fuel within the boat tanks and safety hazards. Mr. Craig Curtis of Oyster Harbors Marina clarified concerns for fuel within the tanks noting that most fuel can be drained from the boat tanks, however a small quantity.always remains within the lines and tank itself. Mr. Alger stated that the Applicant has committed to satisfying all requirements of the Centerville Osterville,Marstons Mills Fire Department and Water Department and all other requirements from the site plan review committee. Mr. Alger addressed the five questions posed by Precinct 10,Town Councilor,Ms Janice L.Barton, 58 Gooseberry Lane,Marstons Mills in her letter submitted to the Board that evening. 2 c Mr. Alger addressed each of the requirements for the special permit as itemized in Section 240-94 for a change in a nonconforming use to another nonconforming use citing that no approval of the Board of Health is necessary. The proposed nonconforming use requires no parking, generates no traffic except for the seasonal in and out of the boats, generates no noise, dust, or odor,does not result in an increase in the hours of operation or tenants or employees, and is not to expand. Public comment was requested. Speaking in opposition were Philip B. Thibeau of 85 Knowlton Lane,Ms. Barbara C. Hill of 26 Lakeside Drive who is also a member of the Historic Commission who cited that there has never been a contractors use of the property from 1968 forward. Clifford O. Noreen, 98 Lakeside, Sally Hutchinson Burk, 16 Lakeside,Debora Palmer, 102 Roseland Terrace, also spoke in opposition. In favor of granting the special permit were Mr. Al Baker,Marstons Mills and Alexander B.Trakimas 68 Lakeside Drive. The Chairman noted that a petition has been submitted in opposition to granting of the relief. That petition cited the two lots and included the expansion of the nonconforming use. Those two issues were now removed from the application. The petition was signed by 58 persons. Letters favoring the grant of the special permit from;Barbara W.Fuller, 995 Cotuit Road, Carolyn Garbutt, Marstons Mills,Joseph S. Brown,60 Indian Pond Point,Coren&Jeff Peacock, 1024 Cotuit Road,and Ronald L Beals and Lillian C. Beals, 64 Rose Land Terrace, were entered into the file. Letters in opposition from: Barbara C. Hill, Sally Hutchinson Burke, and Herbert F. Clark and Alice M. Clark, owners of 38 Lakeside Drive, were entered into the file. Findings of Fact: At the hearing of July 12,2006,the Board unanimously made the following findings of fact: 1. Appeal 2006-059 is now seeking a Special Permit pursuant to Section 240-94.A Change of a Nonconforming Use to Another Nonconforming Use for 1 lot only. That lot being parcel 5 as shown on Assessor's Map 102. That property is owned by Edward A. Thew and Alberta J. Thew and is commonly addressed 982 Route 149,Marstons Mills,MA, It is zoned Residence F and in a Groundwater Protection Overlay Zoning Districts. 2. The applicants are seeking to change a preexisting nonconforming use of the lot as a contractor's storage area to that of seasonal boat storage of up to 42 boats. 3. A plan has been submitted for the layout for boat storage to accommodate 42 boats varying from 8 to 30 feet in length. Although the plan depicts two lots, all of the boat storage is located on Lot 5, the existing developed lot. This permit if issued shall be issued only to the one lot now developed and shown on that plan as Parcel 5 of Assessor's Map 102. 4. The applicants have substantiated that the one lot,parcel 5 of Assessor's Map 102,has been in continuous use for business purposes predating 1950. The subject lot is being used in conjunction with the Thew's family business which is a contractor/builder. Originally it included excavation. The lot was used to store materials,contractor's supplies,machinery and trucks. That use of the property is no longer permitted in this district as it is a single-family zoning district. This use of this lot is a"legally created preexisting nonconforming use"and the applicants would have that right to apply for the special permit. 3 5. More recently, the applicant has permitted the seasonal storage of boats on the lot. However,that use of the property is illegal as it constitutes a change in the use and should not have been implemented without permission from this Board. Today that is the relief the applicant is seeking-to change the use of the property from a contractors' storage to that of seasonal storage. 6. The applicants have been before the Site Plan Review Committee and received an approval of the plan subject to conditions and the granting of this Special Permit. Seasonal storage of all 42 boats, 8 feet to 30 feet in length, is located only on Parcel 5 shown on the approved plan.. 7. The applicants have indicated that they are willing to not currently develop Parcel 6 of Assessor' Map 102, a land locked lot. They have offered to currently retain that lot in vegetation so that a natural buffer to the boat storage area is maintained. 