The variances granted are as follows: Section 360-1 of the Town of Barnstable Code: To install a septic tank 83 feet away from a coastal bank, in lieu of the minimum 100 feet separation distance required. Section 360-1 of the Town of Barnstable Code: To install a septic tank 50 feet away from a bordering vegetated wetland, in lieu of the minimum 100 feet separation distance required. These variances are granted with the following conditions: (1) No further expansion of the "beach house" is authorized in the future. No more than two (2) bedrooms maximum are allowed at the "beach house." (2) The, septic system' shall be installed in strict accordance with the revised engineered plans dated May 17, 2013. (3) The'designing engineer shall supervise .the construction of the onsite sewage disposal system and shall certify in writing to the Board of Health that the system wash installed in substantial compliance with the revised plans dated May 17, 2013. I (4) The innovative/alternative (I/A) system (PERC-RITE Drip Dispersal System) shall be designed, constructed, and maintained in compliance with the Renewal Certification for General Use Approval letter from the Massachusetts Department of Environmental Protection dated May 23, 2012. (6) Prior to commencement of construction of the PERC-RITE Drip Dispersal System and after recording and/or registering the Deed notice required by 310 CMR 15.287 (10), the System owner shall provide the Public Health Division Office a copy of the certified Registry copy of the Deed notice. These variances are granted because the proposed plan appears to meet all of the setback requirements and design standards contained within the State Environmental Code, Title 5. This property borders wetlands and the Marstons Mills River. The designing engineer designed the soil absorption system to be located further away from the wetlands outside of the 100 feet buffer. Please note,that the septic tank for guest house and the pump chamber have been relocated to a position southeasterly of the guest house. In this location, these two components are both more than 1 00' from all wetland resource areas except Land Subject to Coastal Storm Flowage (100 year flood plain). Thus, these components no longer require Variances from either Title 5 or from local septic systeih regulations. Further, the client has agreed to limit the number of bedrooms in the Beach House to two. This'is the number historically present in the building. Consequently, there will be no increase in flow from this building. The septic tank for this unit continues to require a local Variance of 17.2' from the down gradient side of the adjacent Coastal Bank Top; 82.8' being provided rather than the 100' required under Ch 360 Art I Sec 360-1. No Title 5 Variances are required for this tank. Enclosed, as promised, is one copy of documentation provided to the Barnstable Conservation Commission relative to the Beach House supporting the fact that it has always been used as a dwelling. As first constructed in 1966, it had one (1) bedroom. The 1973 addition provided a second bedroom. Mr. McKean believes that a Variance is required to install the system below the Top of the Coastal Bank. ' As you are aware 310 CMR 15.211(1) requires systems to be located so that the solid components are set back 25' and the SAS 50' from certain wetland resource areas. These include Bordering Vegetated Wetlands (BVW), salt marshes, and Inland and Coastal Banks. The regulation does not tell you whether to measure in a landward direction. However, that is the convention. To do otherwise would result in a system located in a resource area. More guidance is offered at 310 CMR 15.211(3) which states in pertinent part: "All set back distances from wetlands shall be measured in accordance with the criteria of the Wetlands Protection Act and 310 CMR 10.00, from the most landward edge of the following ' features . . . top of coastal bank as defined in 310 CMR 10.30(2)." The Conservation Commission is named as the arbiter in the event of a dispute as to the location of the Bank Top- Again, there is no direction _ on provided, however, to measure the setback toward the resource area provides a nonsensical result and convention has always been to measure landward of the resource area. ' 1 20 Rascally Rabbit Road Unit 3 508 420-9792 Marstons Mills,MA 02648 FAX 508 420-9795 ' The Conservation Commission has already granted an O-C for the septic system at this site and no questions were raised about the resource delineation during ' that review. The issue for this site is that there is a compound bank. That is, there is a low bank adjacent to the Prince Cove Estuary which confines normal tide events. Landward of that bank there is a relatively broad and relatively flat flood plain. Landward of the flood plain there is a secondary slope which is a Coastal Bank as defined by ' DEP Policy. The Top of the Coastal Bank for purposes of the Wetlands Protection Act and its Regulations is the first break in slope above the 100 year flood ' elevation where the slope becomes flatter than 1:4. In cases where there are compound banks with relatively broad shelves between ' the two sections of slope and where the shelf is only a floodplain but otherwise upland by vegetation and soils—the case for the subject site—DEP is in the habit of allowing development to occur on that shelf. The precedential case of such a permit in Barnstable is Eskandarian, SE3-3319. This site is in Osterville adjacent to the Centerville River. Here the Conservation Commission initially denied permission for a pool and its amenities. On appeal, however, DEP allowed the construction to proceed in the shelf between two sections of a compound bank; that is, below the absolute