Hi Tom, Just writing to inform you of a stable located at 695 Wakeby Road,Marstons Mills that only has a license for three
(3) horses due to the fact that there is only 1.01 acres of land. Property is owned by Bernard Chase but is leased for the
stable by a woman named Suzanne Landers who resides at 4 St. John St., Hyannis. Her phone number is 508-778-6910.
The complaint/problem is that Suzanne Landers is maintaining 7 horses on the property and I have pictures proving this
situation exists.

PROPERTY. IT HAS BECOME A PROBLEM
FOR OWNER. 7 HORSES IN A 4 HORSE
BARN.
Actions Taken/Results: DZM investigated on 1/13/03 and found 7
horses on site along with piles of manure and
also many bags of manure stored in trailer.
Much manure from this site is also being
brought to her residence at 4 St. John St.,
Hyannis. DZM notified Tom Perry due to the
zoning violation of more than 3 horses on only
an acre of land. Suzanne Landers is being
called in before the BOH for a show cause
hearing on Feb. 18th. There are not seven
stalls at this property for seven horses. She
only has a license for three.

NOTICE TO ABATE VIOLATIONS OF 105 CMR 410.00, STATE SANITARY CODE H,
MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION AND THE TOWN
OF BARNSTABLE BOARD OF HEALTH NUISANCE CONTROL REGULATION
NUMBER ONE
The property owned by you located at 695 Wakeby Road, Marstons Mills was inspected on July
24, 2000, at 3:30 p.m. by Jerome Dunning, Health Inspector for the Town of Barnstable, because
of a complaint. The following violations of the Nuisance Control Regulation Number One
Regulation and the Sanitary Code H were observed:
Garbage observed on the ground beside the dwelling. This is a repeat violation,therefore,
we are issuing you a non-criminal violation.
You are directed to correct violations within seven (7) days of receipt of this notice.
You may request a hearing if written petition requesting same is received by the Board of Health
within seven(7) days after the date order is received. However, this violation must be corrected
regardless of any request for a hearing.
Please be advised that failure to comply with an order could result in a fine of not more than
$500. Each separate day's failure to comply with an order shall constitute a separate violation.
You are also subject to non criminal citations of$40.00 for the first violation and $15.00 for each
additional violation. Tickets will be issued daily until the violations are corrected. Enclosed is a
non-criminal ticket for $40.00 due to your failure to remove the garbage.

CITATION #G2161381 issued to Jacqueline C. Putnam for:

2) OPERATING MOTOR VEHICLE WITH REVOKED REGISTRATION
Observed MV #1 traveling east on Wakeby Rd. at excessive speed.
Following behind vehicle I clocked it's speed at 45 mph in an area posted 25
mph. Vehicle also was having a difficult time staying in it's lane.
I attempted to pull the vehicle over at the first safe location, on
Lovell's Ln. , but vehicle pulled into the driveway of #230 and stopped.
I spoke with the driver, asking for her license and registration. She
said her license was at home and gave me the registration. She told me her

name was Kelly Putnam and that she couldn't remember her license number. She
then changed her story and said she was Jacqueline Putnam which Kelly being
her middle name then finaly admitted Kelly was her daughter. She then said
her license was suspended and gave me her license number.
Registry of Motor Vehicle computer check revealed Putnam's license was
revoked and that the vehicle registration was also revoked.
I then placed Putnam UNDER ARREST and placed her in my cruiser. The
vehicle was at a relative's home and they stated the vehicle could be left
there. I secured the 2 registration plates for return to Registry of Motor
Vehicles .
I transported Putnam to the station and she was BOOKED by Sgt. Dowling.

STABLE REGULATION
The stable owned by you located at 695 Wakeby Road, Marstons ealtMills was ant for the

inspected on March 27, 1997 at 3:35 p.m. by Thomas McKean, H g
Town of Barnstable because of a complaint. The following violations were observed:
FART IX: SECTION 7 & II Manure waste matter was accumulating on the ground at
the north side and the west side of the stable building. In some locations the manure
material was at least four (4) inches deep. This manure was also piled within 100 feet of a
private water supply well.
PART IX: SECTION 5 Fencing around the pasture area had been broken in several
areas and was not strong enough to contain the horses.
NUISANCE CONTROL REG. #I Many bags of rubbish observed in the back of a pick-
up truck located to the north of the stable building. Also, piles of broken boards on the
ground located at the north side of the stable building. (In addition, the dumpster was full
to the top with rubbish and manure.)
These violations were also observed on June 7, 1996, May 11, 1993, August 4, 1992,
and April 6, 1992 and are therefore considered as recurring violations.
In addition, your personal checks for Board of Health stable permits were returned due to
insufficient funds. Therefore, you owe the Town of Barnstable $237.50 (cash or postal
money order) at the Town Treasurer's Office, 3rd Floor, 230 South Street, Hyannis, MA. f
You are ordered to correct the above listed violations within three (3) days of your receipt
of this order letter by: (a) removing all manure waste matter, (b) repairing or replacing
broken fencing around the pasture area , (c) removing all the rubbish from the property,