8. The lot is in a Ground Water Protection Overly Zoning District,but it is approximately 6000 feet up gradient of the Cotuit Well, approximately 900 feet from wetlands, approximately 1500 from Hamblin's Pond,and approximately 1600 feet from Shubel's Pond. 9. The applicants have indicated that they will restrict the use to seasonal storage only,September through May only. The maximum number of stored boats will not exceed 42. The applicants have addressed the criteria for the granting of the special permit pursuant to Section 240-94.A. In doing so, the boat storage use is no more detrimental than the previous legal nonconforming use. Activity on the site will be very minimal. There will be no additional traffic,no work taking place on the lot,no signage, and adequate screening. 10. This application falls within a category specifically excepted in the ordinance for a grant of a Special Permit. After evaluation of all the evidence presented,the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected provided certain restrictions are imposed and fully adhered to. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the Special Permit for the seasonal storage boats on Parcel 5 of Assessor's Map 102 subject to full compliance with all of the following conditions: 1. Development of the site which is restricted to Parcel 5 of Assessor's Map 102 only shall be as proposed in a plan entitled"Site Plan of Land Located at 976 &982 Route 149,Marstons Mills,MA prepared for Edward Thew"dated October 31,2005, last revised April 27, 2006,by Yankee Survey Consultants. Again this relief and nonconfo....ing use shall only be on the lot addressed as Parcel 5, 982 Route 149, Marstons Mills,MA All proposed site work must comply with this plan including that site access over the neighboring lot addressed 998 Route 149 and that access within the site. 2. The number of boats stored on the property shall be limited coley to seasonal storage of no more than 42 at any one time,not to excel 30 foot in length. All shall be on Lot 5 only and not on any other lot. Storage shall only be seasonal storage from September 1" to May 30`h only. All boats shall arrive shrink wrapped to the site. Maintenance or repair of the boats while on the property is strictly prohibited. 3. Prior to storage of any boat on the property, as much gasoline as possible and practical shall be drained from the tank of every boat stored on the lot. In addition the applicants shall provide for containment of 4 potential gasoline spillage satisfactory to the Centerville Osterville Marstons Mills (COMM)Fire Department. 4. An on-site hydrant connected to the existing water main in Route 149 shall be provided by the applicants. This hydrant and its water service line shall be located,designed and installed in full compliance with all requirements of the COMM Water District and the COMM Fire Department before any boats are moved onto the property. An easement to COMM Water District and the Fire Department for this hydrant and water line shall be designated and gifted from the owner to COMM. 5. A natural vegetative buffer of not less that 35 feet shall be maintained around the storage area. Parcel 6, which is the land locked parcel owned by the applicants and addressed as 976 Route 149, shall remain as vegetated and not stripped during the life time of this permit in order to assure screening to the boat storage on Lot 5. 6. The applicants shall be required to maintain the access drives to the boat storage in passable conditions at all time,including snow plowing when necessary especially including access to the fire hydrant. 7. No night lighting shall be installed on the property and there shall be no business signage permitted. 8. All other permits and licenses as required shall be obtained before the use is allowed on the property. 9. Annual inspections by the Fire Department as well as the Building Commissioners Office shall be made to assure compliance with all conditions and that proper access has been maintained. 10. The Building Commissioner shall have the right at any time to inspect the property for full compliance with this decision. Violation of any condition shall be reason for the Commissioner to request a show cause hearing to revoke this decision. 11. The nonconforming use of the site(Lot 5) for contactors storage shall cease upon executing this permit as no more that one nonconforming use is permitted to exist on the lot. 12. This special permit is non-transferable. It shall run with the owner. Upon the owner transferring the property this permit shall expire unless further allowed to continue by this Board.
