Mills.It was brought to our attention that a complaint was made concerning the amount of brush and
debris that has acc=mAaed on this property. We are well aware of the concerns of the Health
Dgmtn ent and have made numerous attempts over the past 7 Weeks to rent a vehicle to.expedite the -
removal of all excess brush and debris. Our failure to acquire the necessary equipumm should not
indicate that we are unwilling to comply with your offices request.We are oonfident that within the na¢
two months this situation will be resolved Thank you for your patience.

Dear Mr. Hansen:
This letter is in reference to the sign which you have posted in front of the above referenced
address. I had spoken with you previously in regards to what you must do to be in compliance
with local zoning ordinances and issued you a warning on December 5, 2003. You were informed
by myself that failure to comply would result in fines for each day of non-compliance.
Subsequently, the sign was removed and compliance achieved. However, on March 15,2004,it
was noted that the sign was once again in place and again is in violation with local zoning
ordinances. This letter shall serve as notice that fines will be levied in the amount of$100.00 for
March 15, 2004 and each day following that the violation is observed. I may be contacted at(508)
862-4034 with any questions you may have regarding this issue.

The property owned by you, located at 28 Santuit-Newtown Road, Marstons Mills was
inspected on February 22, 2006 by Town of Barnstable Health Inspector David W.
Stanton, R.S:, because-of a complaint.
The following violation of the Town of Barnstable Board Code was observed:
353-1 Responsibilities of Owners: Several large piles of rubbish were observed on
your property.' The rubbish included stumps,tree branches, building material waste, etc.
Enclosed please find a copy of the Town of Barnstable Code, Chapter 353: Nuisances.
It is noted that you have been warned several times in the past for this same violation, and
issued several non-criminal citations. Also enclosed is a copy of"Open Burning: Answers
to Your Burning Questions" from DER It states you may not burn stumps or waste from
commercial clearing, which I have highlighted for your convenience. It is noted that
some of this wood is going to be used for fire wood, which is allowed, however, the
stumps and building material waste are not allowed to be burned.
You are directed to remove the rubbish from your property and dispose of it
properly within 14 days of your receipt of this notice.
You may request a hearing before the Board of Health if written petition requesting same
is received within ten(10) days after the date the order is served.
Failure to comply with an order will resultin a fine of$100.00. Each day's failure to comply

ARTICLE 1 Storage of Garbage and Refuse [Adopted 5-21-1980; revised 8-24-1999, effective 9-2-1999

§353-1. Responsibilities of owners and occupants.
The occupant of any building used for business or habitation shall be responsible for maintaining in a clean and sanitary condition
and free of garbage, rubbish, other filth or causes.of sickness in that part of the building and outside area which.he occupies or
controls. The owner of any building, vacant or otherwise, or parcel of land shall be responsible for maintaining such building or
land in'a clean and sanitary condition, free from garbage, rubbish, or other refuse.
§353-2.Storage of garbage and rubbish.
Garbage, or mixed garbage and rubbish, shall be stored in watertight receptacles with tight-fitting covers. Said receptacles and
covers shall be constructed of metal or other durable, rodentproof material.
§$53-3. Definitions.
As used in this chapter, the following.terms shall have the meanings indicated:
GARBAGE—The animal, vegetable, or other organic waste resulting from the handling, preparing, cooking, consumption or
cultivation of food, and containers and cans which have contained food unless such containers and cans have been cleaned
or prepared for recycling.
RUBBISH—Combustible or noncombustible waste materials, except garbage, including but not limited to such material as
paper, rags, cartons, boxes,wood, bottles, plastic, rubber,.leather, tree branches, yard trimmings, grass clippings, tin cans,
metals, mineral matter, glass, crockery,dust, and residue from the burning of wood, coal, coke, and other combustible
materials.
§353-4. Minimum setback to abutting property line.
No person shall store any rubbish or garbage less than 10 feet away from an abutter's property line.Where compliance with this
provision is not possible due to existing physical constraints of the property, the refuse containers)shall be set back away from
the property line to the maximum separation distance feasible.

§353-5.Screening of refuse storage areas in other than single-family dwellings.
Storage of refuse from commercial buildings, lodging houses, multiple-family dwellings, municipal buildings and other business
establishments(excluding single-family dwellings) shall be as follows:All outdoor rubbish and garbage storage areas shall be
located in an area which is screened from the neighbor's view and from public view. Said screening maybe.in the form of
fencing, evergreen trees or other plants capable of providing year-round screening, located around the refuse storage area in
such a manner to block the view of the rubbish and garbage storage area from the neighbors and from other persons passing-by.
§353-6.Violations and penalties.
Any person in violation of this regulation may be fined $40.Any person who fails to comply with an order issued pursuant to this
regulatidn shall be fined $40. Each separate day's failure to comply with an order shall constitute a separate violation.