and (d) paying the Town of Barnstable Treasurer's Office $237.50 in cash or postal
money order.
You may request a hearing if written petition requesting same is received by the Board
within seven (7) days of this order.
Failure to comply with these orders will result in a Board of Health public show-cause
hearing on Tuesday April 15, at 7:00 p.m. at the Town Hall Hearing Room, 367 Main

FINAL NOTICE TO ABATE VIOLATIONS OF THE BOARD OF HEALTH
STABLE REGULATION
The stable owned by you located at 695 Wakeby Road, Marstons Mills was again
inspected on April 23, 1997 at 2:30 P.M. by Thomas McKean, Health Agent and Charles
Lewis, Animal Control Officer for the Town of Barnstbale because of a complaint. The
following violations were observed:
PART IX: SECTION 7 & H
Manure waste matter was accumulating on the ground at the north side and the west side
of the stable building in the paddock. In some locations the manure material was at least
(2) inches deep. A small manure pile was also observed within 10 feet of a private water
supply well.
PART IX: SECTION 5
Fencing around the pasture area had been broken in a few areas and had not been
replaced. Also, the fencing did not appear to be strong enough to contain the horses in
several areas..
Similar violations were also observed on June 7, 1996, May 11, 1993, August 4, 1992,
April 6, 1992, March 27, 1997 and April 9, 1997 and are therefore considered as recurring
violations.
In addition, your personal checks for Board of Health stable permits were returned due to
insufficient funds. Therefore, you owe the Town of Barnstable $237.50 (cash or postal
money order) at the Town Treasurer's Office, 3rd Floor, 230 South Street, Hyannis, MA.
On April 15, 1997, the Board of Health ordered you to pay all outstanding permit fees
within seven (7) days. However, as of April 23, 1997, the fees remain unpaid.

of this order letter by (a) Removing all manure waste matter. (b) Repairing or replacing
broken fencing around the pasture area and (c)Paying the Town of Barnstable Treasurer's

Health within seven (7) days of this order.

STABLE REGULATION
The stable owned by you located at 695 Wakeby Road, Marstons Mills was again
inspected on March 27, 1997 at 3:35 p.m. by Thomas McKean, Health Agent for the
Town of Barnstable because of a complaint. The following violations were observed:
PART IX: SECTION 7 & 11 Manure waste matter was accumulating on the ground at
the north side and the west side of the stable building. In some locations the manure
material was at least four(4) inches deep. This manure was also piled within 100 feet of a
private water supply well.
PART IX: SECTION 5 Fencing around the pasture area had been broken in several
areas and was not strong enough to contain the horses.
NUISANCE CONTROL REG. #1 Many bags of rubbish observed in the back of a pick-
up truck located to the north of the stable building. Also, piles of broken boards on the
ground located at the north side of the stable building. (In addition, the dumpster was full
to the top with rubbish and manure.)
These violations were also observed on June 7, 1996, May 11, 1993, August 4, 1992,
and April 6, 1992 and are therefore considered as recurring violations.

The reason I write to you today is Jackie Putnam.
For the past four years my neighbors and myself have had to deal with the
way she runs her stables. The last B.O.H. hearing concearning her stables
she was given a week to comply with guidlines set forth; one being to keep
her horses contained. Just four days after that hearing her horses were loose
again. Stampeeding through my yard and lawn as well as most of my neigh-
bors yards and lawn's.In my yard they stomped and destroyed 8 white pine
seedling's, and 24 deep hoof print's in my lawn. My neighbor's also had similar
damage, adding flower beds being stomped and destroyed by these animal's.
Being a former horse owner myself; I can tell you from experience that Jackie
in no way, shape or form cares for these animals the way they ought to be
cared for. These animals are made to walk around in their own feces for month's
on end. And as neighbor's we get to smell it. I viewed the t.v. broadcast of that
hearing and can tell you that every word Ms. Putnam had to say was a lie.
In closing, I hope that the Board Of Health will listen to us this time and close
her down; if not for us, the taxpayers, then for these abused animal's.

