As we discussed at our meeting of October 30, 2018, Gifford Brothers Sand & Gravel (Gifford
Brothers)and TJA Clean Energy(TJA)would like to modify the Comprehensive Site Assessment
Scope of Work(CSA-SOW)that was approved in the Department's January 30, 2007 Provisional
Approval for the Corrective Action Design (CAD) for the referenced site.
SITE CHARACTERIZATION
iSince the CAD,dated October 26,2006,was issued,a significant amount of site clean up work has
been accomplished by Gifford Brothers. The attached Figures 1 and 2,in plan and aerial photograph
format,show the existing conditions of the site in 2005,respectively. As noted on the figures,there
were potential contamination sites identified as a stump dump, a pile of an estimated 10,000 tires,
a pile of unprocessed asphalt,brick and concrete(ABC),a pile of processed ABC and a substantial
' amount of junk vehicles. Between 2005 and 2007 Gifford Brothers excavated,ground and screened
the stump dump and either sold off the product as mulch or soil and retained a portion of the
processed material on site for use as top soil. The tire pile has been removed and sent to a tire
recycler. The unprocessed ABC was processed(crushed)and removed from the site,along with the
processed ABC,for reuse as aggregate. Figure 3,a 2007 aerial view,indicates how the site had been
excavated and cleared in those areas, when compared to the 2005 aerial. Also in 2007, seven soil
samples were taken in the areas that had previously been the site of the unprocessed and processed
1 ABC piles. The samples were analyzed for EPH, PCBs and metals. The results indicated no
exceedances of MCP S-1 standards. The laboratory reports are attached. Figure 4 is a current
t (February 2018)aerial photograph that shows the site as partially revegetated in the areas that were
cleared in the 2007 aerial photograph and that there is a significant reduction in the number of junk
vehicles from 2005.

PROPOSED CSA-SOW
' Gifford Brothers and TJA believe that the previous site remediation work has removed all potential
contamination source materials and that the removal of the source material has mitigated the
potential of impacting groundwater in the vicinity of 810 Wakeby Road. Consequently, Gifford
Brothers and TJA are requesting MassDEP to approve a revised CSA-SOW that will update the
site's environmental characterization,conduct a sampling and analysis program that will confirm the
removal of potential contamination source material at identified locations and any currently
unidentified locations that my indicate potential contamination and sample an existing on-site
irrigation well.
' Environmental Site Characterization
' Using available information from MassDEP, the Town of Barnstable and the Town of Sandwich,
potential environmental receptors and resources will be identified and characterized,to at least 500
feet from the site's perimeter. Information sources will include Massachusetts GIS mapping along
with any GIS information that Barnstable and Sandwich may provide, relative to such things as
resource protection districts and groundwater flow direction. The Towns' Board of Health and
Water Department records will be reviewed to determine if there are any private wells and to confirm
the presence of public water supply systems in the vicinity of the site.

Site Investigation
The purpose of the site investigation work will be to confirm that the site remediation work, done
to date, has removed potential contamination sources that could threaten environmental receptors
1 and that the site can be closed as a solid waste facility. Figure 5 shows a proposed soil sampling
program in the identified areas where materials were previously stored and have been removed. The
sample grids represent areas of approximately 2,500 square feet (50' x 50'). Samples will be
composited from within the top two feet of each of the approximate grid areas. Each sample will
be analyzed for metals, SemiVOCs, PCBs and TPH. In addition the rest of the site will be canvased
for any signs of contamination, such as stained or odorous soils and pockets of stressed vegetation.
' Any of these areas will also be sampled and analyzed as described above,with the possible addition
of analyzing for VOCs, where signs of potential contamination can be the result of fuel spills.
Should soils analysis indicate the presence of contamination ofgreaterthan MCP S-1 criteria,further
remediation,such as soils removal may be conducted in that area. Further sampling and analysis of
' residual soils will be conducted to confirm that contamination above MCP S-1 levels, has been
removed. The excavated material will then be properly removed from the site for reuse or disposal,
tusing either a Bill of Lading(BOL) or Material Shipping Record(MSR) procedure.
In addition there is an irrigation well located on site,approximately where shown on Figure 5. The
well will be purged and sampled for the parameters listed above and VOCs. Also, if any private
wells are found to be located within 500 feet of the site, a request will be made to the well's owner
to sample their well.