top of the Coastal Bank for the site. When this matter was discussed in the Committee rewriting Title 5 prior to the 1996 revisions, the concern with siting systems close to Coastal Banks was breakout, as is the case for any sloped surface. Consequently, a 50' setback from a Coastal Bank which, under 131/40, has a slope of 1:4 or steeper seemed reasonable to continue. The issue of bank stability for projects on or below a Coastal Bank is one for the Conservation Commission to rule on. As noted above, they have done so by giving the septic system construction a permissive Order of Conditions. ' . We have never requested a Variance under Title 5 for systems on the down slope side of a Coastal Bank. Ch 360-1 is also not specific as to from which direction the setback from wetlands should be measured. It does say that bordering vegetated wetlands are as defined at 310 CMR 15.002. The Coastal Bank definition at 310 CMR 15.002 refers you back to the definition of MGL 131 Sec 40 and 310 CMR 10.30(2). However, it goes on to say that a Coastal Bank is generally the "seaward face or side of any elevated landform". 2 ' For the subject site, the Coastal Bank adjacent to the SAS does not face the ocean or the estuary. The Top of that Coastal Bank is depicted on Sheet 2 of 2 of the ' approved septic design sheet, revised 8/24/12. The graphic is two dashes separated by one dot. Unfortunately, the label is not on that sheet. At its closest, the SAS appears to be set back 40' to the down gradient side of the Bank Top; the pump chamber is ±75' and the septic tank for the new guest house ±84' from the down gradient side of this Coastal Bank. It is our professional opinion that measuring in this way is not what was intended, however the decision is clearly the Board's to make. Should you believe. ' The SAS, as you can see, has been relocated to a position close to the main residence. General Conditions Under Massachusetts Wetlands Protection Act The following conditions are only applicable to Approved projects I. Failure to comply with all conditions stated herein,and with all related statutes and other regulatory measures,shall be deemed cause to revoke or modify this Order. 2. The Order does not grant any property rights or any exclusive privileges;it does not authorize any injury to private property or invasion of private tights. 3. This Order does no,relieve the permittee or any other person of necessity of complying with all other applicable federal, state,or local statutes,ordinances,bylaws,or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: a.the work is a maintenance dredging project as provided for in the Act;or b.the time for completion has been extended to a specified date more than three years,but less than five 1, years,from the date of issuance. If this Order is intended to be valid for more than three years,the, extension date and the special circumstances warranting the extended time period are set forth as a special condition in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. If this Order constitutes an Amended Order of Conditions,this Amended Order of Conditions does not exceed the issuance date of the original Final Order of Conditions. 7. Any fill used in connection with this project shall be clean fill.Any fill shall contain no trash,refuse,rubbish,or debris,including but not limited to'lumber,bricks,plaster,wire,lath,paper,cardboard,pipe,tires,ashes,refrigerators,motor vehicles,or parts of any of the foregoing. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or the Land ' Court for the district in which the land is located,within the chain of title of the affected property.In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of the registered land,the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is done.The recording information shall be submitted to the Conservation Commission on the form at the end of this Order,which form must be stamped by the Registry of Deeds, ' prior to the commencement of work.. 10. A sign shall be displayed at the site not less then two square feet or more than three square feet in size bearing the words, "Massachusetts Department of Environmental Protection" ' [or'MassDE.P"] File Number:"003-5022" 11. Where the Department of Environmental Protection is requested to issue a Superseding Order,the Conservation Commission ' shall be a party to all agency proceedings and hearings before Mass DEP. 12. Upon completion of the work described herein,the applicant shall submit a Request for Certificate of Compliance(WPA Form 8A)to the Conservation Commission. 13. ' 16. This Order of Conditions shall apply to any successor in interest or successor in control of the property subject to this Order and to any contractor or other person performing work conditioned by this Order. 17. Prior to the start of work,and if the project involves work adjacent to a Bordering Vegetated Wetland,the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden stakes or flagging.Once in place,the wetland ' boundary markers shall be maintained until a Certificate of Compliance has been issued by the Conservation Commission. 18. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully stabilized with vegetation or other means.At no time shall sediments be deposited in a wetland or water body.During construction,the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed.The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission,which reserves the right to require additional erosion and/or damage prevention controls it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. NOTICE OF STORMWATER CONTROL AND MAINTENANCE REQUIREMENTS 19. The work associated with this Order(the"Project")is(1) Ci is not(2)R, subject to the Massachusetts Stormwater Standards.