Yes- The stable permit was issued 7/31196 under the authority of MGL c.111 s. 155. It remains valid
today.
According to Gloria Urenas, the property is within an RF zone and horse stabling is allowed there. Due to
the lot size, three horses are allowed there. There are in fact three horses there now.
If the judge asks what are you going to do with the horses, perhaps we could answer "the sheriff's youth
ranch has offered to take them."
My question is whether the Board of Health (after proper notice and holding a public hearing with a solid
record) would have the authority to issue an order to remove the horses from the property.

Does she have a stable permit? When was it issued, and under what authority? I know we have a zoning
provision allowing stabling of horses in residential areas. Is this such a situation? Is it a pre-existing,
non-conforming use (if you know).
Assuming we are dealing with a stable permit under M.G.L. c. 111 §§, 155, 158, it is possible that a
proper revocation, after notice and hearing, with a solid record, could be followed by seeking an injunction
in the Superior Court against operation of a stable without the permit. If we arrive at that point, I want to
have an answer for the judge when he asks me "What are you going to do with the horses when I close the
place down, Mr. Smith?" That contingency plan will have to come from you.

Brian Grady, BOH member, posed the question yesterday.
At 695 Wakeby Road,_aque.U0g Putnam operates a horse stable. There are three horses there. Over the
past four years and during recent weeks there have been recurring health violations, including manure piles
on the ground and broken fences in the stable area. The horses have been running loose onto other
neighboring properties, endangering children and causing destruction to lawns and flowers. The
neighborhood submitted a petition to the Board four years ago regarding these problems, seeking action by
the BOH.
Now, the neighbors are now complaining again. Police Sargeant Damery confirmed to me that the horses
were running loose two Sundays ago. I again observed manure piles on the ground and broken fencing
there two days later.
I continually hand Ms. Putnam order letters to correct the violations. She does a little bit of work, but the
problems re-occur.
Please advise Mr. Grady whether the Board of Health can revoke the stable permit and order Ms. Putnam to
remove the horses from the property.

Donna Miorandi, Health Inspector for the Town of Barnstable
because of a complaint. The following violations of Part IX
Stable Regulation and Nuisance Control Regulation Number
One were observed:
PART IX
STABLE REGULATION: Operation of a stable without a valid
stable permit from the Board of Health.
PART IX
STABLE REGULATION: Waste matter disposed on the ground at
the property, and is in close proximity
(within ten feet) to a private drinking
water source.
The Health Department mailed a certified order letter to the
owner of the subject property Mr. Bernard Chase on April 7 ,
1992 concerning the manure and bags of trash at the
property. Mr. Chase received the letter on April 8, 1992 .
However, the manure was not disposed in a sanitary manner.
You are directed to cease and desist operation of the stable
O ten (10) days of receipt of this notice. The horses must be
removed within' ten (10) days of receipt of this notice.
You may request a hearing if written petition requesting
same is received by the Board of Health within seven (7)
days after the date order is received. However, the waste
matter must be removed and disposed of in a sanitary manner
tggArd1@@@ of any request for a hearing.

Please be advised that failure to comply with an order could
result in a fine of not more than $500. Each separate day's
failure to comply with an order shall constitute a separate
violation.
You are also subject to non criminal citations of $40.00 for
the first violation and $15.00 for each additional
violation. Tickets will , be issued daily until the
violations are corrected.

Section 28. Beasts taken up by a field driver in a town which adopts 1
this section or has adopted corresponding provisions of earlier laws may 2

be impounded on his own premises; and for the purposes of this chapter 3
he shall be considered a pound keeper, and such place on his premises 4
shall be considered a town pound relative to beasts therein impounded. 5
49:29. Remedies for damage done by untended animals.
Section 29. If a person is injured in his land by horses, mules, asses, 1
neat cattle, sheep, goats or swine, he may recover his damages in an 2
action against the owner of the beasts or by distraining the beasts doing 3
the damage and proceeding therewith as hereinafter directed.

49:30. Care of distrained animals.
Section 30. Beasts so distrained shall be impounded in the pound or 1
in some suitable place under the immediate care and inspection of the 2
distrainor, and he shall furnish them with suitable food and water while 3
they remain impounded.

49:31. Duties of distrainor.
Section 31. If the beasts are impounded in the pound, the distrainor 1
shall leave with the pound keeper a memorandum in writing, under his 2
hand, stating the cause of impounding and the amount which he demands 3
from the owner for the damage done by them, and also for the daily 4
charges of feeding them; and if the
y are impounded in any other place, 5
he shall on demand give a like memorandum to the owner.

49:32. Release of distrained animals; conditions.
Section 32. The pound keeper shall not deliver the beasts to the 1
owner until his fees, the amount so demanded by the distrainor for the 2
damages and charges aforesaid, the expense, if any, of advertising, and 3
all other legal costs and expenses have been paid to him.