Still, there are times when open burning is the best or only option. Even
then, there are limits on what can be burned and when, as well as important public health

offer you suggestions on doing it right.
Why are there limits on open burning in Massachusetts?
The Department of Environmental Protection (MassDEP) and your local fire department
3 � limit open burning for public health and safety reasons. Open burning pollutes the air and
N 3 can make it difficult for people with respiratory problems to breathe. When the air is
stagnant, open burning can pose smoke and odor nuisances - and health risks - to nearby
residents, particularly in densely populated areas. Open burning can also pose a safety risk

What can be burned, when, and under what conditions?
You may burn, with limits: brush, cane, driftwood, forestry debris, tree prunings, dead
rasberry stalks, blueberry patches and infected beehives. You may not legally burn grass,
hay, leaves, stumps or tires.
In most of the state's towns and cities, homeowners are allowed to burn brush, cane,
driftwood and forestry debris - not including grass, hay, leaves or stumps 'between
January 15 and May 1, so long as the open burning takes place:
• with the permission of the local fire department;
• between the hours of 10 a.m. and 4 p.m.;
• when the air is circulating well but winds are light;
• no less than 75 feet away from all dwellings; and
• on your own property and as close as possible to the source of material(s) to be
burned,
Be sure to get a permit from your local fire department before burning anything.
Fungus-infected elmwood and other materials normally associated with agriculture and
agricultural land clearing - such as tree prunings, dead raspberry stalks, blueberry patches
for pruning purposes- and disease-infected beehives may also be burned with fire
department permission.
With the fire department's approval and supervision, a community may schedule:
• Christmas tree burning between December 26 and January 7 (although recycling
trees by chipping them into landscaping material or"planting" them in dunes to
control beach erosion are more beneficial to the environment);
• One ceremonial bonfire each year to observe a municipal, state or national event;
and
• A bonfire between July 2 and July 6 in observance of Independence Day.
Outdoor cooking is allowed year-round in all communities and is not subject to open
burning limits. With specific approval from MassDEP, local fire departments may also stage
outdoor fires for purposes of fire prevention or protection research and training. See

What types of open burning are not allowed? 1
There are no circumstances under which it is legal to burn grass, hay, leaves"-stumps or
tires. They simply do not burn as "cleanly" as those'materials that may legally be burned.
All of them produce acrid smoke that causes nuisance conditions and threatens people's
health. When tires are burned, they produce noxious gases and petroleum residue, both of
which can be harmful to people and the environment.
In addition, the burning of brush, cane, driftwood and forestry debris from commercial ord
industrial land clearing is prohibited statewide.
Are there any communities in which open burning is not allowed at
all?
Yes. Open burning is prohibited in 22 of the state's largest cities and towns due to the
:v density of population and close proximity of buildings within their borders: Arlington,
Belmont, Boston, Brookline, Cambridge, Chelsea, Chicopee, Everett, Fall River, Holyoke,
Lawrence, Lowell, Malden, Medford, New Bedford, Newton, Somerville, Springfield,
Waltham, Watertown, West Springfield, and Worcester.
Open Burning Guidelines
First things first:
• Contact your local fire department for information on obtaining an open burning
permit.
Starting the fire:
• Remove all grass from the area where you will be burning.
• Try to start the fire with natural "kindling" - never with gasoline or charcoal lighter
fluid. If you must use an artificial helper, kerosene is probably safest.
While burning:
• Never add brush that is green or wet. It will reduce the efficiency of the fire and
produce thick smoke.
• Someone must attend the fire until it's completely out. You will need a hose or
other supply of water and a shovel or rake for controlling the fire.
Putting the fire out:
• Burn the fire down to the coals, drown them with water, spread them out, then
drown them again.

It is noted that you have been warned several times in the past for this same violation, and
issued several non-criminal citations. Also enclosed is a copy of"Open Burning: Answers
to Your Burning Questions" from DER It states you may not burn stumps or waste from
commercial clearing, which I have highlighted for your convenience. It is noted that
some of this wood is going to be used for fire wood, which is allowed, however, the
stumps and building material waste are not allowed to be burned.
You are directed to remove the rubbish from your property and dispose of it
properly within 14 days of your receipt of this notice.
You may request a hearing before the Board of Health if written petition requesting same
is received within ten(10) days after the date the order is served.
Failure to comply with an order will result in a fine of$100.00. Each days failure to comply
with an order shall constitute a separate violation.

The property owned by you located at 28 Santuit-Newtown Rd., was inspected on Sep 10,
2003, by Donald Desmarais R.S., Health Inspector, because of a complaint.
The following violations of the Town of Barnstable Board of Health Regulations,
Nuisance Control Regulation No. 1 were observed:
Nuisance Control Restulation No. 1, Part VII, Section 1.00: Numerous piles of logs,
brush and rubbish.
You are directed to correct the violations within seven days of receipt of this order
letter.