' Site Assessment Report
A Comprehensive Site Assessment Report will be prepared which will present the results of the
Environmental Site Characterization and Site Investigation work described above. The report will
summarize the findings of the Environmental Site Characterization by tabulating and graphically
depicting locations of identified receptors and resources within a 500 foot radius of the site. Using
that information the applicable groundwater criteria will be determined for the site. If there are
critical receptors and resources in the vicinity of the site, possible mitigation measures, such as
providing a public water supply connection and abandonment of a private well, may be proposed.
The report will includ
e de a description of all of the Site Investigation work that has been conducted.
Activities will be documented with photographs,field logs and laboratory reports. Laboratory data
will be tabulated and compared to the applicable standards that are developed in the Environmental
Site Characterization summary,described above. Should any remedial action,such as soil removal
be performed,that work and laboratory reports of removed and residual materials will be included
' and evaluated. Conclusions and recommendations will be developed and presented in the report,
which will determine whether closure of the site as a solid waste facility is appropriate, or whether
further action may be required to attain that status. The report will be submitted to MassDEP for its
approval.

designed to assess the precision of analytical results in a given matrix and are expressed as
' relative percent difference (RPD). Values which are less than five times the reporting limit for any
individual parameter are evaluated by utilizing the absolute difference between the values; although
the RPD value will be provided in the report.

A storage shed at a former Junk yard In Marstons Mills was destroyed by fire Sunday after-
noon, according to the Centerville-Osterville-Marstons Mills Fire Department. A neighbor

4:45pm 1/03/2010-COMM Fire Department requested a Health Inspector at the scene of
an explosion/fire at 810 Wakeby Road, Marstons Mills.
Request Work History:
Entered on 1/5/2011 8:23:37 AM
DZM responded and took pictures. It was a shed fire that was caused by an unknown factor. It
is in ZOC-no wetlands nearby. It is a 16 acre parcel formerly owned by Gifford and known as the
"Gifford Pit". It is now owned by Wakeby Road Realty Trust/Christopher Keyes, phone 3508-888-
3400. Captain Eldredge of COMM Fire Dept was the Incident Commander and many fire dept
personnel were on the scene including cotuit for assistance. Wakeby Road was shut down for this
period of time. DZM called DEP and spoke to Julie Hutcheson. Julie went to the site on 1/4/2011
with Cynthia Martin, Hazardous Material Inspector of Barnstable Health. No imminent problems-
premise was that anything that was on site went up in air with the fire. Cynthia Martin shall follow
up with later inspections.

Dear Mr. Taurasi:
I am writing to seek the Department's assistance in investigating possible
violations of the Department's regulations regarding the recent disposal of asphalt
concrete, stumps, tree branches and soil, at a sixteen-acre parcel located at 810 Wakeby
Road, Marstons Mills, Massachusetts. This site is found in the town's groundwater
protection overlay district and therefore, is of particular sensitivity and concern to the
Board of Health.
By way of brief background, the site in question as been the subject matter of
litigation in the Barnstable Superior Court based on a cease and desist order issued by
Building Commissioner ,prohibiting all activities on the site, except for residential use and
the salvage operations, consistent with previously issued permits. After a trial held in
April of 1999, the Court sustained the Zoning Board of Appeals and Building
Commissioner, except for the removal of sand and gravel in a five-acre area of the
property closest to Wakeby Road. The Court acknowledged that there may be no more
sand and gravel to mine in that area. (The superior court decision is on appeal). It is my
understanding that there has been no removal of gravel from the specified area for
several years.

In addition, I am advised that the Department has been in discussions since 1997
with Christopher Keyes, the president of Gifford Brothers Sand and Gravel Inc.,
regarding the entry of an administrative consent order regarding the property. As far as I
know, there has been no such consent decree executed. However, Mr. Keyes has
raised his discussions with the Department as a justification for continuing to engage in
activities which the town and now the superior court have determined are impermissible
but which Mr. Keyes has claimed are required by the Department as part of a cleanup of
the premises.
Based upon an investigation undertaken by the Barnstable Police Department
regarding continuing zoning violations on the property, the Board of Health has been
made aware that broken asphalt and concrete have been disposed on the property with
some frequency. Additionally, stumps, tree branches and other like materials have been
brought into the property as well. (See copy of affidavit of Paul Everson enclosed
herewith). No prior notice or approval was provided to or given by the Barnstable Board
of Health for the commencement of these activities. Particularly because of the parcel's
location in a groundwater protection overlay district, the Board requests the Department's
assistance in evaluating whether the dumping of concrete and asphalt as well as stumps,
brush and other materials is in conformance with the Department's regulations and state
law.

I, Detective Paul Everson, being duly sworn, depose and say:
1) 1 have full knowledge of the facts stated herein and am competent
to testify to these facts.
2) 1 hold the position of detective in the Barnstable Police Department.
I have been employed by the Barnstable Police Department for approximately 20
years.
3) On or about September 24, 1999, 1 met with Barnstable Town
Attorney Robert D. Smith concerning the Gifford Brothers Sand and Gravel, Inc.
case and was asked to investigate complaints that Gifford Sand and Gravel Inc.
was not complying with the Findings of Fact, Rulings of Law and Order of
Judgment, dated June 25, 1999 issued in Gifford Sand and Gravel Inc. v. Zoning
Board of Appeals, Town of Bamstable, Case No. 98-87. As a result of this

meeting, I conducted an investigation into the activities being undertaken at the
property located at 810 Wakeby Road, Marstons Mills.
4) As part of my investigation, on or about September 25, 1999, 1
spoke with Patricia Gifford of 800 Wakeby Road, regarding the operation at the
location. Patricia Gifford relayed to me a history of the property as it pertained to
her family. Patricia Gifford stated that she was no longer involved in the daily
operation of the property. However, she stated that she retained an ownership
interest in the property. According to Mrs. Gifford, whatever business enterprises
are being undertaken at the site located at 810 Wakeby Road, Marstons Mills are
being initiated and run by Mr. Keyes.
5) On September 25, 1999, I also interviewed a Mr. James P.
McDonough of 111 Mockingbird Lane, Marstons Mills. Mr. McDonough showed
me where his property abuts the rear of 810 Wakeby Road. Mr. McDonough
showed me where the property of 810 Wakeby Road had been cleared up to his
property line as well as the adjacent abutters.
6) On October 12, 1999, 1 viewed the processing of what appears to
be a loam pile on the 810 Wakeby Road property from the property of the
McDonoughs.
7) On or about October 15, 1999, 1 observed an 18-wheel tractor
trailer, Child's Trucking, South Dennis, transporting materials to the 810 Wakeby
Road property.
8) On October 26, 1999: 1 again met with Patricia Gifford at her home
at 800 Wakeby Road. At this time, I observed a front-end loader working just

behind the Gifford residence. The operator of the machine was actively
screening and processing various piles of loam and earth, loading it into a green
sifting machine, which mechanically processed this material. Patricia Gifford
showed me the pile of concrete and tar dumped on the 810 Wakeby Road,
Marstons Mills, MA property by Child's Trucking and Deco Trucking on October
14, 1999 and October 15, 1999. 1 also observed the Sky Frog Tree Service
truck and trailer enter the premises and deposit a construction trailer.
9) On or about October 27, 1999, 1 spoke with Mr. Charles Childs,
owner of Child's Trucking. I asked Mr. Childs about the dumping of debris on the
property at 810 Wakeby Road. Mr. Childs, upon checking his records, reports to
me that he did have a truck working a "sub-contract" for RH Construction on the
dates in question. Upon contacting the driver who operated the truck on these
dates, Mr. Childs confirmed that his truck did deposit materials at 810 Wakeby
Road. The driver, a Mr. Warren Crooker, confirmed that he picked up three
loads of concrete and tar from a Falmouth construction site and dumped them at
810 Wakeby Road, Marstons Mills. RH Construction is run by Randy Harnois.
Mr. Crooker further adds that the demolition of materials came from a site on
Bridge Street in Falmouth.
